Article 1 In order to strengthen the management of safe production and civilized construction of construction projects in our province, ensure that the cost of safe and civilized construction measures is put in place, effectively improve the working conditions and living environment of construction employees, and prevent and reduce the occurrence of safety accidents, According to People's Republic of China (PRC) Law on Work Safety, People's Republic of China (PRC) Construction Law, Regulations on Management of Work Safety in Construction Projects and other laws and administrative regulations, Provisions of the Ministry of Construction on Management of Costs and Use of Safety Protection and Civilized Construction Measures in Construction Projects, and Decision of Sichuan Provincial People's Government on Further Strengthening Work Safety (Z.F.F. [2004] No.20).

Article 2 These Measures shall apply to construction projects within the administrative area of Sichuan Province.

The term "construction projects" as mentioned in these Measures refers to all kinds of housing construction and municipal infrastructure projects.

Housing construction refers to all kinds of housing construction and its ancillary facilities, as well as supporting lines, pipelines, equipment installation projects and indoor and outdoor decoration projects.

Municipal infrastructure projects refer to civil engineering, pipeline and equipment installation projects of urban roads, public transportation, water supply, drainage, gas, heat, gardens, sanitation, sewage treatment, garbage disposal, flood control, underground public facilities and their ancillary facilities.

Article 3 The measures fee for safe and civilized construction as mentioned in these Measures refers to the cost required for purchasing and updating building safety protection articles and facilities and improving safe production conditions and working environment in accordance with the current national standards for building safety and environmental sanitation at construction sites and relevant regulations.

The cost of safe and civilized construction measures for construction projects consists of safe construction costs, civilized construction measures costs and temporary facilities costs. See attachment 1 for details.

Article 4 If the project with special requirements for safety protection and civilized construction is more dangerous than the standards stipulated in these Measures, and it is necessary to increase the cost of safety and civilized construction measures, the tenderer shall make separate items and calculate the cost when preparing the bill of quantities, pre-tender estimate or budget control price, and the bidder shall quote separately in the measure project according to the requirements of the tenderer and the engineering characteristics.

Article 5 The cost of safety and civilized construction measures is divided into two parts: basic cost and on-site assessment cost. The basic fee is the basic guarantee fee for the contractor's safety and civilized measures in the construction process, and the on-site evaluation fee refers to the increase fee for the safety and civilized measures obtained by the contractor in implementing the relevant safety and civilized construction regulations and the on-site inspection and dynamic evaluation organized by the construction safety supervision and management organization of the construction administrative department.

The measures fee for safe and civilized construction is calculated according to the charging basis stipulated in the current quota, and the specific standards are as follows:

On-site inspection and evaluation work shall be organized and implemented by the construction safety supervision and management institution of the construction administrative department.

Construction safety supervision and management institutions shall formulate on-site evaluation and scoring methods according to "Construction Safety Inspection Standards" (JGJ59-99).

On-site evaluation shall be subject to dynamic management, and the construction safety supervision and management institution shall inspect and evaluate the safety and civilized construction measures in stages according to the project progress and regulatory needs.

The construction safety supervision and management institution shall determine the final evaluation result according to the inspection and evaluation. The evaluation results are divided into three grades: excellent, qualified and unqualified.

1. If the evaluation result is excellent, the on-site evaluation fee will be charged.

The calculation method is as follows: if the score is 80 points, the on-site review rate is calculated at 40% of the basic rate; If the score is above 80 points, the on-site review rate will be increased by 3% on the basis of the basic rate; The intermediate value is calculated by interpolation method, with two digits after the decimal point and the third digit rounded off. The calculation formula of site evaluation rate is as follows:

On-site review rate = basic rate ×40%+ basic rate × (review score -80)×3%.

2. If the evaluation result is qualified, the score is 70 ~ 80. The cost of safety and civilized construction measures is calculated according to the basic cost, excluding the on-site evaluation fee.

3. If the evaluation result is unqualified, rectification shall be carried out, and the evaluation result after rectification shall be used as the calculation basis for the cost of safe and civilized construction measures. If the evaluation is still unqualified after rectification, the cost of safe and civilized construction measures will no longer be charged.

Three, the ground of the construction site should be hardened, and the civilized construction measures fee in the safety and civilized construction measures fee is calculated at 60% of the rate.

Four, during the period of construction, the contractor has more than four (including four) quality and safety accidents, regardless of the safety and civilized construction measures.

Five, without on-site assessment of the project, are not allowed to take safe and civilized construction measures.

Article 6 The cost of safe and civilized construction measures for construction projects is uncompetitive. In the preparation of budgetary estimate, budget control price or pre-tender estimate, tender offer, it should be fully calculated, that is, the cost rate of safe and civilized construction measures is calculated according to the basic rate plus the highest rate of on-site review fee.

Civilized construction measure rate = basic rate of civilized construction ×2.

Safety construction fee rate = basic safety construction fee rate ×2

Temporary facilities rate = basic rate of temporary facilities ×2

Article 7 If the bidder fails to quote for "civilized construction", "safe construction" and "temporary facilities" according to the rate stipulated in Article 6, its bid will be rejected.

Article 8 In order to ensure that safety and civilized construction measures are put in place, a rate measurement system shall be implemented for civilized construction, safe construction and temporary facilities. After the completion of the project, the contractor shall apply to the project cost management institution where the project is located for measurement with the Safety and Civilized Construction Measures Evaluation and Rate Determination Form (Annex 2).

Counties (autonomous regions and municipalities) without engineering cost management institutions belong to construction projects, and the measurement institutions of safe and civilized construction measures and rates are determined by the construction administrative departments of counties (autonomous regions and municipalities), and reported to the municipal and state engineering cost management institutions for the record.

According to the evaluation results of the construction safety supervision organization, the agency for determining the cost rate of safe and civilized construction measures determines the evaluation rate and the contractor's cost rate of safe and civilized construction measures. The measurement shall be completed within 3 working days after receiving the measurement form.

Article 9 The settlement management of safety and civilized construction measures:

After the project is completed and accepted, the contractor shall handle the completion settlement according to the rate determined in the Evaluation of Safe and Civilized Construction Measures and Rate Determination Table.

Without on-site review or the Contractor is unable to issue the Safety and Civilized Construction Measures Evaluation and Rate Determination Form, the Contractor shall not charge the safety and civilized construction measures fee.

Article 10 The employer and the contractor shall stipulate in the construction contract the total cost of safe and civilized construction measures, as well as the prepayment plan, payment plan, use requirements and adjustment methods. If the contract period is less than one year, the cost of safety and civilized construction measures paid in advance by the employer shall not be less than 60% of the basic cost; If the contract period is more than one year (including one year), the prepaid cost of safe and civilized construction measures shall not be less than 40% of the basic cost, and the rest shall be paid according to the construction progress and the contract.

In the case of general contracting, if the general contracting unit subcontracts the project to other units according to law, the general contracting unit and the subcontractors shall specify in the subcontract that the cost of safety and civilized construction measures shall be managed by the general contracting unit in a unified way. Safety and civilized construction measures shall be implemented by subcontractors, who shall put forward special safety and civilized construction measures, which shall be implemented after being approved by the general contractor and paid by the general contractor.

Article 11 When applying for a project construction permit, the construction unit shall submit the payment plan for safe and civilized construction measures agreed in the construction contract to the construction administrative department as a concrete measure to ensure the safe and civilized construction of the project. If it is not submitted, the construction administrative department shall urge the construction unit to submit it when issuing the construction permit.

Article 12 The Employer shall pay the contractor the cost of safety and civilized construction measures in time according to these regulations and the contract, and urge the contractor to implement the safety and civilized construction measures.

If the Employer fails to pay the cost of safe and civilized construction measures in accordance with these provisions and the contract, the construction administrative department at or above the county level shall, in accordance with the provisions of Article 54 of the Regulations on the Administration of Work Safety in Construction Projects, order rectification within a time limit; Overdue correction, shall be ordered to stop the construction project. Those who cause personal injury or death shall bear the corresponding liability for compensation.

Thirteenth engineering supervision units shall conduct on-site supervision on the implementation of safety and civilized construction measures by the employer and the contractor. If the supervision unit finds that the employer fails to pay the cost of safe and civilized construction measures according to the provisions of these measures or the contract, it shall promptly pay the employer. Refuse to pay, have the responsibility to report to the construction safety supervision and management institutions where the project is located; If it is found that the contractor fails to implement safe and civilized construction measures, it has the right to order it to make rectification. If the contractor refuses to make rectification, the project supervision unit shall promptly report to the employer and the construction administrative department and order it to suspend construction when necessary.

Article 14 The contractor shall ensure that the safety and civilized construction measures are earmarked. The contractor's safety production management organization and full-time safety production management personnel are responsible for on-site supervision and inspection of the organization and implementation of safety and civilized construction measures for construction projects, and have the right to report the situation to the construction administrative department.

The general contractor shall take overall responsibility for the cost of safe and civilized construction measures of the construction project. The general contractor shall, in accordance with these provisions and the contract, pay the subcontractors the cost of safe and civilized construction measures in a timely manner. If the general contractor fails to pay the fees in accordance with the provisions and the contract, resulting in the subcontractors failing to implement the safety and civilized construction measures in time, causing casualties, the general contractor shall bear the main responsibility and be liable for compensation if economic losses are caused.

Fifteenth construction administrative departments shall, in accordance with the current standards and norms, supervise and inspect the implementation of safety and civilized construction measures, and supervise and inspect the fees paid by the employer and the contractor for using safety and civilized construction measures.

Article 16 The employer or the engineering cost consulting enterprise entrusted by it shall calculate the safety and civilized construction measures fee according to the rates determined in the safety and civilized construction measures evaluation and rate determination table issued by the safety and civilized construction measures fee rate determination institution when auditing the project completion settlement.

Cost engineers and engineering cost consulting enterprises that fail to calculate the cost of safe and civilized construction measures in accordance with the provisions of these Measures shall be punished in accordance with Articles 19 and 20 of the Measures for the Administration of Construction Contracts and Contract Valuation (Order No.23). Ministry of Construction 107).

Seventeenth engineering supervision units did not review the safety technical measures or special construction plans in the construction organization design; Failing to ask the contractor to rectify or temporarily stop the construction after discovering the hidden dangers of safety accidents; The contractor refuses to rectify or stop the construction, and fails to report to the relevant competent department in time; Failing to implement supervision in accordance with laws, regulations and mandatory standards for engineering construction, it shall be punished in accordance with the provisions of Article 57 of the Regulations on the Administration of Work Safety in Construction Projects.

Eighteenth construction administrative departments of the staff have one of the following acts, shall be given administrative sanctions by their units or the competent authorities at higher levels in accordance with the provisions of laws and regulations:

(a) failing to supervise the implementation of the project in accordance with the provisions, and failing to submit the payment plan for safety and civilized construction measures, resulting in dereliction of duty in issuing construction permits;

(two) other acts that do not perform supervision and management duties according to law.

Article 19 Construction safety supervision and management institutions and safety civilized construction measures fee rate measurement institutions shall conscientiously perform their duties, adhere to the principles of fairness, openness and impartiality, and deal with supervisors who seriously fail to perform their duties, neglect their duties, abuse their powers and engage in malpractices for selfish ends in accordance with relevant regulations.

Twentieth these Measures authorize the provincial construction project cost management station to be responsible for the interpretation.

Article 21 These Measures shall be implemented as of August 6, 2006.
