Notice of Hengyang County People's Government on Renovating Rural Illegal Occupation of Cultivated Land for Building Houses and "Greenhouse Houses"

First, strictly implement the "Ten Prohibitions"

First, it is not allowed to occupy permanent basic farmland to build houses;

Second, it is not allowed to occupy more cultivated land to build houses;

Third, it is not allowed to buy, sell or transfer cultivated land to illegally build houses;

Fourth, illegal building on contracted farmland is not allowed;

Fifth, it is not allowed to illegally occupy cultivated land to build houses under various excuses;

Sixth, it is not allowed to occupy cultivated land to build houses in violation of the provisions of "one household, one house";

Seventh, illegal sale of houses built on cultivated land is not allowed;

Eighth, it is not allowed to illegally approve the occupation of cultivated land for building houses;

Nine, it is not allowed to build projects unrelated to agricultural production in the name of agricultural facilities;

Ten is not allowed to exceed the standard construction of agricultural facilities such as nursing homes.

Second, illegal construction is strictly prohibited.

Since July 3, 2020, units and individuals who violate the "Ten Prohibitions" within the county should immediately stop construction, dismantle illegal buildings and other facilities on cultivated land or other land, and take the initiative to reclaim and restore the land to its original state. Those who refuse to dismantle new illegal buildings and other facilities by themselves will be forcibly demolished according to law. There is "zero tolerance" for illegal acts such as illegal land occupation, excessive land occupation, illegal buying and selling of collective land for building houses, and illegal new construction. Those who violate the criminal law will be investigated for criminal responsibility according to law.

Third, strictly regulate the examination and approval behavior

Villagers building, rebuilding and expanding rural housing shall be reported to the relevant departments for examination and approval in strict accordance with the regulations; Belonging to agricultural facilities projects, land registration shall be handled in accordance with the provisions. No construction shall be carried out without approval or filing according to law, and the construction without approval shall be resolutely put an end.

Fourth, serious accountability and accountability.

Those who refuse to correct illegal land use and illegal construction, and resist law enforcement departments to perform their duties according to law by violence or threats, shall be severely punished by the public security organs according to law, and shall be investigated for criminal responsibility according to law if the case constitutes a crime. National public officials who support, participate in, cover up, connive, collude in the illegal sale and purchase of land and illegally occupy land for building houses should be strictly investigated for relevant responsibilities.
