Interim Provisions on the Administration of Production Licenses for Civil Aviation Special Vehicles and Ground Special Equipment

Article 1: These interim regulations are formulated in order to strengthen the production and management of special civil aviation vehicles and special ground equipment (see appendix 1 for scope), ensure flight safety, improve product quality, and provide good services. Article 2 These regulations apply to civil aviation airports and units that produce special civil aviation vehicles and special ground equipment. Article 3 Production units of special vehicles and special ground equipment that directly serve air transportation must apply for a production license from the Civil Aviation Administration of China. Only after obtaining the license can they organize production according to the approved model specifications. Article 4 The production license is valid for two years. and cannot be transferred. The production unit shall be valid until its name, address is changed and the production license is revoked or suspended. Article 5 The Capital Construction Airport Management Department of the Civil Aviation Administration of China shall specifically handle the issuance, suspension or revocation of production licenses, and shall supervise and inspect production units that have obtained production licenses. Article 6 Newly trial-produced special vehicles and special ground equipment by production units must be tried out for more than half a year and must be appraised and approved by the relevant provincial (ministerial) level business authorities in accordance with regulations before they can apply for a production license from the Civil Aviation Administration of China. Article 7 The production unit shall fill in the production license application form in the prescribed format (Appendix 2 of the application form) and submit it to the Civil Aviation Administration of China. Article 8 To apply for a production license for special civil aviation vehicles and ground equipment, the following documents and information must be submitted:

1. Approval documents for development tasks of special vehicles and special ground equipment and approval documents for qualification;

2. Production drawings (including general installation drawings);

3. Technical instructions;

4. Production and acceptance technical standards;

5. Instructions for use and maintenance;

6. Test and trial reports;

7. Standardized review report;

8. Tooling, process and technical documents;

9. Parts catalog (including homemade and outsourced);

10. Safety and health review report;

11. Summary of trial production work;

12. Description of factory personnel, major equipment, factory area and quality assurance system. Article 9 The Civil Aviation Administration of China will conduct a preliminary review within 30 days from the date of receipt of the production license application from the production unit to determine whether the product meets the production conditions, and notify the production unit of the results of the preliminary review, deciding whether to accept the application. Article 10: After review, if the product is deemed to meet the conditions, the Civil Aviation Administration of China shall issue a production license (Appendix 3) for special civil aviation vehicles and special ground equipment to the applying production unit, and notify each user unit. Units holding a production license can only produce products of the model specifications specified in the license. Article 11 If a production unit holding a production license for China's civil aviation special vehicles and special ground equipment decides to stop production on its own, it must report to the Civil Aviation Administration of China 90 days in advance and return the production license in a timely manner. China Civil Aviation notifies the user unit of this situation. Article 12 Production units that have not obtained the production license issued by the Civil Aviation Administration of China are not allowed to produce special civil aviation vehicles and special ground equipment. Units that produce without authorization shall be responsible for their own economic losses. The Civil Aviation Administration of China will notify all civil aviation users not to purchase or stop using such products. Article 13 The Civil Aviation Administration of China shall conduct a comprehensive review at least once every two years. Conduct a comprehensive review of the quality assurance system and product quality of production units holding civil aviation production licenses, point out deficiencies, and urge production units to make rectifications. If the rectification is still ineffective, the production license will be given a warning, short-term revocation or permanent revocation. After the user receives the special vehicle or special ground equipment, if it discovers production quality problems, it has the right to return the goods and recover the payment after identification. If an accident occurs due to product quality during use, the production unit will be responsible for compensation for direct economic losses. Article 14 The Civil Aviation Administration of China is responsible for the interpretation of these regulations. Article 15 These regulations shall come into effect from the date of promulgation. Before the implementation of these regulations, units that have been approved by the Civil Aviation Administration to produce such vehicles and equipment must complete the procedures in accordance with the relevant provisions of these regulations within one year from the date of implementation of these regulations.
