Regulations of Shandong Province on the Administration of Frontier Defense and Public Security of Coastal Ships

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the relevant laws and administrative regulations and in the light of the actual situation of this province in order to strengthen the administration of border security of coastal ships, maintain the order of border security in coastal areas, safeguard the legitimate rights and interests of seafarers and promote the economic and social development of coastal areas. Article 2 These Regulations shall apply to the administration of border security of all kinds of ships berthing, sailing and operating in the sea area of this province. Except for military ships, official ships and other ships as otherwise provided by laws and administrative regulations. Article 3 The public security management of coastal ships' frontier defense adheres to the principles of active prevention, management according to law, relying on the masses and combining education with punishment. Article 4 The people's governments of cities and counties (cities, districts) in provinces and coastal districts shall strengthen their leadership over the management of border security of coastal ships, establish and improve the coordination mechanism for law enforcement and the safety prevention system, and study and solve major problems in the work in a timely manner. Article 5 The public security frontier defense organ is the competent department in charge of the frontier security administration of coastal ships.

Departments of marine and fishery, transportation, maritime affairs, customs and other departments shall, within the scope of their respective duties, cooperate in the management of border security of coastal ships. Article 6 The people's governments of cities and counties (cities, districts) in provinces and coastal areas shall provide financial support for maritime law enforcement by public security frontier organs, ensure daily law enforcement duties, and gradually improve the level of maritime law enforcement vessels and equipment. Chapter II Administration of Maritime Frontier Defense Documents Article 7 Ships going to sea and offshore production operators shall apply to the public security frontier defense organ at the port of registry or the place where the ship is located for maritime frontier defense documents in accordance with the relevant provisions of the state.

The public security frontier defense organ shall simplify the procedures for issuing maritime frontier defense documents in accordance with the relevant provisions of the state to provide convenience for the applicant; If it meets the requirements and can be handled on the spot, it shall be handled on the spot. Article 8 Ships going to sea and production workers going to sea shall carry their maritime border defense documents with them and keep them properly, and shall not alter, forge, falsely use or lend them; If the certificate is lost or damaged, it shall apply for a replacement in time. Article 9 Where a sea-going ship is renovated, changed in use, bought, sold, transferred, leased, scrapped or lost, it shall apply to the public security frontier defense organ that originally issued the certificate for change or cancellation of the sea-going certificate within 15 days after handling the relevant formalities according to law.

Where there is a change in the production and operation personnel going to sea, they shall apply to the public security frontier defense organs for changing their frontier defense documents before going to sea. Article 10 The public security frontier defense organ shall not handle the following applications for maritime frontier defense documents:

Under 16 years old;

(2) Being a defendant or criminal suspect in a criminal case;

(3) Being sentenced to public surveillance, probation, parole or medical parole;

(4) Having been dealt with for illegal and criminal acts such as smuggling and crossing the border;

(five) the certificate of maritime frontier defense has been revoked for less than six months;

Others are not suitable for offshore production operations. Chapter III Management of Ships and Personnel Going to Sea Article 11 Public security frontier defense organs shall regularly carry out publicity activities on frontier security management, and make use of the opportunity of ships returning to Hong Kong in summer to focus on relevant legal knowledge education for personnel going to sea. Article 12 Where ships go to sea for centralized berthing, mass organizations for ship security management may be established according to needs, and management assistants shall be set up to carry out service and management work under the guidance of local public security frontier defense organs. Thirteenth shipbuilding enterprises or individuals shall, within five days after handling the relevant formalities according to law, file with the local public security frontier defense organs. Article 14 If a ship fails to write its name and number as required, or its name and number are unclear, or its name and number are altered, concealed, altered or forged without authorization, it is prohibited to go to sea. Article 15 When a ship going to sea enters or exits a port, wharf or other berthing point, it shall apply to the public security frontier defense organ for frontier inspection in addition to obtaining a ship visa according to law. Sixteenth without the approval of the relevant departments, ships and personnel going to sea are not allowed to enter the sea areas, islands and temporary warning zones prohibited or restricted by the state, and are not allowed to board ships of foreign nationality or Hongkong, Macao Special Administrative Region and Taiwan Province Province without authorization.

In case of emergency avoidance or force majeure, you should leave immediately after the cause is eliminated, and report to the public security frontier organs within 24 hours. Seventeenth ships, fishing gear, aquaculture materials and other items found at sea shall be returned to the obligee in a timely manner; If it cannot be returned, it shall report to the public security frontier defense organ or turn it over. The public security frontier defense organ shall promptly identify the ownership and return it to the obligee; If the ownership cannot be ascertained, it shall be auctioned and sold according to law, and the proceeds shall be turned over to the state treasury. Eighteenth maritime, fishery disputes or other disputes, the parties should be resolved through consultation or reported to the relevant departments in accordance with the law. Neither party shall detain the other party's personnel, ships or other property. Article 19 Ships and personnel at sea shall not commit the following acts:

Carrying drugs, illegal publicity materials and other prohibited items;

(2) Illegally carrying firearms, ammunition, control devices, explosives, toxic substances, radioactive substances and other controlled items;

(three) the illegal use of explosion, poisoning and other ways to endanger public safety;

(four) damage to submarine cables, pipelines and public facilities such as maritime navigation marks and buoys;

(5) illegally entering or organizing others to illegally enter the waters of other countries;

(six) illegal exploitation of sea sand or illegal salvage of seabed cultural relics and sunken ships;

(seven) illegal interception, forced boarding, collision or theft of other people's ships;

Destroying and stealing other people's breeding facilities and products;

(9) Forcibly buying, peddling, soliciting or exchanging catches or other articles;

(10) Other illegal and criminal acts.
