Code of Conduct for Police on Duty in Detention Center (for Trial Implementation)

Chapter I General Principles

Article 1 In order to strengthen the regularization of the police force in detention centers, standardize duty behaviors, cultivate excellent vigilance, establish a strict, fair and civilized law enforcement image, and ensure the smooth progress of supervision, this Code is formulated in accordance with the People's Police Law of the People's Republic of China, the Regulations of People's Republic of China (PRC) Detention Center and the Internal Regulations of the People's Police of Public Security Organs.

Article 2 The term "duty behavior" as mentioned in this Code refers to the words and deeds of the police in detention centers when performing their duties.

Article 3 The police in detention centers must strictly abide by this Code when they are on duty.

Chapter II Basic Requirements

Fourth detention center police should do:

Be loyal to their duties and enforce the law impartially;

(2) Honesty and self-discipline;

(three) according to law, strict, scientific and civilized management.

Fifth detention center police shall not have the following acts:

(1) Releasing detainees without permission;

(2) Dereliction of duty;

(3) Asking for, accepting, encroaching on or borrowing the property of detainees and their relatives and friends, or accepting invitations to eat;

(4) extorting confessions by torture or corporal punishment, ill-treatment or humiliation of detainees;

(5) Beating or conniving at others beating detainees;

(6) using criminals to provide services for personal gain;

(seven) to deliver messages, letters and articles for detainees without permission, and to arrange for detainees to meet relatives and friends, deliver articles and make phone calls without permission;

(8) handing over detainees to others for supervision;

(nine) other violations of law and discipline.

Chapter III Police Capacity

Article 6 The police in detention centers shall wear police uniforms, duty certificates and police equipment according to the Regulations on the Dress Management of People's Police of Public Security Organs, and keep their police appearance clean and tidy.

Article 7 The police of a detention center shall keep their appearance clean and tidy when on duty. Male policemen should not wear colored hair, nails, heavy makeup, jewelry, long hair and beard, and female policemen should wear braids over their shoulders.

Article 8 The police of a detention center shall behave solemnly, be full of energy and have a correct posture when on duty.

Article 9 The police of a detention center shall consciously maintain the environment, sanitation and office order of the detention center, and ensure that the articles are neatly placed, the house is standardized, the sanitation is clean and tidy, and the order is orderly.

Chapter IV Etiquette and Reception

Tenth detention center police on duty shall abide by the following etiquette:

(a) to meet the leadership inspection, inspection, detention center police should raise their hands; When it is inconvenient to raise your hand because of duty, you can raise your eyes.

(2) When meeting with the leaders and other colleagues of our firm, they should exchange greetings; When handing over posts, you should salute each other.

Article 11 When receiving investigators and lawyers, the police in detention centers should take the initiative to say hello, provide warm service and provide convenient conditions according to law, and must not shirk, shirk or play an attitude under any excuse. Matters that cannot be handled according to law should be clearly explained and patiently explained.

Article 12 When receiving relatives and friends of detainees, the police in detention centers should take the initiative to greet, patiently answer questions raised, take the initiative to introduce the civilized management of detention centers according to law, and solicit opinions and suggestions on the work of detention centers. The meeting and delivery should be arranged in time according to the regulations, and the reasons should be clearly stated if not arranged. It is forbidden to be cold, hard, horizontal or pushed.

Chapter V Diligence

Fourteenth detention center police should stick to their posts, be serious and responsible, and standardize civilized work. Do not go to work after drinking, leave without leave, sleep, chat, drink, eat snacks, entertain or engage in other activities that hinder service.

It is strictly forbidden to use detainees to manage detainees.

Female police officers should manage female detainees. Male police officers are not allowed to enter the women's prison area and women's prison room alone, and are not allowed to talk to female detainees alone.

Article 17 The police in detention centers should be familiar with the basic situation, major cases, litigation process and ideological trends of detainees, actively carry out educational transformation, urge detainees to plead guilty and obey the supervision, and voluntarily confess and expose illegal and criminal activities.

Eighteenth detention center police should pay attention to ways and means in management and education, so as to achieve civilized management according to law.

(a) timely inform and effectively protect the legitimate rights of detainees according to law. When punishing a detainee, the facts, basis and procedure of punishment shall be explained.

(two) respect for the personality and dignity of detainees, and respect for the living habits of ethnic minorities and foreign detainees. Detainees should use standardized language, must use their names or numbers, and must not use nicknames or other insulting or discriminatory language. (3) fully mobilize the enthusiasm of detainees to accept supervision and plead guilty to the law, strive for in-depth and meticulous work, teach students according to their aptitude, convince people by reasoning, and affect people, truly save them, truly influence them, and put an end to simple and rude management methods.

(4) Caring for the thought, life and health of the detainees, seriously answering the questions raised by the detainees according to law, solving the difficulties of the detainees, and explaining the reasons for those who do not meet the requirements or are difficult to solve by the detention center itself. Ill detainees should be given timely treatment and life care.

Article 19 The police in a detention center should maintain a high degree of safety awareness and vigilance when on duty, strictly abide by the patrol system of more than two people on duty for 24 hours, closely monitor the detainees, strictly control the safety of all work links, and prevent all kinds of accidents.

Twentieth detention center police should be familiar with the plans to deal with all kinds of accidents and incidents, and actively participate in drills. When an accident or incident occurs, you should obey the unified command and mobilization, act tactfully, decisively and quickly, and handle it properly.

Twenty-first in addition to handling major accidents, incidents and other necessary circumstances, the police of the detention center shall not carry weapons into the prison area.

Twenty-second detention center police should use restraint in strict accordance with the relevant provisions.

Chapter VI Supplementary Provisions

Twenty-third this specification applies to all levels of public security organs, railways, transportation, civil aviation, forestry systems, and police in detention centers affiliated to public security organs.

Twenty-fourth in violation of this code, if the circumstances are minor, it should be criticized and corrected on the spot; If the circumstances are serious, it shall be dealt with accordingly in accordance with relevant regulations; If a crime is constituted, criminal responsibility shall be investigated according to law.
