Article 2 These Provisions shall apply to the drafting of local regulations and the formulation of government regulations by the Municipal People's Government. Article 3 The draft local regulations mentioned in these Provisions refer to the normative documents drafted by the Municipal People's Government and submitted to the Municipal People's Congress and its Standing Committee for deliberation in the form of a motion of the Municipal People's Government.

The term "government regulations" as mentioned in these Provisions refers to the normative documents formulated by the Municipal People's Government and promulgated and implemented in the form of orders of the Municipal People's Government. Article 4 The drafting of local laws and regulations and the formulation of government regulations shall conform to the provisions of the Constitution, laws, administrative regulations and other superior laws, follow the legislative principles and legislative authority determined by the Legislative Law of People's Republic of China (PRC) and the Regulations on Rules-making Procedures of the State Council, base on the actual situation of this Municipality and highlight local characteristics. Article 5 The names of draft local regulations are generally called "Regulations", "Implementation Measures" and "Provisions". The names of government regulations are generally called "regulations" and "measures", not "regulations". Article 6 Draft local regulations and government regulations shall conform to the legislative technical specifications, with strict structure, clear organization, accurate and concise language and clear and specific provisions.

In principle, local regulations and draft government regulations will not repeat the provisions of laws and regulations that have been clearly stipulated. Article 7 The legal institution of the Municipal People's Government shall guide, supervise and comprehensively coordinate the drafting of local regulations and the formulation of government regulations, and review the submitted draft local regulations and government regulations.

The people's governments of all districts and counties, Binhai New Area Management Committee, High-tech Zone Management Committee, Shuidongwan New City Management Committee, all departments and directly affiliated institutions of the Municipal People's Government, and organizations authorized by laws and regulations to manage public affairs shall, according to their respective responsibilities, undertake the specific work of drafting local laws and government regulations and cooperate with the relevant work of government legislation. Article 8 The funds required for drafting local laws and government regulations shall be included in the annual financial budget. Chapter II Project Establishment Article 9 The Municipal People's Government shall, according to the needs of urban and rural construction and management, environmental protection and historical and cultural protection in this Municipality, put forward local laws and regulations to propose projects and prepare annual plans for government regulations. Article 10 The legal institution of the Municipal People's Government shall, before June 65438+1 October1every year, solicit opinions and suggestions on local regulations and government regulations for the next year from the people's governments of all districts and counties, the administrative committees of Binhai New Area, High-tech Zone and Shuidongwan New City, the departments and directly affiliated institutions of the Municipal People's Government, and organizations authorized by laws and regulations. Article 11 District and county-level municipal people's governments, Binhai New Area Management Committee, High-tech Zone Management Committee, Shuidongwan New City Management Committee, various departments and directly affiliated institutions of the Municipal People's Government, and organizations authorized by laws and regulations with the function of managing public affairs shall put forward legislative suggestions to the legal institution of the Municipal People's Government if they think it necessary to formulate local regulations or government regulations in the next year. To put forward legislative proposals, the following materials shall be submitted to the legal institution of the Municipal People's Government:

(1) Legislative proposals. The contents include the names of local regulations or government regulations; The necessity and feasibility of formulation; The main problems to be solved; The main system to be established; Laws, regulations, rules and policy basis; Investigation and demonstration; Drafting timetable; Time for submitting the plan to the Municipal People's Government.

(2) Draft local regulations or government regulations. Twelfth citizens, legal persons and other organizations that put forward local laws and government regulations can only put forward the name of the legislative proposal project and the main reasons for legislation. Thirteenth local regulations and government rules and regulations proposed projects, should be put forward during the collection of legislative proposals by the legal institutions of the Municipal People's government. Overdue, generally not included in the next year's local regulations and government regulations suggested project scope. Article 14 The legal institution of the Municipal People's Government shall sort out and summarize the projects suggested by local laws and government regulations, listen to and study opinions and suggestions from all sides by holding project coordination meetings, demonstration meetings or special investigations according to actual needs, form the draft proposals of local laws and government regulations for the next year, and submit them to the executive meeting of the Municipal People's Government for deliberation. Fifteenth local regulations proposed by the executive meeting of the Municipal People's government, the office of the Municipal People's government shall timely submit it to the Standing Committee of the Municipal People's Congress for deliberation.

After the annual plan of government regulations is examined and approved by the executive meeting of the Municipal People's Government, the office of the Municipal People's Government shall issue it in time and announce it to the public. Sixteenth after the annual plan of government regulations is determined, the drafting unit shall organize the implementation according to the plan, and shall not adjust it by itself. The legal institution of the Municipal People's Government shall supervise the implementation.

If it is really necessary to adjust the annual plan of government regulations, the unit that puts forward the adjustment shall put forward the adjustment proposal to the Municipal People's government.
