Provisions of Guangzhou Municipality on the Protection and Management of Liuxihe Water Conservation Forest

Article 1 In order to strengthen the protection and management of Liuxihe water conservation forest (hereinafter referred to as water conservation forest), ensure Liuxihe water supply, purify water quality and prevent soil erosion, these Provisions are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Forest Protection and Management of Guangdong Province and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 Liuxihe water source forest refers to forests, trees and woodlands that can conserve water and purify water quality within the protection scope of Liuxihe water source forest.

The protection scope of Liuxihe water source forest includes: Dongming Town, Lutian Town, Tian Liang Town, Taoyuan Town, Wenquan Town and Wenquan Nature Reserve in Conghua City, Liuxihe Forest Farm, Dalingshan Forest Farm and water source forest within the planning line of Huanglongdai Reservoir management. Article 3 These Provisions shall apply to the planning, protection, construction and management of Liuxihe water source forest. Fourth Liuxihe water source forest to implement unified planning and hierarchical management.

The municipal forestry administrative department is the competent department in charge of planning, protection, construction and management of Liuxihe water source forest, and is responsible for organizing the implementation of these Provisions.

The forestry administrative department of Conghua City and the Town People's Government within the scope of protection are responsible for the protection, construction and management of water source forests within their respective jurisdictions.

Planning, finance, urban construction, environmental protection, land, highways, minerals, water conservancy, power supply, public utilities and tourism departments shall, in accordance with their respective responsibilities, coordinate the implementation of these Provisions. Article 5 People's governments at all levels shall incorporate the construction and protection of water source forests into national economic and social development plans and environmental protection plans. Water source forest tending management funds should be included in local financial budgets at all levels. Raise funds for water source forest protection and construction through multiple channels. Sixth Liuxihe water source forest to implement the interest compensation system. Compensation shall be given to forest owners or operators whose economic benefits are affected by the delineation of water source forests. The specific measures for raising compensation funds and compensation shall be formulated by the Guangzhou Municipal People's Government. Article 7 Coniferous forests, sparse forests, over-mature forests or forests with serious diseases and insect pests below 800 meters above sea level in water source forest areas shall be renovated in a planned way, and an ecological public welfare forest mainly composed of evergreen broad-leaved forests or coniferous and broad-leaved mixed forests shall be gradually built. Article 8 Within the protection range of Liuxihe water source forest, where timber production is the main source of livelihood, with the approval of Guangzhou forestry administrative department, no more than 15% of forest land can be set aside to develop economic forest in a planned way. Article 9 The Town People's Government and relevant units shall set up permanent signs in the water source forest areas, set up fire prevention lines according to the topography, delimit the responsibility areas for management and protection, equip full-time forest guards, and strengthen forest fire prevention and pest control. Article 10 The following acts are prohibited within the scope of water source forest:

Illegal logging and deforestation;

(2) Quarrying, mining, earth borrowing, reclamation and building renovation;

(3) branching, tapping and hunting;

Violating the provisions on the use of fire in the wild;

(five) other acts prohibited by laws and regulations. Eleventh strictly control the cutting of water source forest, and if it is really necessary to cut or rebuild toilets, it shall be handled in accordance with the following provisions:

(a) township collective forest area, by the county-level city forestry department to apply;

(two) the forest area under the jurisdiction of Huanglongdai Reservoir Management Office shall be applied by its superior competent department;

(three) the municipal state-owned forest farm by the director to apply;

The application for items (1), (2), (3) and (3) of the preceding paragraph shall be approved by the administrative department of forestry of Guangzhou City and the cutting license shall be issued before it can be carried out. Twelfth any unit or individual shall not change the use of water source forest without authorization. If it is really necessary to use the water source forest for other purposes, it must be examined and approved by the administrative department of forestry of Guangzhou City, and the examination and approval procedures shall be handled in accordance with relevant laws and regulations. Thirteenth in violation of the provisions of article tenth, article eleventh, article twelfth, by the city and county forestry administrative departments in accordance with the "China people's forest law" and its implementation details. Fourteenth in violation of land management, environmental protection and water resources management and other relevant laws and regulations, by the relevant administrative departments in accordance with the law. Article 15 If the staff of the government and relevant departments abuse their powers, neglect their duties or engage in malpractices for selfish ends, causing serious damage to the water source forest, they shall be given administrative sanctions by their units or the competent department at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law. Article 16 Whoever destroys water source forests or makes things difficult, hinders, besieges or beats public officials who perform their duties according to law shall be dealt with by public security organs in accordance with the regulations on administrative penalties for public security; If a crime is constituted, criminal responsibility shall be investigated according to law.
