Article 5: Administrative punishment follows the principles of fairness and openness. The establishment and implementation of administrative penalties must be based on facts and be commensurate with the facts, nature, circumstances and degree of social harm of the illegal act. Provisions on imposing administrative penalties for illegal acts must be published; if they are not published, they shall not be used as the basis for administrative penalties.
