Chapter 1 General Provisions Article 1 is to strengthen the protection, proliferation, development and rational utilization of fishery resources, develop artificial breeding, protect the legitimate rights and interests of fishery producers, promote the development of fishery production, and adapt to the construction of socialism These regulations are formulated in accordance with the provisions of the "Fisheries Law of the People's Republic of China" and relevant laws and regulations, and in light of the actual conditions of this province. Article 2 These Regulations shall apply to those engaged in fishery production activities such as breeding and fishing of aquatic animals and aquatic plants within the administrative area of ??this province. Article 3 People's governments at or above the county level shall incorporate fishery production into national economic and social development plans, make full use of resources, actively develop breeding, rationally arrange fishing, raise funds through multiple channels, gradually increase investment, and promote the sustainable development of fisheries.

Encourage the development and utilization of waste beaches and wasteland for aquaculture in accordance with the law; encourage the introduction of domestic and foreign funds, advanced technology and talents to engage in fishery production. Article 4 The fishery administrative department of the Provincial People's Government is responsible for the fishery management of the province.

The fishery administrative departments of the people's governments at or above the county level are responsible for fishery management within their own administrative regions.

Fishery management work across administrative regions shall be managed by the relevant county-level people's government through consultation, or by the fishery administrative department of the people's government at the next higher level. Chapter 2 Breeding Production Article 5 People's governments at or above the county level shall take measures to encourage the development of high-quality, ecological, and safe aquatic product breeding, and protect and rationally utilize aquatic biological resources with economic value.

The fishery administrative department of the Provincial People's Government is responsible for organizing and implementing the identification of the origin of pollution-free aquatic products, and assisting relevant departments in the certification of pollution-free aquatic products. Article 6 The preparation of plans for water areas that can be used for aquaculture shall be carried out in accordance with the following division of labor. After approval and announcement by the people's government at the same level, it shall be reported to the fishery administrative department of the people's government at the next higher level for the record:

(1) ) The planning of water areas that can be used for aquaculture across cities and prefectures in the province shall be prepared by the fishery administrative department of the provincial people's government in conjunction with relevant departments at the same level and relevant local people's governments;

(2) Cross-county ( The planning of water areas that can be used for aquaculture in cities, districts, special zones, etc. shall be prepared by the relevant county-level people's government through consultation, or by the fishery administrative department of the people's government at the next higher level in conjunction with the relevant departments at the same level. Prepared by departments and relevant local people's governments;

(3) The planning of waters that can be used for aquaculture in counties (cities, districts, special zones) shall be prepared by the fishery administrative department of the people's government at the local county level in conjunction with the same level Prepared by relevant departments. Article 7: If units or individuals use water areas owned by the whole people that are designated by the state for aquaculture, the users shall apply for a breeding license in accordance with the law.

Units and individuals engaged in aquaculture in contracted collective-owned waters shall voluntarily apply to the fishery administrative department of the local county-level people's government for aquaculture registration. Article 8 The fishery administrative department of the people's government at the county level is responsible for organizing the quarantine of the origin of aquatic animals within its own administrative region and the disinfection of transportation vehicles.

The fishery administrative departments of the people's governments at or above the county level shall regularly monitor and investigate aquatic animal pathogens, take effective measures to control major epidemics in a timely manner and report them in accordance with regulations.

Units and individuals engaged in aquaculture production shall cooperate with the fishery administrative departments of the people's governments at or above the county level to monitor and investigate aquatic animal epidemics. Article 9 The fishery administrative departments of the people's governments at or above the county level shall strengthen guidance, supervision and inspection of the use of fishery drugs in aquaculture production.

Units and individuals engaged in aquaculture production shall implement the technical standards, specifications or regulations of aquaculture production, shall not disrupt aquaculture production, and shall not use prohibited fishery drugs and toxic and harmful feed additives, premixed feeds, and feeds. , bait, and shall not engage in fishery farming in water bodies containing toxic and harmful pollutants, and shall not cause environmental pollution in the waters. Chapter 3 Aquatic Seeds Article 10 The fishery administrative department of the Provincial People's Government shall scientifically plan the production of aquatic seeds in the province based on the development of fishery production and the characteristics of germplasm resources.

Article 11 Those engaged in aquatic seed production must meet the following conditions and apply for an aquatic seed production license from the fishery administrative department of the county-level people's government:

(1) Have a fixed production site, The water source is sufficient and the water quality meets the fishery water standards;

(2) The quality of the parents used for breeding meets the germplasm standards;

(3) The production conditions and facilities meet the aquatic seed production technology Operating procedures requirements;

(4) Have professional and technical personnel suitable for aquatic seed production and quality inspection;

The provisions of the preceding paragraph do not include fishery producers’ self-breeding and self-owned aquatic products Seedlings. Article 12 The aquatic seed production licenses for aquatic raw materials and improved seed farms shall be reviewed and issued by the fishery administrative department of the provincial people's government; the aquatic seed production licenses shall be reviewed and issued by the fishery administrative department of the county-level people's government.

The examination and approval authority shall conduct an examination within 20 days from the date of receipt of the application materials, and make an administrative licensing decision to approve production for those that meet the conditions; for those that do not meet the conditions, make a written decision not to grant administrative licensing and Give reasons. Article 13 The production of aquatic seeds shall comply with the technical operating procedures for the production of aquatic seeds prescribed by the state or the province and comply with the quality standards for aquatic seeds. The parents of hybrid aquatic seedlings should be pure line populations.

The operation of aquatic seed shall be subject to supervision and inspection by the fishery administrative department of the people's government at or above the county level.

The introduction of aquatic seedlings from other places must go through quarantine procedures in accordance with relevant national regulations.
