Chapter I General Provisions

Article 1 In order to strengthen the management of urban construction waste and improve the quality of city appearance and environmental sanitation, these regulations are formulated in accordance with the Regulations of the State Council Municipality on the Management of City Appearance and Environmental Sanitation, the Regulations of Sichuan Province on the Management of City Appearance and Environmental Sanitation and other relevant laws and regulations.

article 2 the term "construction waste" as mentioned in these provisions refers to muck, waste materials and other wastes generated by construction units or individuals in the process of new construction, reconstruction, expansion, laying or demolition, repair and decoration.

article 3 these provisions shall apply to the generation, collection, transportation and disposal of construction waste by any unit or individual within the city limits of this municipality.

article 4 the management of construction waste in this municipality shall follow the principles of unified management, graded responsibility, and the combination of functional department supervision and social supervision.

the municipal administrative department of city appearance and environmental sanitation is responsible for the management of urban construction waste in this city.

the city appearance and environmental sanitation administrative department determined by the people of * * * * county in * * * District is responsible for the management of urban construction waste within its jurisdiction.

chapter ii management of collection, transportation and disposal

article 1 a unit that produces construction waste shall, within 15 days before the start of construction, handle the construction waste disposal permit with the relevant documents such as the construction project planning permit, the demolition permit or the safety permit for the decoration of the building structure, and the information such as the quantity, types and disposal plan of the generated construction waste.

article 11 the construction unit shall strengthen the environmental sanitation management around and out of the construction site to prevent the construction waste from spreading and polluting the surrounding environment. Engaged in road or pipeline construction, the construction area should be effectively isolated to prevent the spread of construction waste from polluting the road.

article 12 the construction waste generated by personal decoration or maintenance of houses can be piled up at the temporary stacking point designated by the people of the sub-district office * * * * * *, and the administrative department of city appearance and environmental sanitation will organize the removal in a unified way.

article 13 the collection of construction waste shall be civilized, and it shall not be mixed with domestic waste, littered or piled up, and shall be removed in time. If it is really necessary to temporarily store it on the construction site, it should be stored centrally at the site and effectively covered.

Article 14 After the project is completed or the house is demolished, the construction unit shall * * * occupy the road within 3 days, and * * * within five days for construction; All construction waste will be removed and reported to the administrative department of city appearance and environmental sanitation for acceptance.

article 15 whoever engages in the transportation and disposal of construction waste shall be examined by the administrative department of city appearance and environmental sanitation. Article 23 A construction waste disposal site shall not dispose of industrial waste, domestic waste or hazardous wastes such as toxic, harmful, flammable and explosive wastes.

Chapter IV Legal Liability

Article 24 In case of any of the following acts, the administrative department of city appearance and environmental sanitation shall order it to make corrections, remove pollution within a time limit, and go through the formalities of examination and approval, and may impose a penalty of * * * of more than 1 yuan and less than 5 yuan. In case of any of the acts in items * * * 3 * * to * * * 5 * * *, one of the Construction Waste Transportation Permit may be temporarily withheld.

Article 25 In case of any of the following acts, the administrative department of city appearance and environmental sanitation shall order it to make corrections and remove the pollution within a time limit, and may also impose * * *:

Article 26 In case of any of the following acts, the administrative department of city appearance and environmental sanitation shall order it to make corrections, complete the examination and approval procedures within a time limit, restore the original state, and clean up the pollution, and may impose a fine of more than 2, yuan and less than 1, yuan.

article 33 the administrative law enforcement personnel of the administrative department of city appearance and environmental sanitation shall enforce the law impartially. Abuse of power, corruption, given administrative sanctions by their units or the competent authorities at a higher level; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 34 If the performance of official duties is protected by law and hinders the administrative law enforcement personnel of the city appearance and environmental sanitation administrative department from performing official duties according to law, the public security organ shall punish them in accordance with the Regulations of the People's Republic of China on Administrative Penalties for Public Security; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter V Supplementary Provisions

Article 35 The collection of construction waste disposal fees and their charging standards shall be implemented after being reported by the municipal administrative department of city appearance and environmental sanitation to the provincial finance department and the provincial price department for examination and approval. The special fund from the income is used for the construction and management of construction waste treatment facilities.
