Regulations on the Protection and Management of Erhai Lake in Dali Bai Autonomous Prefecture of Yunnan Province (revised on 20 14)

Chapter I General Provisions Article 1 In order to strengthen the protection and management of the ecological environment of Erhai Lake and its basins, and promote the coordinated development of ecological civilization and economy and society, these Regulations are formulated in accordance with the Water Law of People's Republic of China (PRC) and the Water Pollution Prevention Law of People's Republic of China (PRC), and in combination with the actual situation of Dali Bai Autonomous Prefecture (hereinafter referred to as the Autonomous Prefecture). Article 2 Units and individuals engaged in activities within the scope of Erhai Lake protection and management shall abide by these regulations. Article 3 Erhai Lake is a multifunctional plateau freshwater lake with artificially adjusted water level, a centralized drinking water source in Dali, and an important part of national Dali scenic spot and Cangshan Erhai Nature Reserve. The protection and management scope of Erhai Lake covers the main river basins of Erhai Lake, including Erhai Lake area and runoff area. Article 4 The protection and management of Erhai Lake adheres to the principles of giving priority to protection, scientific planning, comprehensive management, sustainable utilization and participation of the whole people. Article 5 The lowest operating water level of Erhai Lake is1964.30m above sea level (national elevation datum 1985, the same below), and the highest operating water level is1966.00m above sea level.

If it is really necessary to adjust the water level of Erhai Lake in a special year, the Dali Municipal People's Government shall put forward a plan and report it to the Standing Committee of the Autonomous Prefecture People's Congress for deliberation and decision. Article 6 The water quality of lakes, major rivers and reservoirs in Erhai Lake area and runoff area shall be protected according to the second-class national standard for surface water environmental quality. Dali Municipal People's Government is responsible for the protection and management of Erhai Lake area and Erhai runoff area within its administrative area.

Eryuan County People's Government is responsible for the protection and management of Erhai runoff area within its administrative area.

The township (town) people's government within the scope of Erhai Lake protection and management shall be responsible for the protection and management of Erhai Lake within its administrative area, and cooperate with relevant departments to do a good job in administrative law enforcement.

The villagers' committees (communities) and villagers' groups within the scope of Erhai Lake protection and management shall cooperate with the township (town) people's government to do a good job in Erhai Lake protection and management. Article 8 Autonomous Prefecture and people's governments of Dali City and Eryuan County shall set up Erhai Lake protection and management institutions to perform the protection and management duties of Erhai Lake area and runoff area within their respective administrative areas, and exercise the administrative law enforcement power conferred by these regulations.

Relevant departments of development and reform, finance, industry and informatization, environmental protection, housing and urban-rural construction, planning, land and resources, transportation, tourism, agriculture, animal husbandry, forestry, water affairs, supervision, public security, industry and commerce administration, quality and technical supervision, food and drug supervision and management in Dali and Eryuan County shall do a good job in the protection and management of Erhai Lake according to their respective responsibilities. Article 9 The people's governments of autonomous prefectures, Dali City and Eryuan County shall incorporate the protection and management of Erhai Lake into the national economic and social development plan, and the required funds shall be included in the fiscal budget at the corresponding level.

Autonomous Prefecture shall establish an ecological compensation mechanism for Erhai Lake, and the specific measures shall be formulated separately by the Autonomous Prefecture People's Government. Tenth Erhai Lake within the scope of protection and management of water resources and aquatic resources to implement the system of paid use. Those who use the water resources, aquatic resources, scenic resources and water surface in Erhai Lake area and runoff area to engage in business activities shall pay the following related fees according to law:

(1) Those who take water from Erhai Lake or engage in power generation and other business activities by using the seawater resources of Erhai Lake shall pay water resource fees and water charges.

(two) engaged in fishing, pay the fee for the protection of fishery resources.

(three) engaged in tourism business in scenic spots, pay the paid use fee of scenic resources.

(4) Other expenses that shall be paid as stipulated by laws and regulations. Eleventh Erhai Lake fees should be used for the protection and management of the ecological environment of Erhai Lake and its runoff area, and its scope of use is:

① Prevention and control of water pollution;

② Ecological compensation;

(3) Construction and protection of water conservation forests;

(four) artificial release of fishery resources and reproduction of indigenous fish;

(five) the management and protection of navigation channels, docks and navigation facilities;

(6) Scientific research and technical training;

(seven) other Erhai Lake protection matters approved by the Autonomous Prefecture People's government. Article 12 People's governments of autonomous prefectures, Dali City, Eryuan County and townships (towns) within the scope of Erhai Lake protection and management shall organize publicity and education on Erhai Lake protection, popularize relevant knowledge on Erhai Lake protection, and enhance citizens' awareness of Erhai Lake protection.

Encourage citizens, legal persons and other organizations to participate in or carry out Erhai Lake protection activities in the form of donations and voluntary services.

Any unit or individual has the right to dissuade, report and accuse acts that violate the provisions of these regulations. Chapter II Protection and Management of Erhai Lake Area Article 13 The specific management scope of Erhai Lake Area is the lake area within the highest operating water level of Erhai Lake, the river channel from the control gate of Xi 'er River to the water intake of Tianshengqiao I power station, and the water conveyance tunnel leading Erhai Lake into Binlao Qingshan to the exit boundary pillar. The boundary of the lake area shall be delineated by the Dali Municipal People's Government, and boundary markers shall be set up and announced to the public.

Erhai area should be managed in a unified way. Fourteenth Dali Municipal People's government Erhai Lake protection and management institutions mainly perform the following duties:

To publicize and implement relevant laws, regulations and these regulations;

(two) to formulate a long-term plan for the protection and management of Erhai Lake and a plan for the utilization of Erhai water resources, which shall be reviewed by the Dali Municipal People's Government and implemented after being reported to the Autonomous Prefecture People's Government for approval;

(three) unified management of Erhai water outlet control gate and Erhai water intake control gate;

(four) in conjunction with the relevant departments to supervise, inspect and implement the ecological protection and water pollution prevention measures in Erhai Lake;

(five) in conjunction with the relevant departments to organize and coordinate the popularization and application of scientific research and scientific research achievements in Erhai Lake;

Responsible for the pre-trial of Erhai regional development and utilization projects;

(seven) collect fees related to Erhai Lake area;

(eight) the relatively centralized exercise of Erhai Lake area and the forest belt around the lake water administration, fishery administration, forestry administration, environmental protection, nature reserves and scenic spots protection and other administrative law enforcement rights.
