A company in Qianshan, Jiangxi illegally occupied forest land to mine sand. What penalties will they face?

An enterprise in Qianshan, Jiangxi Province illegally occupied forest land and mined sand. The Eighth Inspection Team of the State Council’s nine inspections went to Wang Village, Wuyishan Town, Yanshan County, Jiangxi Province for an on-site inspection and found that the enterprise occupied forest land and illegally mined sand and gravel for more than 40 years. Mu, the original geological disaster management road section has become the site of illegal logging and deforestation, endangering people's production, life and travel safety, and the relevant departments have failed to supervise.

Jiang Tianyuan Company did not apply for a logging license and a sand mining license, and the use of forest land greatly exceeded the approved scope, including 29.16 acres of national public welfare forest. In order to pile up the excavated sand and gravel, the company also illegally expropriated 11.86 acres of villagers' land through the Wangcun Village Committee. The Yanshan County Natural Resources Bureau commissioned the Geographic Information Group of the Jiangxi Provincial Geological Bureau to estimate the amount of sand and gravel loss from the site, which totaled approximately 43,900 cubic meters and was estimated by professionals to be worth nearly 1 million yuan.

The Lianshan County Development and Reform Commission did not implement the "three major" decision-making mechanisms. Without the consent of the County People's Government General Affairs Committee and the County Party Committee Standing Committee, it only relied on an application report and the Jiangtianyuan Company's geological disaster emergency investigation report to give a reply. . During the application, construction and exit processes of the enterprise, relevant departments engaged in illegal operations and lack of supervision, which created pitfalls. According to regulations, earth and rock materials generated by geological disaster recovery projects should be included in the public resource trading platform by the county-level people's government, and construction companies are not allowed to dispose of them privately. However, the Wuyishan Municipal Government and Wangcun Village Committee illegally signed an agreement with Jiang Tianyuan Company to allow it to process and sell waste rock generated during the construction process.

Lianshan County urges and coordinates relevant units to complete the Wangcun and Shangping geological disaster restoration projects, ecological restoration of disaster spots, and restoration of occupied cultivated land as soon as possible in accordance with the project schedule requirements, so as to solve problems affecting people's travel. Straighten out the supervision mechanism, check various illegal activities during the construction process, and strengthen the responsibilities of the competent departments and relevant responsible persons. The Yanshan County government carried out reforms. At present, the backfilling and drainage and irrigation facilities for the cultivated land temporarily occupied by stacked materials have been completed. The second season of late rice was planted, and the quality improvement and restoration work was fully completed. The Lianshan County Forestry Bureau hired a third party to assess the damage to forest resources, organized and arranged forestry law enforcement personnel to conduct investigations, and dealt with illegal activities strictly in accordance with the law.
