Specification for police work of highway patrol police force

Chapter I General Provisions Article 1 This Code is formulated in accordance with relevant laws and regulations for the purpose of regulating the police work of highway patrol teams, maintaining safe and smooth road traffic and public order, and ensuring that highway patrol teams perform their duties according to law. Article 2 This Code applies to traffic police brigades, traffic police squadrons (including road traffic police squadrons and township traffic police squadrons) and large (middle) teams of road traffic police. Article 3 The police work of highway patrol teams shall follow the principles of legality, science, high efficiency, standardization, openness and convenience. Article 4 Provincial public security organs shall scientifically plan the layout of highway patrol police teams, set up highway patrol police teams according to the traffic safety situation and highway mileage in their respective jurisdictions, and equip them with police forces according to comprehensive factors such as highway mileage, traffic flow, population, number of motor vehicles and drivers, and traffic safety.

Specific equipment standards shall be formulated by provincial public security organs. Article 5 The highway patrol police force shall be graded, and the specific measures shall be formulated separately by the Ministry of Public Security. Sixth highway patrol police can be equipped with traffic assistants according to the needs.

The relevant provisions on the recruitment, training, use and assessment of traffic assistants shall be formulated by the provincial public security organs. Chapter II Duties and Powers Article 7 Highway patrol teams shall perform the following duties:

(1) directing and diverting traffic and maintaining highway traffic order;

(two) to investigate and deal with traffic violations according to law;

③ Preventing and handling traffic accidents;

(four) to handle or accept the business of motor vehicle registration and driver's license management in accordance with the relevant provisions;

(five) to carry out publicity and education on traffic safety;

Investigate the hidden dangers of highway traffic safety;

(seven) to deal with public security and criminal cases on the expressway in advance;

Investigate criminal suspects in accordance with relevant regulations;

(nine) accept the masses for help;

(ten) the implementation of traffic emergency management;

(eleven) other duties as prescribed by laws and administrative regulations. Article 8 When investigating traffic violations, highway patrol police may take administrative compulsory measures such as detaining vehicles, detaining motor vehicle driving licenses, towing motor vehicles, collecting articles, and detecting the contents of alcohol, psychotropic drugs and narcotic drugs under state control in drivers. Ninth highway patrol police can give priority to the use of vehicles on the highway because of emergency needs such as rescuing the injured and handling emergencies, and should return them in time and pay appropriate fees after use; If losses are caused, compensation shall be made. Tenth in case of natural disasters, bad weather or traffic accidents that seriously affect traffic safety, the highway patrol team can implement traffic control in accordance with relevant laws and regulations and work plans.

To implement traffic control, set up warning signs, indicating signs, etc. Should be set up at the scene to do a good job of traffic command and guidance. Eleventh highway patrol teams should accept the professional guidance of public security and criminal investigation departments, and establish a cooperation mechanism with them in transferring cases, handling public security criminal cases and cracking down on illegal crimes.

Public security, criminal investigation and other departments shall promptly accept the cases handed over by the highway patrol team according to law. Chapter III Highway Service Article 12 Highway patrol teams implement the service mode of combining patrol duty with fixed-point duty, and can use traffic technology monitoring equipment to monitor highway traffic according to law. Thirteenth highway patrol police should strictly implement the service system, and shall not leave their posts without leave or miss their posts, and shall not arbitrarily change the service route and duty time. Fourteenth neighboring provinces, autonomous regions and municipalities directly under the central government, the traffic administrative departments of public security organs and highway patrol police teams should study and establish a regional police cooperation mechanism and implement a joint service system. Fifteenth highway patrol police should perform the following tasks when performing law enforcement tasks:

(a) when driving a police car on patrol, pay attention to the observation of highway traffic, and check whether traffic lights, traffic signs, traffic markings and traffic facilities are in good condition;

(2) directing and diverting traffic and maintaining highway traffic order;

(three) to stop, correct and punish traffic violations according to law;

(four) to accept citizens' help and alarm, to deal with public security and criminal cases on the expressway in advance, and to help people whose personal and property safety has been violated;

(five) on the spot to control the person accused of a crime or suspected of a crime and hand it over to the public security organ with jurisdiction;

Other circumstances handled according to the instructions of the superior.

In the process of pre-disposal of public security and criminal cases on the expressway, at least two policemen should participate in the investigation of suspicious persons and motor vehicles or perform tasks such as inquiry, inspection and arrest, and the division of tasks between vigilance and inspection should be made clear, so as to be alert at all times and ensure safety. Sixteenth highway patrol police driving a police car to perform patrol tasks, should turn on the warning light, according to the provisions to maintain the speed and distance. When performing law enforcement tasks, you should wear reflective vests and observe the following safety protection regulations:

(1) Except for special tasks such as intercepting serious violent criminal suspects, when performing fixed-point duty, intercepting and inspecting vehicles or handling traffic violations, we should choose a place that does not hinder the passage of other vehicles and does not affect our own safety according to traffic conditions and traffic flow, and place safety protection equipment such as luminous or reflective warning signs, warning lights and cones in the direction of incoming vehicles;

(two) in case of a motor vehicle driver refuses to stop, it shall notify the front duty point to organize interception, and shall not stand in front of the car to intercept, and shall not climb the vehicle to force the motor vehicle driver to stop;

(3) If a violent criminal suspect, a hit-and-run driver, a wanted person of the public security organ and other dangerous personnel escape by car, which may pose a serious threat to public safety and the life safety of others, they may drive a motor vehicle to catch up and ask for support in time.
