Regulations of Jilin Province on the Administration of Construction Market (revised in 221)

chapter I general provisions article 1 in order to strengthen the management of the construction market, maintain the order of the construction market, protect the legitimate rights and interests of the parties involved in construction business activities, and ensure the quality and safety of construction projects, these regulations are formulated in accordance with the construction law and relevant laws and regulations, combined with the actual situation of this province. Article 2 Anyone who engages in construction market management and construction business activities within the administrative region of this province must abide by these regulations.

the construction market as mentioned in these regulations refers to the contracting, contracting and intermediary entrustment of construction projects and other construction business activities.

the construction projects mentioned in these regulations refer to civil engineering, building engineering, line and pipeline engineering, equipment installation engineering, decoration engineering and demolition engineering.

the construction business activities mentioned in these regulations include the survey, design, construction and supervision of construction projects, the use of building materials, building components and ready-made concrete, and the contracting, contracting and intermediary services of construction projects. Article 3 Construction business activities must adhere to the principles of fair competition, legal transactions and good faith.

the construction market credit management system shall be implemented, and the construction administrative department shall regularly publish the credit status of the main body of construction business activities and employees. Fourth people's governments at or above the county level construction administrative departments to implement unified supervision and management of the construction market within their respective administrative areas. The administrative department in charge of construction may entrust its subordinate management institutions such as quality supervision, safety supervision, survey and design, tendering and bidding, engineering earthquake resistance, cost, construction, bulk cement, wall reform, urban construction archives, etc. to be responsible for daily management.

other administrative departments of the people's governments at or above the county level related to the management of the construction market shall do a good job in the relevant management within the scope of their duties. Chapter II Qualifications and Qualifications Article 5 Units engaged in construction business activities must obtain qualification certificates issued by construction administrative departments according to law.

the construction unit shall contract out or entrust the survey, design, construction, decoration, supervision and bidding agency of the construction project to a unit that meets the qualifications stipulated by the state. Sixth professional and technical personnel who implement the national registration system can be employed only after registration.

in accordance with national and provincial regulations, professional and technical personnel engaged in construction management, construction supervision and project cost shall obtain corresponding qualification certificates according to law. Article 7 Units that enter our province from abroad to engage in survey, design, construction, supervision and intermediary service activities shall issue business licenses, qualification certificates and corresponding personal practice certificates to the construction administrative department of the provincial people's government for the record. Article 8 The establishment of a tangible construction market that provides places and services for bidding activities and charges according to law shall be examined and approved by the construction administrative department in accordance with relevant regulations. The physical construction market should be separated from the relevant government departments and their affiliated institutions. Article 9 The principal responsible persons, project leaders, full-time managers of production safety and special operators of construction enterprises shall, in accordance with the relevant provisions of the state, obtain corresponding post certificates after examination by the construction administrative department of the provincial people's government before taking up their posts or taking up their posts. Technical labor service operators engaged in construction activities of construction projects shall go through the prescribed pre-job technical training and obtain professional qualification certificates before taking up their posts. Article 1 No unit or individual may buy, sell, lease, lend, alter or forge various qualifications, qualification certificates and practicing seals.

Construction enterprises are prohibited from allowing others to undertake projects in their own name. Chapter iii project contracting article 11 before contracting out a construction project, the construction unit shall file the following contents with the municipal (state) and county (city) construction administrative departments where the project is located:

(1) name of the project;

(2) the construction site;

(3) Project scale;

(4) Total investment;

(5) the amount of investment in the current year;

(6) sources of funds;

(7) bank credit certificate;

(8) documents for examination and approval, approval or filing by relevant departments;

(9) estimated commencement and completion dates;

(1) Contract awarding method;

(11) technical and economic management personnel of the construction unit. Article 12 The survey, design, construction, supervision and procurement of important equipment and materials related to engineering construction of large-scale infrastructure and public utility projects that use state-owned funds or state financing in whole or in part, loans and aid funds from international organizations or foreign governments, and are related to social interests and public safety shall be invited for bidding.

the contracting-out methods for construction projects other than those specified in the preceding paragraph shall be determined by the contracting-out unit.

no unit or individual may break up the items that must be subject to tender according to law or evade the tender by other means. Article 13 All construction projects invested by state-owned funds, or construction projects in which state-owned funds play a controlling or leading role, and the survey, design, construction and supervision of projects with loans and aid funds from international organizations or foreign governments, as well as the procurement of important equipment and materials related to construction projects, shall be invited by public bidding, and the system of winning the bid at a reasonable low price after evaluation, comprehensive evaluation and bidding without pre-tender price shall be implemented.

the bidding method of other construction projects that should be contracted out through bidding shall be determined by the employer.

in case of inviting tenders, there must be at least three legal persons or other organizations with the survey, design and construction capabilities of the project subject to tender and corresponding qualifications to participate in the tender.
