Measures for the Administration of Film Distribution and Projection in Hebei Province

Article 1 In order to regulate the film market behavior, strengthen the management of film distribution and projection, develop and prosper the film industry, and promote the construction of socialist spiritual civilization, these Measures are formulated in accordance with the Regulations of the State Council on the Administration of Films and the actual situation of this province. Second within the administrative region of this province, the distribution, projection and management of films must abide by these measures. Article 3 The administrative departments of film distribution and projection at or above the county level shall be responsible for the management of film distribution and projection within their respective administrative areas. Article 4 Anyone who engages in film distribution and projection shall go through the examination and approval procedures at the local administrative department of film distribution and projection in accordance with the regulations, and go through the relevant procedures at the relevant departments with the "Distribution and Projection Business License" issued by the administrative department of film distribution and projection. Article 5 To establish a film distribution and projection business unit, the following conditions shall be met:

(a) qualified professional and technical personnel and management personnel;

(2) Having corresponding funds and equipment;

(3) Having a place for distribution and projection that meets the requirements of national security and fire control;

(4) There are legal channels for film feeding and film supply;

(5) Having a sound management system. Article 6 An application for a business license for film distribution and projection shall be submitted for approval in accordance with the following provisions:

(a) engaged in film distribution and ball curtain, curtain curtain form and 70 mm film screening, by the districts of the city film distribution and screening administrative departments for examination and approval, submitted to the provincial film distribution and screening administrative departments;

Article 9 Where a film distribution and projection business unit stops its distribution and projection business, it shall go through the cancellation procedures of distribution and projection at the original approval authority within 30 days from the date of change.

If the issuance and screening activities are stopped for more than one year, the issuance and screening business license will automatically expire.

If it is necessary to reopen the business, it shall go through the examination and approval procedures for film distribution and projection again. Article 10 The business license for film distribution and projection shall be valid for five years. If it continues to be issued or displayed after the expiration, it shall go through the replacement procedures. Eleventh engaged in film distribution and projection business, should pay the national film industry development fund according to the provisions of the state. The special funds for the development of the national film industry must be earmarked in accordance with the principles and scope of use stipulated by the state. Twelfth at or above the county level administrative departments of film distribution and projection shall, in accordance with the following requirements, conduct an annual inspection of the film distribution and projection business units within their respective jurisdictions. Distribution and projection business units shall go through the annual inspection procedures at the issuing authority within the specified time:

(1) Abide by the laws, regulations and rules concerning the distribution and projection of films;

(2) Issuing and showing films according to the authority prescribed by the state;

(3) A film to be released or shown shall have a film distribution license issued by the state film administration department;

(four) the number and number of domestic films and their key films released and screened shall not be less than the number and number of times stipulated by the state;

(five) to pay special funds for the development of national film industry in accordance with the regulations;

(six) statistics of film distribution and projection data as required. Article 13 Film copyright is protected by state laws. Without the permission of the film copyright owner, you may not use any carrier to copy or play movies made or produced by others.

Don't sell or rent illegally recorded movie videos. Fourteenth provinces that distribute movies in this province shall hold a film distribution license and a film distribution license, and register with the local administrative department of film distribution and projection. Fifteenth units that buy movies shall submit copies of purchase and sale contracts and invoices to the provincial film distribution and projection administrative departments for the record five days before the film is released. Article 16 Whoever, in violation of the provisions of Article 4 of these Measures, engages in the business activities of film distribution and projection without approval shall be ordered by the administrative department of film distribution and projection at or above the county level to stop the illegal act, confiscate the illegal articles and illegal income, and impose a fine of more than 5 times 10 times the illegal income. Article 17 Whoever, in violation of the provisions of the third paragraph of Article 12 and Article 14 of these Measures, issues or shows a film without obtaining a film distribution license or a film distribution license, shall be ordered by the administrative department in charge of film distribution and showing at or above the county level to stop the illegal act, confiscate the illegal articles and illegal income, and impose a fine of more than 10 and less than 15 times the illegal income; If the circumstances are serious, the original issuing authority shall order it to suspend business for rectification or revoke its license. If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law. Eighteenth any of the following acts shall be dealt with by the administrative department of film distribution and projection at or above the county level in accordance with the relevant provisions of the state:

(1) Failing to pay the special funds for the development of the national film industry as required;

(two) the distribution and screening of domestic films and their key films can not reach the number and number of times stipulated by the state;

(3) Failing to report the statistical data of film distribution and projection as required.
