Article 1 In order to strengthen the management of urban construction waste and improve urban environmental sanitation, these Provisions are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of Urban Appearance and Environmental Sanitation and the Measures for the Administration of Urban Domestic Waste. Article 2 The term "construction waste" as mentioned in these Provisions refers to the waste such as muck, waste soil, waste and sludge produced by the construction unit or individual in the process of building, laying, dismantling and repairing various buildings, structures and pipe networks; Construction waste management refers to the management of collection, transportation, consumption and treatment of construction waste. Article 3 The competent administrative department of environmental sanitation of the Municipal People's Government shall be responsible for the unified management of urban construction waste within its administrative area, and formulate detailed rules for construction management according to the Measures for the Administration of Urban Domestic Waste and organize its implementation. Fourth construction or construction units that produce construction waste should declare the construction waste disposal plan to the environmental sanitation management department before the project starts, and sign the environmental sanitation responsibility letter.

After receiving the application documents, the environmental sanitation management department shall issue a disposal certificate in time, and shall inform the reasons if it fails to issue a disposal certificate.

The disposal certificate shall not be lent, transferred, altered or forged.

@ Article 5 If construction waste is transported to the storage and transportation (stacking) site of construction waste set up by the environmental sanitation management department for disposal, the disposal fee shall be paid according to the regulations.

The construction unit or the construction unit shall accept the supervision and inspection of the urban environmental sanitation management department if it arranges the transportation and disposal of construction waste on its own.

Units and individuals that need to backfill with construction waste shall apply to the environmental sanitation management department for registration, and the environmental sanitation management department shall be responsible for unified arrangements. Article 6 The specific charging items and standards for construction waste disposal shall be formulated by the environmental sanitation administrative department in conjunction with the price administrative department. The special fund extracted from the income is used for the construction and management of urban construction waste treatment facilities. Seventh construction, construction units or units and individuals who undertake the transportation and treatment of construction waste must obey the unified management of the environmental sanitation administrative department of the city people's government and strictly abide by these provisions. Article 8 The supervisory team or supervisors of the environmental sanitation administrative department of the people's government of a city shall strengthen the supervision and inspection of the construction, construction units or units and individuals responsible for the transportation and disposal of construction waste. It is strictly forbidden to dump construction waste at the designated place, leaving it scattered or omitted during transportation. Ninth in violation of the provisions, shall be punished according to the relevant provisions of the "measures" management of municipal solid waste. Article 10 The Ministry of Construction shall be responsible for the interpretation of these Provisions. Eleventh these Provisions shall come into force as of the date of promulgation.
