If the injury is identified as minor injury or above (including minor injury), the hitter has been suspected of intentional injury and should be investigated for criminal responsibility according to law. If the injury is identified as minor injury, you can directly sue the court for personal injury compensation; At the same time, administrative penalties such as administrative detention fines may be required. Specific responsibility depends on the injury. Those who constitute serious injuries or minor injuries shall bear criminal responsibility. Whether or not to bear criminal responsibility, civil liability for compensation must be borne. You can claim compensation for personal injury, medical expenses and reduced income caused by absenteeism, including medical expenses, absenteeism expenses, nursing expenses, transportation expenses, accommodation expenses, hospital food subsidies and necessary nutrition expenses.

Article 43 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment, whoever beats others, or intentionally hurts others' bodies, shall be detained for more than 5 days 10 days, and fined for more than 200 yuan and less than 500 yuan; If the circumstances are minor, they shall be detained for less than 5 days or fined for less than 500 yuan. Under any of the following circumstances, the offender shall be detained for more than 10 and less than 15, and fined for more than 500 yuan 1000 yuan:

Article 234 of the Criminal Law of People's Republic of China (PRC) shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention or public surveillance. Whoever commits the crime mentioned in the preceding paragraph and causes serious injuries shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years; Whoever causes death or serious disability by particularly cruel means shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death. Where there are other provisions in this Law, such provisions shall prevail.

Article 179 of the Civil Law of People's Republic of China (PRC) infringes upon others and causes personal injury, it shall compensate the reasonable expenses of medical treatment, nursing expenses, transportation expenses, nutrition expenses, hospital food subsidies, etc., and the income reduced due to missed work. If it causes disability, it shall also compensate for the cost of assistive devices and disability compensation; If death is caused, funeral expenses and death compensation shall also be paid.

If the injured person is slightly injured and the other party refuses to pay compensation after mediation by the police station, or the mediation fails, the victim may write a complaint and file a lawsuit in the court where the defendant is located. At the same time, to collect evidence, you can ask the police to provide relevant evidence. If it constitutes a minor injury or more, the other party is suspected of intentional injury. After the procuratorate files a criminal lawsuit, the victim may file a criminal incidental civil lawsuit and demand compensation from the other party.
