Chapter I General Provisions Article 1 In order to standardize the management of civil air defense projects, improve the combat readiness level and social and economic benefits of civil air defense projects, and protect the safety of people's lives and property, these measures are formulated in accordance with the People's Republic of China (PRC) Civil Air Defense Law, the Measures for the Implementation of the People's Republic of China (PRC) Civil Air Defense Law in Jiangxi Province and other laws and regulations, combined with the actual situation of this province. Article 2 These Measures shall apply to the planning, construction, maintenance, use, supervision and management activities of civil air defense projects (hereinafter referred to as civil air defense projects) within the administrative area of this province.

The term "civil air defense projects" as mentioned in these Measures includes underground protective construction projects (hereinafter referred to as single civil air defense projects) built separately for the protection of wartime personnel and materials, civil air defense command and medical rescue. And basement (hereinafter referred to as air defense basement) which can be used for air defense in wartime. Article 3 The construction of civil air defense works shall be coordinated with economic construction and combined with urban construction. Adhere to the combination of long-term construction and emergency construction; Adhere to the combination of state investment and social financing.

The construction of civil air defense projects should follow the principles of unified planning, acting according to one's abilities, combining peacetime and wartime, and putting quality first. Article 4 Civil air defense projects belong to national defense projects and social public welfare undertakings. The people's governments at or above the county level shall strengthen their leadership over the construction of civil air defense projects and incorporate the construction of civil air defense projects into the national economic and social development plans and annual plans.

Civil air defense works are usually maintained, managed and used by investors or managers and users in accordance with relevant regulations, and are uniformly arranged and used by the people's government in wartime or in case of public emergencies. Fifth people's governments at or above the county level shall be responsible for the supervision and management of the planning, construction, maintenance and use of civil air defense projects within their respective administrative areas.

The departments of development and reform, natural resources, housing and urban and rural construction, finance, health, auditing, water conservancy, municipal administration and emergency management of the people's governments at or above the county level shall do a good job in the management of civil air defense projects according to their respective responsibilities. Article 6 Enterprises, institutions, social organizations and individuals are encouraged to invest in the construction, development and utilization of civil air defense projects.

The construction, development and utilization of civil air defense projects enjoy the relevant preferential policies stipulated by the state, the army and the provincial people's government. Chapter II Planning and Construction Article 7 The competent departments for civil air defense of the people's governments at or above the county level shall, jointly with the departments of natural resources, development and reform, formulate plans for the construction of civil air defense projects in their respective administrative areas, solicit opinions from the competent departments for civil air defense of the people's governments at the next higher level, and report them to the people's governments at the same level for approval before implementation.

Civil air defense engineering construction planning should be balanced and ensure the key points, and schools, hospitals, stations and other densely populated areas should be listed as the key points of protection.

Civil air defense engineering construction planning should be incorporated into the overall urban planning and urban underground space development and utilization planning. The competent department of natural resources shall, jointly with the competent department of civil air defense, implement the requirements of civil air defense engineering construction planning when preparing the detailed urban regulatory planning. Eighth civil air defense engineering construction planning is the basis of civil air defense engineering construction, and no unit or individual may modify it without authorization. If it is really necessary to modify it, it shall be handled in accordance with the original examination and approval procedures. Ninth civil air defense engineering construction responsibility division:

(a) the civil air defense command project, the public personnel shelter project and the evacuation trunk road project shall be organized and implemented by the competent civil air defense department. The funds for the construction of civil air defense command projects shall be arranged by the financial budget at the corresponding level; The construction funds for the public shelter project and the evacuation trunk road project are mainly arranged by the financial budgets of the people's governments at all levels and raised by the competent departments for civil air defense according to law.

(two) special projects such as air defense professional teams, medical rescue and material reserves shall be organized and implemented by mass air defense organizations and wartime medical rescue and material reserves; The relevant units are responsible for the construction of personnel and materials shelter projects of their own units. Its construction funds are solved by all relevant departments and units.

(three) the basement project, by the relevant units or individuals responsible for organizing the construction. Its construction funds are raised by the construction unit or individual and included in the total investment of the construction project. The development and reform department shall make clear the construction scale and investment budget of the air defense basement when examining and approving the basic construction projects. Tenth relevant departments of the people's governments at or above the county level shall guarantee the construction land needed for civil air defense projects according to law; Necessary conditions should be provided for the construction of civil air defense projects connecting urban roads, power supply, water supply, drainage, communication, sewage discharge and fire fighting systems. Eleventh individual civil air defense projects project proposal, feasibility study report, preliminary design documents, in accordance with the following authority for examination and approval:

(a) civil air defense command projects at all levels with an investment scale of 1000 million yuan (inclusive) or more and other projects with an investment scale of 20 million yuan (inclusive) or more, after being accepted by the competent civil air defense department of the provincial people's government, go through the examination and approval procedures in accordance with the relevant provisions of the state;

(2) Civil air defense command projects at all levels with an investment scale of less than10 million yuan and other projects with an investment scale of 2 million yuan (inclusive) to 20 million yuan shall be examined and approved by the competent civil air defense department of the provincial people's government, and the project proposal and feasibility study report shall be submitted to the competent civil air defense departments of the state and military regions for the record;

(3) For construction projects other than those specified in the preceding two paragraphs, the feasibility study report and preliminary design documents may not be prepared, and the project proposal shall be examined and approved by the competent civil air defense department of the municipal people's government with districts where the project is located, and submitted to the competent civil air defense department of the provincial people's government for the record.

The competent departments for civil air defense of the people's governments of provinces and districts shall, from the date of accepting the application for examination and approval of the proposal, feasibility study report and preliminary design documents of civil air defense projects of single buildings, complete the examination within 14 days respectively. If it meets the requirements, it shall be approved; Do not meet the conditions, not approved, informed in writing and explain the reasons.
