Measures of Shandong Province for the Administration of Civil Air Defense Works

Article 1 In order to strengthen the management of civil air defense projects, improve the combat readiness benefits, social benefits and economic benefits of civil air defense projects, and protect the safety of people's lives and property, these measures are formulated in accordance with the Civil Air Defense Law of People's Republic of China (PRC) and the Regulations on Quality Management of Construction Projects of the State Council, combined with the actual situation of this province. Article 2 These Measures shall apply to the planning, construction, maintenance, use and related management activities of civil air defense projects within the administrative area of this province. Article 3 Civil air defense projects as mentioned in these Measures include civil air defense projects and air defense basements.

The term "single-building civil air defense project" as mentioned in these Measures refers to the underground protective building built separately to ensure wartime personnel and materials, civil air defense command and medical rescue.

The term "air defense basement" as mentioned in these Measures refers to the basement that can be used for air defense in wartime. Article 4 People's governments at or above the county level shall strengthen their leadership over the management of civil air defense projects, coordinate and solve major problems in the management of civil air defense projects, and include the funds needed for the management of civil air defense projects in the financial budget. Article 5 The departments in charge of civil air defense work of the people's governments at or above the county level (hereinafter referred to as the competent departments for civil air defense) are in charge of the management of civil air defense projects within their respective administrative areas.

Development and reform, finance, housing and urban construction, natural resources, emergency management, comprehensive administrative law enforcement and other departments, in accordance with the division of responsibilities to do a good job in the management of civil air defense projects. Article 6 The construction of civil air defense projects belongs to the construction of national defense projects and social welfare undertakings.

Encourage enterprises, institutions, social organizations and individuals to invest in the construction of civil air defense projects. The construction, development and utilization of civil air defense projects shall enjoy preferential policies such as tax reduction and exemption in accordance with the relevant provisions of the state and the province. Article 7 The competent departments for civil air defense of the people's governments at or above the county level shall, jointly with natural resources and other relevant departments, formulate plans for the construction of civil air defense projects in their respective administrative areas, which shall be incorporated into the national spatial planning after being approved by the people's governments at the corresponding levels.

The natural resources department of the people's government at or above the county level shall, jointly with the competent department of civil air defense, implement the construction plan of civil air defense projects in the detailed urban planning. Article 8 Before a single civil air defense project starts, the construction unit shall apply for a commencement report in accordance with the relevant provisions of the state and the province. Article 9 The competent civil air defense department of the people's government at or above the county level shall, in accordance with the relevant provisions of the state and the province, jointly with the relevant departments, implement synchronous and parallel examination and approval of civil construction projects corresponding to the construction of air defense basements, and complete them within a time limit.

The civil buildings mentioned in the preceding paragraph refer to houses, office buildings of state organs and other public buildings such as commerce, service industry, education and health. Tenth new civil buildings in urban planning areas, the construction unit shall build air defense basement in accordance with the following standards:

(a) the national first-class civil air defense key cities shall be built in accordance with the standard of not less than 9% of the total floor area of the approved construction project planning;

(two) the national second-class civil air defense key cities should be built in accordance with the standard of not less than 8% of the total floor area of the approved construction project planning;

(three) the national third-class civil air defense key cities and cities without districts shall be built in accordance with the standard of not less than 7% of the total area of ground buildings approved by the planning of engineering construction projects;

(four) the county according to the standard of not less than 6% of the total area of ground buildings approved by the planning.

The protection category, resistance grade and wartime use of the air defense basement of new civil buildings shall be determined by the competent civil air defense department in accordance with relevant regulations. Eleventh when building an air defense basement, the construction unit shall, in accordance with the provisions, support the construction of medical rescue projects, nuclear and biochemical monitoring projects and air defense professional team projects.

If the construction unit builds a medical rescue project or a nuclear and biochemical monitoring project, it shall be multiplied by 2 according to the construction area of the project and included in the construction area of the air defense basement to be built in the project; For the construction of civil air defense professional team project, the construction area of the project shall be multiplied by 1.5, and included in the construction area of the civil air defense basement to be built in the project. Twelfth new civil buildings in the urban planning area are not suitable for building air defense basements due to geological and topographic reasons. With the approval of the competent department of civil air defense, the construction unit shall not build an air defense basement, but shall pay the construction fee for the air defense basement in accordance with the regulations.

In addition to the relief projects stipulated by the state, no unit or individual may arbitrarily approve the relief of ex situ construction fees. Thirteenth urban underground space development and utilization should take into account the needs of civil air defense. The construction of underground trunk lines and comprehensive transportation hubs such as urban subways and tunnels shall conform to the standards for civil air defense protection.

In addition to individual civil air defense projects, underground municipal projects and common ditches, other independently developed underground space projects shall be built according to the standard of not less than 20% of the total underground construction area. Fourteenth districts of the city and county (city, district) civil air defense departments should strengthen the supervision and management of the quality and safety of individual civil air defense projects within their respective administrative areas and the supervision and management of the quality of air defense basement protection projects. Fifteenth competent departments for civil air defense may entrust engineering technical services and auxiliary matters to enterprises, units and other social organizations with corresponding conditions by purchasing services.
