Government procurement process

The Government Procurement Law stipulates five modes of government procurement, and the operating procedures of each mode are as follows:

First, open bidding.

Public bidding means that the tendering and purchasing unit invites unspecified suppliers to participate in bidding by means of tender announcement according to law.

Operating procedures:

(1) announcement. The purchaser and the procurement agency shall publish the tender announcement on the government procurement information release media designated by the financial department.

(2) The bidder obtains the tender documents. It shall not be less than 20 days from the date when the tender documents are issued to the date when the bidder submits the tender documents.

(3) Bidding. The bidder shall prepare the tender documents according to the requirements of the tender documents, seal the tender documents and deliver them to the bidding place before the deadline for submission of the tender documents, and pay the bid bond according to the requirements of the tender documents. After receiving the tender documents, the procurement agency shall sign and keep them, and no unit or individual may open the tender documents before the bid opening.

(4) bid opening. The bid opening shall be conducted in public at the same time as the deadline for submission of bid documents determined in the tender documents. The bidding procurement unit shall notify the financial department and relevant departments of the people's government at the same level before the bid opening. The financial department and relevant departments may, as appropriate, conduct on-site supervision over bid opening activities. The bid opening shall be presided over by the procurement agency, and representatives of the purchaser, bidder and interested parties shall attend. At the time of bid opening, the bidder or its elected representative shall check the sealing condition of the bid documents, and may also be inspected and notarized by a notary agency entrusted by the tenderer; After confirmation, the tender staff will open it in public and read out the name of the bidder, bid price, price discount, alternative bidding schemes allowed in the tender documents and other main contents of the tender documents.

(5) Bid evaluation. The bid evaluation is organized by the purchaser and the procurement agency, and the bid evaluation committee established by the purchaser and the procurement agency according to law is responsible for the specific bid evaluation affairs. The bid evaluation committee shall be composed of representatives of the purchaser and relevant technical and economic experts, and the number of members shall be an odd number of five or more. Among them, technical and economic experts shall not be less than two-thirds of the total number of members. For projects with a procurement amount of more than 3 million yuan and complicated technology, the number of technical and economic experts in the bid evaluation committee shall be an odd number of more than 5. The bidding procurement unit shall take necessary measures to ensure that the bid evaluation is conducted in strict confidentiality.
