Trial Measures of Wuxi Municipality on Relatively Centralized Administrative Punishment Right in Urban Management

Chapter I General Provisions Article 1 In order to strengthen urban management, maintain urban order, improve the level and efficiency of administrative law enforcement, and protect the legitimate rights and interests of citizens, legal persons and other organizations, these Measures are formulated in accordance with the Administrative Punishment Law of the People's Republic of China and other relevant laws, regulations and rules, combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the urban areas of Wuxi. Article 3 Wuxi City Administration and Law Enforcement Bureau (hereinafter referred to as the Municipal Law Enforcement Bureau) shall be responsible for organizing the implementation of these Measures. The District Urban Management Law Enforcement Bureau (hereinafter referred to as the District Law Enforcement Bureau) is responsible for the relatively centralized power of administrative punishment within its jurisdiction in accordance with the prescribed functions and powers. City, district urban management administrative law enforcement agencies entrusted by the law enforcement bureau at the same level, in accordance with the law within the scope of administrative punishment and administrative enforcement measures. Article 4 The Urban Management Security Department of Wuxi Public Security Bureau shall cooperate with the Law Enforcement Bureau to do a good job in the pilot work of relatively centralized administrative punishment power in urban management.

Urban management, planning, gardening, industry and commerce, environmental protection, municipal utilities, public security and other relevant administrative organs shall cooperate with the law enforcement bureau to do a good job in relatively centralized administrative punishment. Article 5 The Law Enforcement Bureau shall relatively concentrate on exercising the power of administrative punishment as stipulated by laws, regulations and rules on the administration of city appearance and environmental sanitation; Exercise part of the administrative punishment rights stipulated by laws, regulations and rules such as urban planning management, urban greening management, industrial and commercial administration, environmental protection management, municipal management and public security traffic management. Sixth after the relative concentration of administrative punishment, the relevant administrative law enforcement departments shall not exercise the centralized administrative punishment power of the law enforcement bureau. If it is still exercised, the decision on administrative punishment made is invalid. Chapter II Management of City Appearance and Environmental Sanitation Article 8 Anyone who commits any of the following acts shall be ordered to correct the illegal act and take remedial measures, and may detain the working tools in accordance with regulations and be fined:

(a) spitting, urinating, dumping sewage, littering, punishable by a fine of more than 5 yuan and less than 200 yuan;

(two) in the city buildings, facilities and trees graffiti or unauthorized display, posting promotional materials, punishable by a fine per 10/0 yuan;

(III) Decorating, stacking and hanging articles that hinder the appearance of the city on the balconies and windows of street-facing buildings on both sides of urban roads, and imposing a fine of 10 yuan or above 100 yuan;

(4) Failing to dump garbage and feces at the prescribed time, manner and place, and imposing a fine of more than 200 yuan 10 yuan; Failing to dump garbage and feces in the prescribed way, causing pollution, or dumping garbage on both sides of urban roads and rivers, and imposing a fine of not less than 3,000 yuan from 200 yuan;

(5) Failing to seal, wrap or cover liquid or bulk goods, resulting in leakage or spillage, and imposing a fine of more than 5 yuan 10 yuan per square meter according to the area and pollution degree of the polluted road;

(VI) Street-facing construction sites are not provided with guardrails or are not covered, the shutdown sites are not covered in time, or the sites are not cleaned and leveled in time after completion, and sewage and sludge from construction sites overflow, which affects the city appearance and environmental sanitation, and a fine of not less than 3,000 yuan shall be imposed on 500 yuan;

(seven) the relevant responsible units failed to keep the fa? ades of buildings and structures clean and tidy as required, and imposed a fine of more than 200 yuan 1000 yuan;

(eight) dumping toxic and hazardous wastes into domestic waste containers or discharging or discarding them without authorization, and imposing a fine of more than 5,000 yuan in 200 yuan;

(nine) in the open air and public garbage containers burning leaves, garbage and other wastes, punishable by a fine of more than 20 yuan and less than 200 yuan;

(ten) stall operators can not keep the surrounding environment clean and tidy, and impose a fine of more than 65438 yuan in 200 yuan;

(eleven) motor vehicles with mud driving in urban areas, impose a fine of more than 50 yuan and less than 500 yuan. Ninth cleaning vehicles polluting roads, shall be ordered to make corrections, given a warning, and may impose a fine of more than 2000 yuan in 200 yuan; If the vehicle fails to clean up the scene in time after loading and unloading the goods, which affects the environmental sanitation, it shall be ordered to correct the illegal act, immediately remove it and take remedial measures, and be fined from 20 yuan to 200 yuan. Tenth unauthorized feeding of livestock and poultry affect the city appearance and environmental sanitation, shall be ordered to deal with it within a time limit or be confiscated, and may impose a fine of more than 10 yuan per animal. Eleventh one of the following acts, shall be ordered to stop the illegal act, a deadline to clean up, dismantle or take other remedial measures, and may be fined:

(a) unauthorized installation of outdoor advertising, outdoor placards, galleries, plaques, affecting the city, and impose a fine of more than 5,000 yuan in 500 yuan;

(two) unauthorized stacking of materials, erection of buildings, structures or other facilities on both sides of the street and public places, which affects the city appearance, and impose a fine of more than 5 yuan and less than 50 yuan per square meter per day;

(3) Dismantling environmental sanitation facilities without authorization or failing to dismantle environmental sanitation facilities in accordance with the approved plan, and imposing a fine of not more than 5,000 yuan;

(four) unauthorized establishment of kiosks, stalls, affecting the city, punishable by a fine of more than 50 yuan 1000 yuan. Twelfth in public places, the impact of the city, shall be ordered to make corrections, given a warning, and may impose a fine of more than 2000 yuan in 200 yuan. Thirteenth buildings or facilities that do not meet the standards of city appearance and environmental sanitation, the law enforcement bureau shall, in conjunction with the Planning Bureau, order them to be rebuilt or demolished within a time limit. If it is not rebuilt or demolished within the time limit, it shall be forcibly demolished after approval by the Law Enforcement Bureau, and a fine of not more than 5,000 yuan may be imposed.
