Regulations on Compulsory Tree Planting for All in Guangdong Province

Article 1: In order to promote the development of voluntary tree planting activities for all people, encourage and organize social forces to participate in land greening, and protect and improve the ecological environment, these regulations are formulated in accordance with relevant laws and regulations and in combination with the actual conditions of this province. Article 2 These regulations shall apply to voluntary tree planting activities carried out by citizens of appropriate age within the administrative region of this province.

Governments, groups, enterprises, institutions and other organizations (hereinafter collectively referred to as units) shall organize their own personnel to participate in voluntary tree planting activities.

Officers and soldiers of the Chinese People's Liberation Army and Armed Police Force stationed in this province participate in voluntary tree planting activities in accordance with the relevant regulations of the State Council and the Central Military Commission. Article 3 The term "voluntary tree planting" as mentioned in these Regulations refers to the greening tasks such as land preparation, seedling cultivation, tree planting, management and maintenance that citizens complete without compensation for a certain amount of labor for land greening. Article 4 Male citizens between the ages of 18 and 60 and female citizens between the ages of 18 and 55 within the administrative region of this province, except those who have lost the ability to work, shall participate in voluntary tree planting activities.

Young people aged 11 to 17 can arrange voluntary tree planting activities nearby.

Those who do not have the obligation to plant trees according to law but voluntarily participate in voluntary tree planting should be encouraged. Article 5 The greening committee of the people's government at or above the county level shall uniformly lead the voluntary tree planting and afforestation work within its own administrative region. The Greening Committee Office is responsible for the daily work of the Greening Committee at the same level. Article 6 The greening committee of the people's government at or above the county level shall formulate a voluntary tree planting plan based on the long-term forestry development plan and urban and rural construction plan, organize forestry, construction, water conservancy, transportation, railway and other relevant departments to formulate annual voluntary tree planting plans, and supervise the implementation. Article 7 March every year is the compulsory tree planting month for all people in our province. Promote voluntary tree planting on commemorative days. Article 8 Compulsory tree planting shall implement various forms of responsibility systems with specific locations, tasks and quality as content. The greening committees of people's governments at all levels and qualified units may establish voluntary tree planting bases according to local conditions. Article 9 The greening committee of the people's government at or above the county level shall, in accordance with national regulations and the voluntary tree planting plan and annual plan, issue the task of voluntary tree planting to all units within its administrative region in the form of a voluntary tree planting notice every year. The notice should specify the number of people obliged to plant trees, the location, quantity, completion time and other requirements.

Units and individuals engaged in afforestation should complete voluntary tree planting tasks.

If units and individuals apply for voluntary tree planting, the local greening committee will make arrangements. Article 10 Agencies, groups, enterprises, institutions and other organizations shall organize their own personnel to participate in voluntary tree planting in accordance with the arrangements of the greening committee of the people's government at or above the county level where they are located.

Citizens of urban age other than those specified in the preceding paragraph shall be organized by the town people's government or sub-district office to participate in voluntary tree planting in accordance with the arrangements of the greening committee of the people's government at or above the county level where they are located.

Rural citizens of appropriate age shall participate in voluntary tree planting organized by the township (town) people's government in accordance with the arrangements of the greening committee of the local people's government. Article 11 The greening committee of the people's government at or above the county level shall register the voluntary tree planting of units and individuals within their respective administrative regions and establish a voluntary tree planting registration card system.

Each unit shall submit the voluntary tree planting registration card to the local people's government greening committee at or above the county level on schedule, and the greening committee of the people's government at or above the county level shall inspect and accept the completion of this year's voluntary tree planting tasks. If the tree planting survival rate is less than 85%, the number of voluntary tree planting completed in the current year will be calculated based on the number of surviving trees. For unfinished tasks, the greening committee of the people's government at or above the county level will arrange replanting in the second year. Article 12 If a unit or individual that is required to perform tree planting obligations is indeed unable to directly participate in voluntary tree planting, it shall apply to the greening committee of the local people's government at or above the county level and pay a greening fee equivalent to the completion of the voluntary tree planting tasks.

Compulsory tree planting and greening fees are managed on two lines of revenue and expenditure. The greening committees of people's governments at all levels use special funds for voluntary tree planting and afforestation, and are subject to the supervision of finance, price, and audit departments.

The standards and usage management methods for voluntary tree planting and greening fees shall be formulated by the provincial price administrative department in conjunction with the provincial financial administrative department. Article 13 People's governments at all levels shall, according to the voluntary tree planting plan and annual plan, allocate a certain amount of funds every year for the construction of seedling production bases to ensure the seedlings required for voluntary tree planting. Article 14 The trees that are voluntarily planted on state-owned land shall be owned by the unit with the right to use the land; the tracts that are voluntarily planted on collective land shall be owned by the collective. If the land use rights have not yet been confirmed, they shall be determined by the people's government at or above the county level in accordance with the law. If there is any other agreement, it shall be determined in accordance with the agreement.

After the forest rights are determined, the people's government at or above the county level will issue a certificate of ownership. Article 15 Before acceptance, the trees planted voluntarily shall be managed and protected by the planter or the person entrusted by him; after acceptance, they shall be managed and maintained by the forest rights unit or the unit or individual designated by the greening committee of the people's government at or above the county level.

The felling, renewal, alteration or transformation of compulsorily constructed green spaces shall be carried out in accordance with relevant provisions such as the Forest Law of the People's Republic of China and the Urban Greening Regulations. Article 16 The greening committee of the people's government at or above the county level may accept donations of funds and materials from the public in accordance with the law, and use them exclusively for voluntary tree planting and afforestation.
