Regulations on penalties for road traffic management in Shantou Special Economic Zone

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security, the Regulations of the People's Republic of China on Road Traffic Management and other relevant laws and regulations, in combination with the actual situation of Shantou Special Economic Zone (hereinafter referred to as the Special Zone). Article 2 These Regulations shall apply to all vehicles and their drivers, passengers and pedestrians passing on the roads within the scope of the Special Zone, as well as those engaged in traffic-related activities on the roads who violate road traffic management and should be subject to administrative penalties. Article 3 The Municipal Public Security Bureau is the administrative department in charge of road traffic management in this Municipality, and its traffic police department (hereinafter referred to as the public security traffic police department) is specifically responsible for organizing the implementation of these Regulations. Article 4 The implementation of road traffic management shall adhere to the principle of combining education with punishment.

Fines shall be separated from fines collection. Fifth traffic police must strictly enforce the law, civilized duty, and consciously accept the supervision of society and citizens.

Traffic police are protected by law when performing their duties according to law, and no unit or individual may illegally interfere. Chapter II Violations of Road Traffic Management and Penalties Article 6 Motor vehicle drivers who commit any of the following acts shall be given a warning or fined by 30 yuan:

(1) Failing to stop or give way in accordance with the regulations when passing the intersection with stop and give way signs;

(two) engaged in smoking and eating while driving;

(3) throwing objects outside the car;

(four) driving a two-wheeled motorcycle without wearing a helmet or an umbrella. Seventh motor vehicle drivers have one of the following acts, a fine of fifty yuan:

(a) driving a motor vehicle after drinking;

(2) using a mobile phone while driving;

(three) after entering the guide lane, changing lanes or not driving in the prescribed direction;

(four) do not drive in accordance with the provisions of the motor vehicle lane, the two-wheeled motorcycle does not take the special lane or does not rely on the right side of the motor vehicle lane;

(5) Stop at the crosswalk with yellow squares;

(six) hanging, posting or placing objects in the cab and windshield of a motor vehicle, which hinders the driving sight or affects the operation;

(seven) failing to install or intentionally damage, cover or distort the vehicle number plate;

(eight) the driver holding a driver's license in different places has been operating in the special zone for more than 90 days, and has not gone through the registration formalities of entrusted management in different places, driving a special zone license plate car;

(nine) the license plate vehicle in different places has been running in the special zone for more than 90 days, and has not gone through the registration formalities of entrusted management in different places;

(10) driving a non-operating vehicle with a remote driving license or a non-operating vehicle with a remote license plate in the special zone for more than 90 days without going through the registration formalities in different places.

Motor vehicle drivers who commit the acts mentioned in Item (3) of the preceding paragraph may suspend their driving licenses for fifteen days. Eighth motor vehicle drivers have one of the following acts, a fine of eighty yuan:

(a) overtaking or crossing the line on the road section with single solid line and double solid line in the middle;

(2) Parking vehicles on sections marked with yellow lines or other prohibited sections;

(three) driving a motor vehicle in a non-motor vehicle lane or sidewalk (except roads);

(four) driving a vehicle whose body and parts are damaged and do not meet the safety requirements;

(five) non disabled people driving special motor vehicles for the disabled;

(six) driving a motor vehicle with an invalid driver's license or using an invalid motor vehicle driver's license.

Motor vehicle drivers who commit the acts mentioned in Item (1) of the preceding paragraph may suspend their driving licenses for 30 days; If there is any act in Item (4), the vehicle driver's license shall be temporarily suspended, ordered to make corrections within a time limit, and the driver's license may be suspended for 30 days. Ninth motor vehicle drivers have one of the following acts, a fine of one hundred and fifty yuan:

(a) when the front is blocked, driving a motor vehicle does not wait in line according to the regulations, and competes for the road;

(2) Driving in opposite directions on a road with a single solid line and a double solid line in the center;

(three) driving a vehicle that does not conform to the driving license;

(four) the driver holding a learning driver's license drives a motor vehicle on the road alone;

(five) driving a motor vehicle on the road without the specified time and route;

(6) Driving a motor vehicle with an overseas driving license.

Motor vehicle drivers who commit the acts mentioned in Items (1) and (2) of the preceding paragraph may also have their driving licenses suspended for 30 days; Anyone who commits the act in Item (3) may have his driving license suspended for 60 days. Article 10 Motor vehicle drivers who fail to follow traffic signals or prohibition signs shall be fined in 200 yuan.

If a motor vehicle is recorded as running a red light and the driver cannot be identified, it shall be punished in accordance with the provisions of the preceding paragraph. Eleventh motor vehicle drivers have one of the following acts, a fine of three hundred yuan:

(1) deliberately stopping driving on the road without obstacles ahead or obstructing traffic in other ways, and disobeying the command of the traffic police;

(2) Driving a motor vehicle after being drunk;

(3) Giving a motor vehicle to a person without a driver's license to drive;

(4) A person without a driver's license drives a motor vehicle;

(5) misappropriating or lending a motor vehicle driver's license;

(six) the use of altered or forged motor vehicle license plate;

(seven) driving a motor vehicle with an altered or forged driver's license;

(eight) in violation of the provisions of the installation and use of alarms or sign lamps;

(nine) driving a motor vehicle without changing the engine number or frame number of the motor vehicle;

(ten) driving without a license motor vehicles and can not explain its legal source;

(eleven) driving a scrapped motor vehicle;

(twelve) driving an illegally assembled motor vehicle;

(thirteen) speeding or overtaking in violation of regulations;

(14) driving a motor vehicle with an incomplete number plate.

Motor vehicle drivers who commit the acts mentioned in Items (2) and (5) of the preceding paragraph may also have their driving licenses suspended for 90 days; Anyone who commits any of the acts in Items (2) to (5) may be detained for less than fifteen days according to Article 27 of the Regulations of the People's Republic of China on Administrative Penalties for Public Security; In case of any act in Item (6) or (7), the invalid motor vehicle license plate and driving license shall be confiscated; In case of any act in Item (8), the illegally installed warning lights and alarms shall be confiscated; In case of any of the acts listed in Items (9) to (12), the vehicle, license plate and driving license shall be confiscated.
