Regulations of Suzhou Municipality on the Administration of Inland River Traffic Safety

Chapter I General Provisions Article 1 In order to strengthen the management of inland river traffic safety, maintain the order of inland river traffic, prevent and control ship pollution, and ensure the safety of people's lives and property, these Regulations are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on the Administration of Inland River Traffic Safety, the Regulations of Jiangsu Province on the Administration of Inland River Traffic and other relevant laws and regulations, and combined with the actual situation of this Municipality. Article 2 Navigation, berthing, operations and other activities related to the traffic safety of inland rivers in the navigable waters of inland rivers within the administrative area of this Municipality (except the Yangtze River) shall abide by these regulations.

If there are other provisions in the laws and regulations on water traffic safety management such as fishing vessels, fishing port waters and urban garden waters, such provisions shall prevail. Article 3 The municipal, county-level city and district people's governments shall strengthen the management of inland river traffic safety within their respective administrative areas, and establish and improve the responsibility system for inland river traffic safety management.

Town People's Government (street offices) shall establish and improve the responsibility system for inland river traffic safety management, determine the management organization or specialized personnel according to the needs of inland river traffic safety management, and be responsible for the safety management of ferries, agricultural boats, catering boats and other ships within its jurisdiction. Fourth city and county-level city and district traffic administrative departments in charge of the administrative area of inland river traffic safety management. The local maritime administrative agencies of cities and county-level cities shall specifically implement the supervision and management of inland river traffic safety within their respective administrative areas.

The administrative departments of safety supervision, public security, water conservancy (water affairs), agriculture, forestry (fishery), landscaping, construction, tourism, environmental protection, city appearance and municipal administration shall, according to their respective functions and duties, cooperate in the management of inland river traffic safety. Chapter II Vessels, Floating Installations and Crew Article 5 Vessels, floating installations and crew members shall meet the conditions prescribed by laws and regulations before sailing or engaging in related activities. Article 6 Ships and ship transportation shall be insured in accordance with the relevant provisions of the State. Seventh passenger ships, dangerous goods carriers, oil tankers and transport ships sailing in Taihu Lake should be equipped with satellite positioning systems and other equipment networked with the local maritime administrative agencies, and ensure the normal operation.

When the ship is sailing, if the satellite positioning system fails, it shall report to the local maritime administrative agency in time. Article 8 The master is fully responsible for the navigation, berthing and operation safety of the ship, and has independent decision-making power and ultimate responsibility for ensuring the safety of people and property on the water and preventing the ship from polluting the waters.

A ship without a captain shall be fully responsible for the safety of navigation, berthing and operation by the crew who perform corresponding duties. Article 9 The local maritime administrative agency shall strengthen the education of seafarers' water traffic safety, and be responsible for the supervision and management of seafarers' training. Chapter III Navigation, Berthing and Operation Article 10 Ships shall try their best to sail along the starboard channel of the ship.

Ships should berth according to traffic safety signs. In case of special circumstances such as inland river traffic accidents, channel blockage, water traffic control, bad weather ahead, etc., when ships need emergency berthing, they shall berth in turn along the starboard side of the ship, and shall not affect the routes of other ships. Eleventh personnel engaged in water operations on ships and floating facilities should wear life jackets. Article 12 Local maritime administrative agencies may issue navigation rules according to the actual needs of ensuring navigation safety.

Vessels entering traffic control areas, dense navigation areas or areas with limited navigation conditions shall abide by the navigation rules issued by the local maritime administrative agency. Apply for escort and other special order maintenance, and go through the relevant formalities with the local maritime administrative agency in accordance with the regulations. Thirteenth ships carrying goods shall ensure the stability of the ship and shall not affect the driving sight. Without the approval of the local maritime administrative agency and taking necessary safety measures, the height of the cargo carried by the ship above the deck shall not exceed half of the depth of the ship, the stowage width shall not exceed 50 cm outboard and the length shall not exceed the hull.

Towing and pushing of ships shall be in the form of single row and one column, and towing methods such as long cable, single cable and towing shall not be used. The deviation cable used shall not exceed half the width of the tugboat. Article 14 When sailing, berthing and operating, a ship shall not commit any of the following acts:

(1) Concealing, defacing or altering the name, port of registry and other ship marks;

Using non-passenger ships to engage in passenger activities;

(three) ships that do not have the conditions for sailing at night;

The crew engaged in navigation and operational activities after drinking alcohol;

(five) dangerous operations such as fast boat rotating at full speed or turning at large rudder angle;

(six) in narrow and curved waterways, bridges, lock approach channels and other waters;

(seven) the agricultural ship changes its use or sails outside the waters specified in the ship certificate. Fifteenth local maritime administrative agencies should set up traffic safety signs such as speed limit and no parking in the waters of ancient bridges, ancient revetments, ancient docks and other cultural relics protection units and ancient buildings along the waterway. When ships pass by, they should abide by the speed limit and no stopping regulations. Article 16 When demonstrating the feasibility of setting up wharves, berths, operation areas and ship crossing facilities, the opinions of local maritime administrations shall be solicited and the navigation safety assessment shall be passed.

Owners and operators of docks, berths, working areas and ship-passing facilities shall set up and maintain traffic safety signs in accordance with the requirements of the specifications, and designate special personnel to manage the order of ship berthing.

Owners and operators of key terminals such as tourist terminals, loading and unloading terminals for dangerous goods, water gas stations, etc. shall install safety monitoring video devices networked with local maritime administrative agencies and ensure their normal operation.
