Chapter 1 General Provisions Article 1 In order to prevent and control air pollution, protect and improve the environment, protect public health, promote the construction of ecological civilization, and promote sustainable economic and social development, in accordance with the "Atmospheric Administration of the People's Republic of China and the State Council" These measures are formulated in accordance with the provisions of laws and regulations such as the Pollution Prevention and Control Law and in light of the actual situation of this city. Article 2 These Measures apply to the prevention and control of air pollution and its supervision and management activities within the administrative region of this city. Article 3 The municipal environmental protection administrative department shall implement unified supervision and management of the prevention and control of air pollution in the city, and the district (city, county) environmental protection administrative department shall implement supervision and management of the prevention and control of air pollution within its jurisdiction.

Development and reform, industry and informatization, public security and traffic management, housing and urban and rural construction, urban management (urban comprehensive administrative law enforcement), agriculture, transportation, meteorology, urban and rural planning, quality and technical supervision, education, Relevant administrative departments such as industry and commerce, health, and land and resources, township (town) people's governments, and community service management agencies shall do a good job in air pollution prevention and control in accordance with their respective responsibilities.

Guiyang Economic and Technological Development Zone Management Committee, Guiyang National High-tech Industrial Development Zone Management Committee, Guiyang Comprehensive Bonded Zone Management Committee, Guizhou Shuanglong Airport Economic Zone Management Committee and other development zone management committees ( (hereinafter collectively referred to as the Management Committee) is responsible for the quality of the atmospheric environment within the management area, and implements supervision and management in accordance with the law. The people's governments at or above the county level shall, in accordance with the assessment methods, assess the completion of the atmospheric environment quality objectives of the relevant administrative departments at the same level, the people's governments at the next level, and the management committees every year, and the assessment results shall be used as the basis for the leadership team and An important part of the performance evaluation of its members.

If the atmospheric environment quality target tasks are not completed, the relevant administrative departments at the municipal level, the people's government at the county level, and the management committee shall interview their main persons in charge, and the relevant administrative departments at the county level, township level, and The (town) People's Government shall interview its main person in charge from the county-level People's Government. The person in charge being interviewed should explain the unfinished situation and implement rectifications. Those who fail to complete the atmospheric environment quality objectives or fail to implement rectifications as required will be held accountable in accordance with regulations.

The assessment results, interviews, and accountability situations should be announced to the public. Article 5: State agencies and their working departments shall carry out education, publicity and training on the current status, situation, tasks and laws and regulations of atmospheric environmental protection, and enhance the awareness of national conditions, rule of law and responsibility of civil servants and other staff in atmospheric environmental protection.

Educational administrative departments and schools should incorporate atmospheric environmental protection knowledge into school education content and cultivate students’ awareness of atmospheric environmental protection.

News media should carry out publicity on atmospheric environmental protection laws, regulations and relevant scientific knowledge, and conduct public opinion supervision on atmospheric environmental violations. Article 6: Encourage and support public participation in air pollution prevention and control and supervision of management, services, law enforcement and other activities.

Encourage and support third parties such as environmental protection public welfare organizations to participate in public welfare activities such as air pollution prevention and control and supervision.

Encourage social capital to invest in air pollution control. Chapter 2 Supervision and Management Article 7 The Municipal People's Government shall organize the municipal environmental protection, urban and rural planning and other relevant administrative departments to delineate functional areas for atmospheric environment quality and key areas for air pollution prevention and control, and announce them to the public. Article 8 The environmental protection administrative departments at or above the county level shall, based on the air pollution status and prevention and control requirements, organize the preparation of plans for meeting the air environment quality standards within a time limit for areas that have not reached the standards and other special plans for air pollution prevention and control, clarify the treatment goals, tasks, plans and measures, and report It will be announced to the public after approval by the people's government at the same level. Article 9 The Municipal People's Government shall combine the city's urban construction, climate, mountains, water systems, green space systems and wind environment characteristics to optimize the spatial layout, improve the natural ecological network, build urban ventilation systems, and improve the quality of the atmospheric environment. Article 10 The municipal administrative department of urban and rural planning shall organize the preparation of the ventilation corridor layout plan in the central urban area, clarify the overall layout of the ventilation corridor and its planning control requirements, and submit it to the Municipal People's Government for approval before announcing it to the public.

The overall layout of ventilation corridors in central urban areas and their planning control requirements should be included in the city's overall urban planning and regulatory detailed planning for management.

District (city, county) urban and rural planning administrative departments outside the ventilation corridor layout planning area in central urban areas should incorporate the construction of urban ventilation corridors into planning control management.

Article 11 The people's governments at or above the county level shall establish and improve the coordination mechanism for air pollution prevention and control involving the participation of environmental protection and other relevant administrative departments, regularly report on the situation of air pollution prevention and control, and study and deal with major matters related to air pollution prevention and control. Article 12 People's governments and management committees at all levels shall implement management according to the delineated environmental supervision grid, establish a responsibility list, clarify the responsible units and responsible persons, and make it public to the public.

People's governments at or above the county level and administrative committees should use advanced concepts and technologies such as big data and blockchain to establish and improve air pollution prevention and control technology systems, service methods and supervision models, and improve and enhance air pollution Prevention and control technical level, service quality and management capabilities. Article 13 The municipal environmental protection administrative department shall organize the construction and management of a municipal-level online atmospheric environmental quality monitoring and release platform and an automatic pollution source monitoring platform, and network them with the corresponding national and provincial platforms.

Relevant administrative departments such as industry and informatization, public security and traffic management, housing and urban and rural construction, urban management (urban comprehensive administrative law enforcement), transportation, quality and technical supervision, meteorology, agriculture and other relevant administrative departments should organize air pollution prevention and control The information is connected to the municipal atmospheric environment quality online monitoring and publishing platform.

County-level people's governments and management committees should establish automatic monitoring stations (points) for atmospheric environment quality and connect to municipal-level online atmospheric environment quality monitoring and release platforms.
