New regulations on anti-pornography in 2022

Starting from March 27, 2020, in addition to fines and detention, there will no longer be compulsory detention measures of six months to two years for prostitutes and solicitors. This also reflects that China’s legal system is becoming more and more sound and perfect.

Carrying out anti-pornography and anti-illegal activities is an important means to purify the cultural market. This work is carried out by the "Anti-Pornography Office". The State Administration of Press, Publication, Radio, Film and Television (Anti-Africa Department) is responsible for organizing, guiding, and coordinating the national "anti-pornography and anti-illegal" work, organizing the investigation and handling of major and important cases, and undertaking the daily work of the national anti-pornography and anti-illegal work group.

Main responsibilities:

Based on the above functional adjustments, the main responsibilities of the National “Anti-Pornography and Anti-Illegal Affairs” Working Group Office are:

(1) Formulating the publication market " "Anti-pornography and illegal activities" guidelines, policies and plans, participate in the drafting of laws, regulations and rules for publication market supervision, and organize their implementation.

(2) Investigate and study the publication market situation and the trends of pornographic production, trafficking, and illegal publishing activities, formulate a work plan for "anti-pornography and crackdown on illegal activities" in the publication market, and organize the implementation, supervision and inspection.

(3) Participate in the formulation of macro-control policies and important management measures for the publication market. Participate in planning the total volume, structure and layout of publishing, printing, reproduction and distribution units.

(4) Supervise and manage publishing activities, and participate in investigating and punishing violations by publishing, printing, copying, and distribution units.

(5) Supervise and manage the publication market, investigate or organize the investigation of illegal publishing activities in accordance with the law, and inspect or organize the seizure of illegal publications.

: If the person engages in prostitution or whoring, he will be detained for up to 15 days and fined up to 5,000 yuan according to the provisions of the "Public Security Management Punishment Law".

If you organize and force others to engage in prostitution, it will constitute a crime. According to the "Criminal Law", you will be sentenced to a fixed-term imprisonment of not less than 5 years but not more than 10 years, and a fine. If the circumstances are serious, you may be sentenced to up to life imprisonment. , and subject to fines or confiscation of property.

If a person tolerates, induces or introduces others to prostitution, he may be sentenced to fixed-term imprisonment of not more than five years, criminal detention or surveillance, and at the same time, he may also be fined. If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years and shall also be fined.

Whoever produces, copies, publishes, disseminates or sells obscene materials, if the circumstances are particularly serious, shall be sentenced to fixed-term imprisonment of not less than 10 years or life imprisonment, and shall also be fined or have property confiscated.

Legal basis: Article 358 of the Criminal Law: Crime of Organizing Prostitution

Whoever organizes and forces others to engage in prostitution shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years, and shall also be fined ; If the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than ten years or life imprisonment, and shall also be fined or his property shall be confiscated. Anyone who organizes or forces minors into prostitution shall be severely punished in accordance with the provisions of the preceding paragraph. Anyone who commits the crimes in the preceding two paragraphs and commits crimes such as killing, injuring, raping, kidnapping, etc. shall be punished in accordance with the provisions of concurrent punishment for multiple crimes. Anyone who recruits or transports people for someone who organizes prostitution or otherwise assists in organizing prostitution for others shall be sentenced to fixed-term imprisonment of not more than five years and shall also be fined; if the circumstances are serious, he shall be sentenced to fixed-term imprisonment of not less than five years and not more than 10 years and shall also be fined.
