Regulations of Guangzhou Municipality on the Classification and Management of Domestic Waste

Chapter I General Provisions Article 1 In order to strengthen the classified management of domestic waste in this Municipality, control pollution, protect the environment and save resources, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Waste, the Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Regulations shall apply to the classified delivery, collection, transportation, disposal, source reduction and related activities of domestic garbage in this Municipality.

Where laws and regulations have provisions on the management of waste electrical and electronic products, those provisions shall prevail.

Household decoration garbage, greening garbage, animal carcasses, feces, etc. shall be managed in accordance with laws, regulations and other relevant provisions of this Municipality. Article 3 Domestic garbage is divided into the following four categories:

(1) Recyclable materials refer to articles suitable for recycling and reuse.

(2) Kitchen waste refers to food waste such as discarded vegetables, melons and fruits, discarded edible oil, household kitchen waste and organic perishable waste.

(3) Hazardous wastes refer to substances that cause direct or potential harm to human health or the natural environment.

(4) Other garbage refers to domestic garbage other than the first three items.

Encourage areas and places with treatment conditions to classify domestic garbage more accurately on the basis of the provisions of the preceding paragraph. Article 4 Domestic garbage shall be classified for use, collection, transportation and disposal.

Domestic waste treatment should follow the principles of government-led, national participation, urban and rural planning and systematic promotion, and implement reduction, resource utilization and harmless management. Article 5 The municipal and district people's governments shall strengthen the work of source reduction and classification of domestic waste, establish a joint meeting system of domestic waste classification management, and coordinate and solve major problems in domestic waste classification management.

The municipal and district people's governments shall incorporate the source reduction and classified management of domestic garbage into the national economic and social development plan at the corresponding level, determine the target of source reduction and classified management of domestic garbage, make overall plans for the layout of facilities for classified delivery, collection, transportation and disposal of domestic garbage, give priority to land use and construction, and ensure the capital investment of source reduction and classified management of domestic garbage.

The Town People's Government and the sub-district offices are responsible for the daily management of domestic waste classification within their respective jurisdictions. Article 6 The municipal administrative department of urban management shall be in charge of the classified management of domestic waste in this Municipality, and organize the implementation of these Regulations. The district urban management administrative department is responsible for the classified management of domestic waste within its administrative area.

The competent administrative department of environmental protection shall be responsible for the monitoring of pollutant discharge in places such as centralized domestic garbage transfer facilities and terminal treatment facilities, as well as the supervision and management of pollution prevention and control in the process of storage, transportation and disposal of hazardous wastes.

The housing construction administrative department is responsible for urging the property service enterprises to carry out the classification of domestic waste, and incorporating the classification management of domestic waste into the credit management system of the property service enterprises.

The administrative department of commerce is responsible for the recycling management of recyclable materials.

The administrative departments of development and reform, education, finance, land planning, agriculture, forestry, gardens, culture, radio, film and television, press and publication, health, industry and commerce, quality and technical supervision, food and drug supervision, tourism, and the comprehensive law enforcement organs of urban management and supply and marketing cooperatives shall, in accordance with the division of responsibilities, do a good job in the related work of source reduction and classified management of domestic waste. Article 7 Villagers' committees and residents' committees shall publicize and guide the source reduction and classified delivery of domestic garbage, incorporate the source reduction and classified delivery of domestic garbage into village regulations and community residents' conventions, and cooperate with the town people's government and neighborhood offices to organize, mobilize and urge villagers and residents to carry out the source reduction and classified delivery of domestic garbage. Article 8 Trade unions, the Communist Youth League, women's federations, associations for science and technology and other organizations shall give full play to their respective advantages, organize publicity and mobilization for the reduction and classification of domestic waste sources, and promote the whole society to participate in the reduction and classification of domestic waste sources.

Encourage environmental protection organizations, volunteer organizations and other social welfare organizations to carry out publicity and mobilization activities for source reduction and classification of domestic waste, and promote the source reduction and classification of domestic waste.

Renewable resources, property management, sanitation, environmental protection, hotels, restaurants and other related industry associations. Self-discipline norms should be formulated for the industry, training, technical guidance and implementation evaluation should be carried out for the source reduction and classification of domestic waste in this industry, and member units should be guided and urged to participate in the source reduction and classification activities of domestic waste. Article 9 The administrative department in charge of urban management shall, relying on the facilities and places related to the treatment of domestic waste, establish a publicity and education base for the source reduction and classification of domestic waste and open it to the public free of charge, and publicize the knowledge and policies and measures of the source reduction and classification of domestic waste through the media.

The education administrative department shall incorporate the knowledge of source reduction, classified delivery, recycling and harmless treatment of domestic waste into the education and teaching content, and cultivate and improve the awareness of source reduction and classification of domestic waste for students and preschool children.

Tourism administrative departments should strengthen the publicity and education on the source reduction and classification of domestic waste for travel agencies, tour guides and other units and individuals engaged in tourism. Units and individuals engaged in tourism shall urge tourists to abide by the provisions on the classified management of domestic waste in this Municipality, and persuade tourists who do not put domestic waste in accordance with the provisions.

The administrative department of service management of the staff stationed in Guangzhou shall strengthen the publicity and education on the classification of domestic waste of the staff stationed in Guangzhou, and guide and urge the staff stationed in Guangzhou to abide by the provisions of this Municipality on the classification and management of domestic waste.

Radio stations, television stations, newspapers, periodicals, internet and other media should strengthen the publicity on the source reduction and classification of domestic waste, popularize relevant knowledge, and enhance the public's awareness of the source reduction and classification of domestic waste.
