Regulations of Anhui Province on the Administration of Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and administrative regulations and in the light of the actual situation of this province in order to standardize the management of police auxiliary personnel in public security organs, ensure and supervise police auxiliary personnel to perform their duties according to law and safeguard their legitimate rights and interests. Article 2 These Regulations shall apply to the activities such as the definition of duties, recruitment, use, guarantee, supervision and management of police auxiliary personnel of public security organs within the administrative area of this province.

The auxiliary police officers referred to in these Regulations (hereinafter referred to as auxiliary police officers) refer to non-people police officers who are recruited to provide auxiliary support for the daily operation and police activities of public security organs according to the development of social security situation and the actual needs of public security work, including civilian auxiliary police and service auxiliary police.

Social forces such as public security joint defense, public security volunteers, village protection teams and school protection teams, and staff engaged in logistics services such as security, cleaning and food delivery in public security organs do not belong to the auxiliary police. Article 3 The management of auxiliary police shall follow the principle of "who uses, who manages and who is responsible", and implement standardized management, clear rights and responsibilities, strict supervision and enhanced guarantee. Article 4 The people's governments at or above the county level shall incorporate the construction of auxiliary police into the special plans related to national economic and social development, scientifically allocate and reasonably control the scale of auxiliary police according to the local economic and social development and social security situation and the principles of appropriate total amount, inclined grassroots, dynamic adjustment and classified use, and include the auxiliary police's salary and welfare, equipment, education and training in the fiscal budget at the corresponding level. Fifth public security organs of the people's governments at or above the county level shall be responsible for the management of auxiliary police.

Institutions, civil affairs, finance, human resources and social security, health, retired military affairs and other relevant departments shall, in accordance with their respective responsibilities, do a good job in the management of auxiliary police. Article 6 Auxiliary police officers who have made outstanding achievements and contributions in their posts shall be commended and rewarded in accordance with relevant regulations.

When recruiting people's police for outstanding auxiliary police, the public security organs shall follow the relevant provisions of the state. Chapter II Duties, Rights and Obligations Article 7 The auxiliary police shall, under the command of the public security organ or the leadership of the people's police, perform auxiliary police work in accordance with regulations.

Auxiliary police perform their duties according to law and are protected by law. Citizens, legal persons and other organizations shall support and cooperate with them.

The consequences of the auxiliary police performing their duties according to law shall be borne by the local public security organs. Eighth civilian auxiliary police can assist the people's police to carry out the following work:

(a) window service, information collection and entry, wiring (letter) query and other management services;

(two) psychological counseling, medical treatment, translation, computer network maintenance, data analysis, communication security, video surveillance and other professional and technical work;

Police security work such as custody and maintenance of police equipment;

(four) other work that can be carried out according to law.

To carry out the work mentioned in the preceding paragraph, it is necessary to have corresponding qualifications according to law and obtain corresponding professional qualifications. Article 9 Under the command of the public security organ or the leadership of the people's police, the service auxiliary police shall assist in the following work according to law:

(1) Accepting and handling people's requests for help and resolving contradictions and disputes according to law;

Carry out publicity and education on public security, traffic safety and drug control;

(three) to divert traffic, discourage and correct traffic safety violations;

(four) to maintain the order and safety of the case (incident), protect the case (incident) and rescue the injured and trapped people;

(five) to carry out services such as information collection and registration of floating population;

Carry out patrol, duty and safety inspection;

(seven) to stop the ongoing illegal and criminal activities;

(eight) other work that can be carried out according to law. Article 10 Under the leadership of the people's police, the service auxiliary police shall assist in the following work according to law:

(a) rental housing security management, special industries, drug control, immigration, border inspection, entry and exit and other related management services;

Implement traffic control and traffic safety inspection;

(3) Assisting in investigating, blocking, monitoring and guarding persons suspected of committing crimes;

(four) to accept reports, register cases, accept evidence, collect information, mediate and serve documents;

(five) to assist in taking temporary protective restraint measures against drunken people whose behavior is out of control and mental patients who commit violent acts;

Management of case handling and supervision places;

(seven) to maintain the order of large-scale public activities;

(eight) to participate in the handling of emergency cases (incidents);

(nine) other work that can be carried out according to law. Eleventh service auxiliary police shall be equipped with necessary duty and safety protection equipment during the performance of their duties, and may drive police vehicles, boats and other means of transportation; In case of emergency endangering public security, social order and citizens' personal and property safety, they can assist in the use of binding police equipment under the leadership of the people's police. Twelfth auxiliary police shall not engage in the following work:

(1) Handling matters involving state secrets;

(2) investigating and collecting evidence, issuing appraisal reports and identifying the responsibility for traffic accidents;

(3) Implementing criminal compulsory measures;
