Regulations on the Prevention and Control of Air Pollution in Hebei Province (202 1 Revision)

Chapter I General Provisions Article 1 In order to protect and improve the environment, prevent and control air pollution, safeguard public health, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the prevention and control of air pollution within the administrative area of this province. Article 3 The prevention and control of air pollution should aim at improving the quality of the atmospheric environment and follow the principles of source control, planning first, highlighting key points, combining prevention and control, government leading and public participation. Fourth people's governments at all levels are responsible for the quality of the atmospheric environment within their respective administrative areas.

People's governments at or above the county level shall incorporate the prevention and control of air pollution into the national economic and social development plan, rationally plan the urban layout and industrial development layout, optimize the industrial structure and energy structure, strengthen ecological construction, and improve the quality of the atmospheric environment. Article 5 The competent department of environmental protection of the people's governments at or above the county level shall exercise unified supervision and management over the prevention and control of air pollution within their respective administrative areas. Other relevant departments of the people's governments at or above the county level shall, within the scope of their respective duties, supervise and manage the prevention and control of air pollution:

(1) The departments of development and reform, industry and informatization of the people's government at or above the county level are responsible for controlling the total coal consumption, optimizing the industrial and energy structure and layout adjustment, organizing and promoting the implementation of technological transformation and upgrading of industrial enterprises, eliminating backward production capacity, increasing the utilization of clean energy, developing circular economy, and formulating and improving relevant policies such as atmospheric environmental protection;

(2) The departments of public security, transportation and commerce of the people's governments at or above the county level shall supervise and manage the management of motor vehicles and off-road mobile machinery and oil and gas recovery;

(3) The competent departments of housing and urban and rural construction, land and resources, transportation, urban management, industry and information technology of the people's governments at or above the county level shall supervise and manage the construction dust, mine dust, road dust and enterprise material storage yard;

(four) the people's governments at or above the county level urban management, public security, industry and commerce, food supervision, agriculture and other departments to supervise and manage catering services, open-air barbecue, raw coal burning, straw burning, etc.;

(five) the departments of agriculture, forestry and animal husbandry of the people's governments at or above the county level shall supervise and manage the air pollution caused by agricultural production and animal husbandry;

(6) The transportation, fishery departments and maritime agencies of the people's governments at or above the county level shall supervise and manage the discharge of atmospheric pollutants by ships.

Township (town) people's governments and sub-district offices shall, under the guidance of county (city, district) people's governments, organize the prevention and control of air pollution according to the actual situation in the region. Article 6 Enterprises, institutions and other producers and operators shall abide by the provisions of laws and regulations, improve the environmental protection management system, implement the post responsibility system, truthfully disclose environmental information to the public, and consciously accept the supervision and management of the competent department of environmental protection and other departments responsible for the supervision and management of atmospheric environmental protection. Strengthen the management of cleaner production, take effective measures to prevent and reduce air pollution, and bear the responsibility for the damage caused according to law.

Citizens should enhance their awareness of atmospheric environmental protection, adopt a low-carbon, frugal and green lifestyle, and consciously fulfill their responsibilities for atmospheric environmental protection. Seventh this province implements the target responsibility system and assessment system for atmospheric environmental quality. The provincial people's government shall formulate assessment and reward and punishment measures, and assess the completion of the atmospheric environmental quality improvement targets and key tasks of air pollution prevention and control in cities and counties (cities, districts) with districts. The evaluation results should be made public. Article 8 People's governments at or above the county level shall increase financial investment in the prevention and control of air pollution, strengthen supervision and management of funds for the prevention and control of air pollution, and improve the efficiency in the use of funds.

People's governments at all levels shall provide support and assistance to enterprises, institutions and other producers and operators in technological transformation and energy substitution.

Encourage and support social capital to participate in air pollution prevention and control, and guide financial institutions to increase credit support for air pollution prevention and control projects. Article 9 The people's governments of provinces and cities divided into districts shall encourage and support scientific and technological research on the prevention and control of air pollution, carry out analysis of air pollution sources and their changing trends, compile an air pollutant discharge list, popularize and apply advanced prevention and control technologies, and give full play to the supporting role of science and technology in the prevention and control of air pollution.

The relevant departments of the people's governments at or above the county level shall provide guidance and services to enterprises, institutions and other producers and operators, enhance their awareness of atmospheric environmental protection, and take effective measures to prevent and reduce atmospheric pollution. Article 10 People's governments at all levels shall reward units and individuals that have made outstanding achievements in preventing and controlling air pollution and protecting and improving the atmospheric environment.

Organs, social organizations, schools, news media and grass-roots mass autonomous organizations should strengthen publicity and education on atmospheric environmental protection, popularize laws, regulations and scientific knowledge on the prevention and control of atmospheric pollution, raise public awareness of atmospheric environmental protection, and promote public participation in atmospheric environmental protection. Chapter II Plans and Standards for the Prevention and Control of Air Pollution Article 11 The municipal people's government divided into districts that fail to meet the national standards for the prevention and control of air pollution shall, according to the national and provincial air pollution prevention and control objectives and the requirements of regional air environmental quality, formulate a plan for reaching the standards within a time limit and an annual implementation plan for air pollution prevention and control, and adopt strict air pollution control measures to reach the prescribed air environmental quality standards on schedule.

The municipal people's government with districts that meet the national standards for atmospheric environmental quality shall, according to the requirements of the state and this province, formulate measures to continuously improve the atmospheric environmental quality.

The atmospheric environmental quality compliance plan and the annual implementation plan for air pollution prevention and control, as well as the implementation effect, shall be made public and evaluated and revised in time.
