Article 4 Illegal acts discovered by traffic police in law enforcement on duty shall be under the jurisdiction of the traffic administrative department of the public security organ where the illegal acts occurred.

If the jurisdiction is disputed, it shall be reported to the traffic administrative department of the public security organ at the next higher level for designation of jurisdiction. The traffic administrative department of the public security organ at the next higher level shall promptly determine the subject of jurisdiction and notify both parties to the dispute.

Article 5 Illegal acts recorded in traffic technical monitoring data may be under the jurisdiction of the traffic administrative department of the public security organ at the place where the illegal act occurred, was discovered or where the motor vehicle was registered.

If the violator or the owner or manager of the motor vehicle has any objection to the facts of the illegal act recorded in the traffic technical monitoring data, it shall submit it to the traffic administrative department of the public security organ where the illegal act occurred, and the traffic administrative department of the public security organ where the illegal act occurred shall handle it according to law.

Article 6 If the violator is given a warning, a fine or a motor vehicle driver's license is temporarily withheld, the traffic administrative department of the public security organ at or above the county level shall make a decision on punishment.

If a person is punished by revoking his motor vehicle driver's license, the traffic administrative department of the municipal public security organ with districts shall make a decision on punishment.

If a person is punished by administrative detention, the county or municipal public security bureau, public security sub-bureau or public security organ equivalent to the county level shall make a decision on punishment.
