Regulations of Lvliang Municipality on the Protection of Ancient and Famous Trees

Chapter I General Provisions Article 1 In order to protect ancient and famous trees, inherit history and culture, and promote the construction of ecological civilization, these Regulations are formulated in accordance with the Forest Law of People's Republic of China (PRC), the Regulations on Urban Greening and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection and management of ancient and famous trees legally recognized and published within the administrative area of this Municipality. Article 3 The term "ancient trees" as mentioned in these Regulations refers to trees that are more than 100 years old.

The famous trees mentioned in these Regulations refer to precious and rare trees or trees with important historical, cultural and scientific research value and important commemorative significance. Article 4 The protection of ancient and famous trees adheres to the principles of government leading, social participation, territorial management, comprehensive protection and scientific management and protection. Fifth city and county (city, district) people's government should strengthen the leadership of the protection and management of ancient and famous trees, and incorporate the protection and management of ancient and famous trees into the economic and social development plan.

City, county (city, district) Greening Committee shall organize and coordinate the protection and management of ancient and famous trees within their respective administrative areas. Article 6 The competent departments of forestry, greening and urban greening of the people's governments of cities and counties (cities, districts) (hereinafter referred to as the departments in charge of ancient and famous trees) shall be responsible for the protection and management of ancient and famous trees within their respective administrative areas in accordance with the duties prescribed by the people's governments.

City, county (city, district) people's government finance, ecological environment, agriculture and rural areas, water conservancy, transportation, public security, cultural tourism, cultural relics, ethnic and religious departments to do a good job in the protection and management of ancient and famous trees within the scope of their duties.

Township (town) people's governments and subdistrict offices shall assist the departments in charge of ancient and famous trees to do a good job in the protection and management of ancient and famous trees within their respective administrative areas.

Village (neighborhood) committees assist in the protection of ancient and famous trees within their respective jurisdictions, and encourage the formulation of village rules and regulations for the protection of ancient and famous trees. Seventh city and county (city, district) people's government and its relevant departments should strengthen the publicity and education of the protection of ancient and famous trees, and enhance the awareness of the whole society to protect ancient and famous trees. Eighth units and individuals are encouraged to participate in the protection of ancient and famous trees in the form of adoption and donation.

Units and individuals that adopt and donate money to protect ancient and famous trees shall enjoy the right to mark and mark within a certain period of time.

City, county (city, district) people's government shall commend and reward the units and individuals that have made remarkable achievements in the protection of ancient and famous trees. Article 9 All units and individuals have the obligation to protect ancient and famous trees, and have the right to stop and report acts that damage ancient and famous trees. Chapter II Identification of Ancient and Famous Trees Article 10 The people's governments of cities and counties (cities, districts) shall conduct a general survey of ancient and famous trees resources within their administrative areas every five years, register, number, take photos and file them, and make them public. Eleventh ancient and famous trees should be protected at different levels:

(a) trees over 500 years old are first-class ancient trees, which are under first-class protection;

(2) Trees that are more than 300 years old but less than 500 years old are second-class ancient trees, which are subject to second-class protection;

(three) the age of trees 100 years old and less than 300 years old are three-level ancient trees, and three-level protection is implemented.

The third-class ancient trees in the urban built-up area are protected at the second level, and the second-class ancient trees are protected at the first level.

Trees with a tree age of more than 80 years and less than 100 years within the urban built-up area are regarded as the follow-up resources of ancient trees, and three-level protection is implemented with reference to ancient trees.

Famous trees are not limited by the age of trees, and the first-class protection is implemented. Twelfth county (city, district) people's government departments in charge of ancient and famous trees should be in accordance with the national and provincial standards for the identification of ancient and famous trees, and in accordance with the following provisions for identification and publication:

(a) a class of ancient and famous trees submitted to the provincial people's government departments of ancient and famous trees identified and published;

(II) Secondary ancient trees are identified and published by the competent department of ancient and famous trees of the Municipal People's Government, and reported to the competent department of ancient and famous trees of the provincial people's government for the record;

(III) Grade III ancient trees are identified and published by the departments in charge of ancient and famous trees of the county (city, district) people's government, and reported to the departments in charge of ancient and famous trees of the provincial and municipal people's governments for the record. Article 13 The departments in charge of ancient and famous trees of the people's governments of counties (cities, districts) shall, in accordance with the requirements of "one tree and one file", establish graphic files and electronic information databases of ancient and famous trees, and dynamically manage information such as the location, characteristics, age, history and culture, growth environment, growth status and protection status of ancient and famous trees. Fourteenth county (city, district) people's government departments in charge of ancient and famous trees should strengthen the daily monitoring of ancient and famous trees resources, investigate and identify the ancient and famous trees resources found, and identify and publish them in accordance with the provisions of Article 12 of these regulations. Chapter III Conservation of Ancient and Famous Trees Article 15 The responsibility system shall be implemented for the conservation of ancient and famous trees, and the person responsible for conservation shall be determined in accordance with the following provisions:

(a) organs, social organizations, enterprises and institutions, cultural relics protection units, sites for religious activities and other ancient and famous trees within the scope of land, by the unit responsible for the maintenance;

(two) the old and famous trees in airports, railways, highways, river dams, reservoirs and lakes shall be maintained by their management units;

(three) the ancient and famous trees in natural and cultural heritage sites, nature reserves, scenic spots, tourist resorts, forest farms and forest parks, geological parks, wetland parks and urban parks shall be maintained by their management institutions;

(four) the ancient and famous trees within the scope of urban roads, streets, green spaces, squares and other public facilities shall be maintained by their management agencies;

(five) the old and famous trees in urban residential areas and residential courtyards shall be maintained by the owners. Owners are not clear, by the township (town) people's government or street offices responsible for maintenance;

(six) the ancient and famous trees within the scope of public facilities such as township streets, green spaces and squares shall be maintained by the township (town) people's government;

(seven) the ancient and famous trees on the contracted land in rural areas shall be maintained by the contractors; The ancient and famous trees on the rural homestead shall be maintained by the right holder of the homestead; Other ancient and famous trees within the scope of rural land shall be maintained by villagers' groups or villagers' committees;

(eight) the adoption of ancient and famous trees, in the adoption period, the adoption unit or the adopter is responsible for the maintenance.

If the person responsible for conservation is not clear or has any objection, it shall be determined by the competent department of ancient and famous trees of the county (city, district) people's government.
