Chapter I General Provisions Article 1 In order to strengthen the construction, maintenance and management of civil air defense projects (hereinafter referred to as civil air defense projects), ensure the combination of peacetime and wartime, and give full play to their combat readiness, social and economic benefits, these measures are formulated in accordance with the provisions of relevant state laws and regulations and in light of the actual situation of this Municipality. Article 2 These Measures shall apply to the construction, maintenance, management and use of all civil air defense projects within the administrative area of this Municipality. Article 3 The term "civil air defense project" as mentioned in these Measures refers to the civil air defense tunnels, tunnels, basements, other underground buildings with protective functions, transformed natural caves and their equipment and facilities invested and constructed in various forms within the administrative area of this Municipality. Article 4 The construction, maintenance, management and use of civil air defense projects in this Municipality shall be led by the people's governments at or above the county level, and the competent departments for civil air defense with management authority shall be responsible. Fifth public security, development and reform, housing and urban and rural construction, resources and planning, urban management, market supervision, taxation, health, electric power, postal services, telecommunications, finance and other departments. Should actively cooperate with the competent departments of civil air defense in accordance with the relevant provisions of the construction, maintenance, management and use of civil air defense projects. Article 6 Units and individuals that have made remarkable achievements in the construction, maintenance, management and use of civil air defense projects shall be commended and rewarded by the people's governments at or above the county level and their competent departments for civil air defense. Chapter II Construction Article 7 The people's governments at or above the county level shall incorporate the construction of civil air defense projects into the national economic and social development plan, and build various supporting civil air defense projects according to the needs of combat readiness. Article 8 The municipal competent department of civil air defense shall, according to the overall planning of land and space, prepare the construction plan of civil air defense projects and organize their implementation after approval. Article 9 Civil air defense command projects shall be organized and implemented by the people's governments at or above the county level.

Civil air defense public works shall be organized and constructed by the competent departments for civil air defense.

Civil air defense works of organs, organizations, enterprises and institutions shall be built by this unit.

Combined with civil buildings (including foreign capital, Sino-foreign joint ventures and cooperative projects), the construction of air defense basement is included in the construction plan of ground construction projects, and the required funds are included in the total investment of construction projects. Article 10 When new civil buildings are built in cities, basements that can be used for air defense in wartime shall be built simultaneously in accordance with the provisions of the state and the province.

Due to one of the following circumstances, upon the application of the construction unit and the approval of the competent department of civil air defense, the construction unit shall pay the ex situ construction fee according to the regulations, and the competent department of civil air defense shall build ex situ according to the plan:

(a) the geological and topographic conditions are not suitable for construction;

(two) the air defense basement space clear height is insufficient;

(three) the area of the air defense basement should be less than a protective unit;

(four) the area of the basement should be less than the construction area of the first floor of the building;

(five) due to the dense buildings or underground pipeline facilities in the construction area, it is impossible to build an air defense basement or it is difficult to take measures to ensure construction safety.

The competent department of civil air defense shall regularly announce to the public the collection and use of ex situ construction fees. Eleventh private houses in cities and towns shall be maintained and rebuilt according to the original area, and private houses in rural areas shall not be built with air defense basements, and shall be exempted from ex situ construction fees. Article 12 The number and location of civil air defense works shall be determined in accordance with state regulations.

The competent department of natural resources and planning shall reasonably arrange the necessary land for the entrance of the civil air defense project, ensure the smooth road of the civil air defense project, and build the entrance facilities. Command post and other important civil air defense projects are determined according to actual needs, and other civil air defense projects are not less than 6% of the underground construction area.

The procedures for land use at the mouth of civil air defense projects shall be handled by the project construction unit with fixed-point planning opinions and by the competent department of natural resources and planning. Chapter III Management and Maintenance Article 16 The competent departments for civil air defense shall, in accordance with the division of labor and relevant regulations, strengthen the management and maintenance of civil air defense projects to ensure that civil air defense projects are always in good condition.

Civil air defense project management personnel should enforce the law impartially, be loyal to their duties, keep secrets, and actively do a good job in the management and maintenance of civil air defense projects. Seventeenth organs, organizations, enterprises, institutions and individuals have the obligation to support and protect civil air defense projects. It is forbidden to occupy or damage civil air defense projects and their facilities, and it is forbidden to cover or damage survey marks such as leveling points and traverse points of civil air defense projects. Article 18 No inflammable, explosive, toxic, corrosive or radioactive articles may be produced or stored in civil air defense works. Article 19 blasting, drilling, ditching and other operations that endanger civil air defense projects shall not be carried out within the safety protection scope of civil air defense projects, and the entrances and exits of civil air defense projects shall not be occupied, blocked or destroyed. It is forbidden to discharge waste gas, waste water and dump wastes into the civil air defense works and near their orifices.
