Article 1. In order to prevent and mitigate flood disasters and strengthen flood control management, in accordance with the "Law of the People's Republic of China on Flood Control" and "Hubei Province's Implementation of the "Law of the People's Republic of China on Flood Control" These regulations are formulated based on the relevant provisions of the Measures and in light of the actual situation of this city. Article 2: These regulations apply to flood control management within the administrative region of this city. Article 3 The water administrative departments of the municipal and district people's governments, under the leadership of the people's governments at the same level, are responsible for the organization, coordination, supervision, guidance and other daily work of flood prevention within their respective administrative regions. The management committee of the development zone is responsible for the daily management of flood control within the Wuhan Economic and Technological Development Zone.

Relevant departments such as construction, transportation, municipal administration, planning, land, and public security, under the leadership of the people's government at the same level, are responsible for relevant flood prevention and relief work in accordance with the division of labor of the flood control responsibility system. Article 4 The flood control command agencies established by the municipal and district people's governments shall, under the leadership of the higher-level flood control command agencies and the people's governments at the same level, direct the flood control and flood relief work within their respective administrative regions.

The city’s flood prevention and fighting measures must be strictly implemented in accordance with the Wuhan City Flood Control Plan. The administrative head responsibility system shall be implemented for flood prevention and fighting. Article 5 The city's flood control work is deployed according to the following water level levels:

(1) During the period when the water level at Wuhan Pass exceeds the fortified water level but has not yet reached the warning level, the specific work of city and district flood control shall be carried out by the city and district water administration. The competent department is responsible;

(2) When the water level at Wuhan Pass exceeds the warning level, the city's flood control work will be under the unified command of the municipal flood control command agency;

(3) When the water level at Wuhan Pass approaches the guaranteed water level , the city's flood prevention work entered a state of comprehensive emergency, and emergency mobilization was implemented. Article 6 During the flood prevention period, any organization or individual within the administrative region of this city shall obey the unified command of the municipal flood prevention command agency and assume flood prevention obligations. Article 7 For rivers, lakes and reservoirs within the administrative area of ??this city, the municipal and district water administrative departments shall be responsible for drainage, water storage, management, protection and other flood prevention work in accordance with their respective responsibilities and the scope delineated by the superior water administrative department. . Article 8 The management scope of rivers and lakes with embankments includes the waters between the two banks, sandbanks, flood areas, beaches, embankments, embankment restricted areas, land reserved for embankment projects, and underground engineering control areas, and shall be divided according to the following provisions :

(1) The embankment body includes the front embankment foot to the rear embankment foot. The embankment body of the earth embankment is from the foot of the wave breakwater slope on the facing water surface to the foot of the pressure flooding platform slope on the back surface (the embankment slope that does not reach the planned and designed section is the foot of the pressure flooding platform slope on the planned and designed section); From the retaining wall foot of the wave platform to the back platform retaining wall foot of the back water surface (the section of the embankment that does not reach the planned and designed section is the planned and designed section);

The reserved land for embankment projects in the restricted areas for dangerous work, the dangerous sections and the soil-deficient embankment sections shall be determined separately by the Municipal People's Government.

The land within the restricted area of ??embankments and reservoir dams shall be delineated by the municipal water administrative department and reported to the municipal land management department for review and registration in accordance with relevant national, provincial and municipal regulations. Article 9 The management scope of rivers and lakes without embankments is the waters, sandbanks, beaches and flood areas between the highest historical flood levels or the design flood levels. Article 10 The natural highlands and original flood control embankments that play a role in flood control within the administrative region of this city shall be approved by relevant departments organized by the Municipal People's Government, clearly marked and announced.

Where units and individuals use natural highlands for production and daily life needs, they must take protective measures and shall not affect flood control safety.

No unit or individual may abolish the original flood control embankment without authorization; if it is really necessary to abolish it due to urban construction, it must be reviewed by the municipal water administrative department and reported to the Municipal People's Government for approval; it must be built according to flood control requirements For replacement projects, the construction unit shall construct them in accordance with regulations. Article 11 It is prohibited to construct buildings or structures that hinder flood discharge within the management scope of rivers, lakes and reservoirs.

When building buildings and structures that comply with flood control requirements and urban master planning within the management scope of rivers, lakes and reservoirs, a flood impact assessment report must be prepared and submitted to the municipal water administrative department and the municipal urban planning administration. After review and approval by the competent authorities (if within the scope of the port area, the consent of the transportation authorities must be obtained), the application shall be submitted for approval in accordance with the approval authority stipulated by the state.

For buildings and structures built on rivers, lakes and flats before the implementation of these regulations, the municipal flood control command agency will instruct relevant departments to investigate and clean up. For those that hinder flood discharge, the municipal flood control command agency will order remedial measures to be taken within a time limit. Measures must be taken to eliminate obstacles; if it seriously affects flood control and remedial measures cannot be taken, it will be ordered to be demolished within a time limit; if it is not demolished within the time limit, it will be forcibly demolished, and the construction unit will bear the required costs.

The rivers, lakes and beaches used by the unit shall not be transferred, leased or changed in use; if they are used within a time limit, they shall be withdrawn within the time limit. Article 12: Sand mining in rivers without authorization is prohibited. Those who have obtained a sand mining license in accordance with the law shall carry out sand mining activities in accordance with the prescribed mining scope and operation methods.

It is prohibited to pile up yellow sand and other materials in rivers and lakes and beaches where the Municipal People's Government does not allow the accumulation of yellow sand and other materials. Stacking of yellow sand and other materials in other rivers and lakes and beaches must be reported to the municipal water administration department for approval and approval.
