Will the family be notified after administrative detention 10?

Generally speaking, family members will be informed of detention.

1. According to Article 150 of the Procedures for Handling Administrative Cases by Public Security Organs, if a public security organ imposes administrative detention punishment, it shall promptly notify the family members of the punished person of the punishment and the place of execution. If the punished person refuses to provide the contact information of his family or there are other circumstances that cannot be notified, the public security organ may not notify him, but it shall indicate it in the decision.

2. According to Article 64 of the Criminal Procedure Law of People's Republic of China (PRC):

When a public security organ detains a person, it must produce a detention permit. After detention, the family members of the detainee or their units shall be informed of the reasons and places of detention within 24 hours, except in cases where the investigation is hindered or notification cannot be made.

3. According to Article 7 1 of the Criminal Procedure Law of People's Republic of China (PRC), when arresting a person, the public security organ must produce an arrest warrant. After the arrest, the family members of the arrested person or his unit shall be informed of the reasons for the arrest and the place of detention within 24 hours, except in cases where the investigation is hindered or the notice cannot be given.

4. Article 108 of the Procedures for Handling Criminal Cases by Public Security Organs stipulates that after detention, a notice of detention shall be made within 24 hours and delivered to the family members or the unit where the detainee works. However, in any of the following circumstances, with the approval of the person in charge of the public security organ at or above the county level, the notice may not be sent:

(1) The suspect in the same case may escape, conceal, destroy or forge evidence;

(two) do not speak the real name and address, the identity is unknown;

(three) other obstacles to the investigation or unable to notify.

After the above situation is eliminated, the family members of the detained person or their units shall be notified immediately. If no notice is given within twenty-four hours, the reasons shall be indicated on the detention notice.
