Legal analysis: academic fraud can constitute illegal acts of scientific and technological personnel, and will be punished according to the Interim Provisions on Handling Illegal Acts of Scientific and Technological Activities and related regulations.

Legal basis: Article 8 of the Interim Provisions on Handling Illegal Acts in Scientific and Technological Activities includes the following situations: (1) Providing false materials in activities such as declaration, review, implementation, acceptance, supervision and inspection, evaluation and evaluation of scientific and technological activities, and implementing entrusted acts such as "greeting" and "pulling relationships"; (2) Deliberately exaggerating the research foundation, academic value, technical value and social and economic benefits of scientific and technological achievements, and concealing technical risks, resulting in negative impacts or financial losses; (three) the person in charge of the talent plan and the person in charge of major scientific research projects change their work units without authorization during their employment or during the implementation of the project, resulting in negative impact or financial losses; (four) deliberately delaying or refusing to perform the main obligations stipulated in the contract for the management of scientific and technological activities; (five) arbitrarily reduce the target tasks and agreed requirements, with the project implementation cycle or irrelevant results to offset their own work; (six) plagiarism, misappropriation, tampering with other people's scientific and technological achievements, fabricating scientific and technological achievements, infringing on other people's intellectual property rights, etc. ; (seven) false, impersonator, misappropriation of financial research funds; (eight) do not cooperate with the supervision and inspection or evaluation, rectification, false rectification or rectification does not meet the requirements; (nine) (ten) to carry out scientific and technological activities that endanger national security, social interests and human health; (eleven) in violation of the provisions of the state on the confidentiality of scientific and technological activities; (twelve) other relevant illegal acts stipulated by laws, administrative regulations, departmental rules or normative documents.
