Interim Measures of Hangzhou Municipality on the Administration of Commercial Characteristic Blocks

Chapter I General Provisions Article 1 In order to strengthen and standardize the management of commercial characteristic blocks, maintain a good social order of commercial characteristic blocks, create a beautiful, clean, safe and orderly shopping, leisure and tourism environment, and promote the prosperity and development of commercial characteristic blocks, these Measures are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Measures shall apply to the management of commercial characteristic blocks in Hangzhou (excluding Xiaoshan District and Yuhang District).

All units and individuals who live, work and engage in business, shopping, tourism, cultural and recreational activities in commercial blocks shall abide by these measures. Article 3 The term "commercial characteristic block" as mentioned in these Measures refers to a commercial block with catering, shopping, leisure, tourism, culture, entertainment and other characteristics named by the Municipal People's Government according to the overall urban planning of Hangzhou.

The specific scope of commercial characteristic blocks (hereinafter referred to as blocks) shall be announced by the local district people's government or the administrative committees of development zones, resorts and scenic spots (hereinafter referred to as district people's governments) in accordance with the scope approved by the Municipal People's government. Fourth block management should follow the principle of territorial management, high efficiency and convenience. Article 5 The trade administrative department of Hangzhou Municipal People's Government shall be responsible for the comprehensive coordination and management of the professional planning, characteristic positioning and commercial network layout of this block. The District People's Government where the sixth block is located is responsible for organizing the implementation of these measures.

The District People's Government may set up a block management organization to be responsible for the daily supervision and management of the block.

The relevant administrative departments shall, in accordance with their respective responsibilities, do a good job in the relevant management work within the block.

The relevant township (town) people's governments and sub-district offices shall cooperate with the block management agencies and relevant administrative departments to do a good job in the daily supervision and management of the block. Article 7 The block management institutions shall carry out daily supervision and management of city appearance, environmental sanitation and greening, public order and traffic safety, public facilities and commercial operations ... Article 8 The municipal and district people's governments shall increase the investment in block management funds, and the funds needed for daily supervision and management of the block management institutions shall be guaranteed by the finance. Ninth administrative departments shall, in accordance with the provisions of the "People's Republic of China (PRC) Administrative Licensing Law", implement administrative licensing for administrative licensing matters involving block management, and regularly report the results of administrative licensing to the local block management agencies. Tenth in violation of the provisions of these measures, the relevant administrative departments shall, in accordance with the provisions of relevant laws, regulations and rules, give administrative punishment according to law.

City, district urban management administrative law enforcement organs in accordance with the provisions of the "Hangzhou city management relatively centralized administrative punishment power implementation measures", the exercise of urban management administrative punishment power in the block according to law. Eleventh block management agencies should discourage or stop illegal acts in the block, and in accordance with the provisions of laws, regulations and rules handed over to the relevant administrative departments; After making a decision on administrative punishment, the relevant administrative departments shall regularly inform the local block management agencies of the results of administrative punishment applicable to general procedures. Chapter II City Appearance, Environmental Sanitation and Greening Management Article 12 All units and individuals should consciously safeguard the good city appearance and environmental sanitation of the block.

The following acts affecting the appearance of the city and the environmental sanitation of public places are prohibited in the block:

(1) illegally posting, scribbling or portraying on the external walls of buildings, municipal public facilities, pipelines, trees and other facilities;

(two) hanging, drying and placing unsightly items at the top of the building facing the street, outside the balcony, outside the window and inside the window;

(three) spitting, urinating, or littering, dumping all kinds of waste;

(four) the construction site does not take measures to prevent dust pollution in accordance with the regulations, which affects the city appearance and environmental sanitation;

(5) Bathing or washing articles in water spraying facilities;

(six) other acts that affect the city appearance and environmental sanitation. Thirteenth it is forbidden for any unit or individual to occupy, damage or dismantle, relocate, rebuild or close the environmental sanitation facilities in the block without authorization. Fourteenth units within the block shall, in accordance with the provisions of the "Hangzhou" three bags in front of the responsibility system management measures ",do a good job in the" three bags in front of the door "responsibility.

Block management agencies are responsible for checking the specific implementation of the "three guarantees in front of the door" responsibility system of responsible units in the block. Fifteenth blocks in the architectural style, landscape design, outdoor advertising and public facilities, should be coordinated with the characteristics of the block positioning, the overall environment.

No unit or individual is allowed to change the original design style and color of buildings in the block without authorization, and not to hang colorful flags, install lighting and other decorations on buildings (structures) facing the street without authorization. Article 16 The property owner or user of buildings (structures) facing the street in the block shall regularly clean and paint the facade of buildings (structures) in accordance with the relevant provisions to keep the buildings clean and beautiful; If it is damaged, it should be repaired in time to maintain its original style.

The decoration of the facade of the street building by the owners and merchants in the block should be coordinated with the characteristic orientation and overall environment of the block. Article 17 If the following activities within a block need to be examined and approved by the relevant administrative departments according to law, the relevant administrative departments shall solicit the opinions of the local block management agencies in writing in advance, and the block management agencies shall conduct daily supervision and management:

(a) building (structure) facade decoration;

(two) new construction, expansion and reconstruction of buildings (structures);

(3) Setting up landscape lighting facilities;

(4) occupying or digging roads;

(five) set up outdoor advertising, or set up public welfare billboards (columns) and slogans;

(six) other activities that affect the landscape of the block.
