Provisions of Zhuhai Municipality on the Administration of Outdoor Advertising

Chapter I General Provisions Article 1 In order to standardize the setting of outdoor advertisements in this Municipality, strengthen the management of outdoor advertisements and beautify the urban environment, these Provisions are formulated in accordance with the Advertising Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation of this Municipality. Article 2 These Provisions shall apply to the setting of outdoor advertisements and related management activities within the administrative area of this Municipality. Article 3 Outdoor advertising settings are divided into outdoor commercial advertising settings and outdoor signboard advertising settings.

The term "outdoor commercial advertising" as mentioned in these Provisions refers to the advertising facilities that directly or indirectly introduce goods or services.

The term "signboard advertisement" as mentioned in these Provisions means that enterprises, institutions and individual industrial and commercial households set up signs, plaques, signboards and other advertising facilities consistent with their registered names within the control scope of their business or office premises or buildings. Those used to indicate the name of a building belong to signboards, while other non-building name markers located on the roof belong to the category of advertisements and are included in the management of outdoor commercial advertisements. Fourth municipal construction administrative departments shall be responsible for organizing the preparation of outdoor advertising planning, and organizing the implementation after the approval of the municipal planning administrative department; And is responsible for the assignment of outdoor commercial advertising rights.

The municipal administrative department for industry and commerce is responsible for the examination, registration, supervision and management of outdoor advertising content.

Municipal, city, garden, public security, environmental protection, administrative law enforcement and other departments in accordance with their respective functions to do a good job in the supervision and management of outdoor advertising settings. Fifth outdoor advertising should be set according to the technical standards for outdoor advertising. Article 6 The installation of outdoor advertising facilities shall conform to the requirements of urban planning, adapt to the functional zoning of urban planning, rationally arrange and standardize the installation.

Outdoor advertising facilities should be safe and beautiful, and in harmony with the surrounding environment, in line with the requirements of beautifying the city. Chapter II Guidelines for the Establishment of Outdoor Commercial Advertisements Article 9 The establishment and publication of outdoor commercial advertisements shall meet the following requirements:

(2) The design, manufacture and installation of facilities shall conform to relevant technical, quality and safety standards, and inferior quality shall not be allowed. Tenth in any of the following circumstances, outdoor commercial advertisements shall not be set up:

(a) the use of traffic safety facilities, traffic signs.

(two) affect the use of municipal public facilities, traffic safety facilities and traffic signs.

(three) hinder production or people's lives, damage the appearance of the city or the image of the building.

(five) the use of illegal buildings, illegal dangerous houses and other buildings and facilities that may endanger safety.

(six) in the state organs, cultural relics protection units, excellent modern buildings and scenic spots in the building control zone.

The transaction method should be based on bidding and auction. For non-public places, the municipal construction administrative department shall negotiate and sign an agreement with the owner of the place or the user of the advertising space in the place, and give the owner of the place or the user of the advertising space in the place as the occupation fee according to the proportion of not more than 50% of the transaction income of the right to use outdoor commercial advertisements, and the rest shall be turned over to the municipal financial account. Article 15 The municipal administrative department of construction shall be responsible for planning and determining the bidding, auction and listing transactions of the right to use advertisements, including organizing the preparation of bidding, auction and listing transaction documents, drawing up the transaction reserve price and the amount of performance bond, signing a contract with the buyer for the right to use outdoor commercial advertisements, collecting the transaction price for the right to use outdoor commercial advertisements, and handling the certificate for the right to use outdoor commercial advertisements.
