On August 16, the Beijing Municipal Commission of Housing and Urban-Rural Development officially issued the Notice on Further Regulating the Sales Behavior of Newly-built Commercial Housing.

The improved and revised Notice still maintains the structure of 15, including: standardizing the setting of delivery model houses, standardizing the sales promotion of new commercial houses, implementing the house quality acceptance system before delivery, compacting the main responsibility of development enterprises, and others.

"Notice" clearly, existing home sales should be fully displayed to buyers. Require enterprises to strengthen sales management. For hot-selling projects (more than 3 customers/households), under the guidance of the district housing and construction department, the notary lottery is given priority to families without houses, families in territories and families of employees in neighboring enterprises and institutions.

According to the "Notice", it is particularly clear about the setting of delivery model rooms: First, if the model rooms built within the project scope cannot be retained due to the need of completion acceptance, the layout content should be notarized by a third party. Second, before the delivery model room is set up, the enterprise shall not set up the display (publicity) model room, and the delivery model room, process model room and display (publicity) model room shall be set up in the same place. Display (publicity) model houses should be marked in a prominent position, and interior decoration is only used for display.

The notice put forward the requirements of "three consistences" for the model rooms and "four prohibitions" for the sales staff.

Specifically, the "Notice" stipulates that enterprises should list the main materials and equipment in the pre-sale plan according to the decoration standards agreed in the transfer contract; If a model room is set in the pre-sale of commercial housing, it shall be delivered to the model room according to the planning drawings and the pre-sale plan that defines the apartment type, area, standard and process setting, and the area of the process model room shall be arranged for the delivery of the model room. "Three consistences" means that the decoration standards of model houses should be consistent with the contents listed in the pre-sale plan, with the delivery standards agreed in the purchase contract, and with the actual delivery of the project, and no other decoration and facilities beyond the delivery standards should be added. At the same time, it is required that the sample room be kept until three months after the project delivery.

In the specification of sales promotion, it is stipulated that when making all kinds of sales promotion materials, the content displayed within the project scope should be consistent with the planning permission content and the status quo outside the project; The unfavorable factors of the project should be publicized in a prominent position at the sales site. Strict sales organization, personnel and behavior management. Before the sale of the project, the development enterprise should train the sales staff, including the basic situation of the project, the contents of unfavorable factors, sales policies and regulations, and standardized promotion terms.

In the process of sales, salespeople should wear badges, and online sales should have their real names. At the same time, the "four prohibitions" of sales staff are put forward, that is, it is strictly forbidden to make false and untrue propaganda, to mislead customers to dispose of public parts, to publicize public service facilities that have not been built around them, and to promote sales in a tense atmosphere.

In terms of house quality inspection before delivery, enterprises are required to hold at least two "on-site open days" before completion and acceptance under the premise of ensuring safety, and organize buyers to enter the project site to understand the project site situation. Encourage real-time display of construction progress to buyers through online video.

The key point is to implement the quality inspection system before housing delivery. In addition to the provisions of the Notice of Beijing Municipal Construction Committee on Implementing the Quality Inspection of New Houses before Delivery, buyers should also be organized to inspect the decoration quality standards listed in the pre-sale plan.

In response to the opinions and suggestions put forward by buyers on the "on-site open day", the official "Notice" clearly stated that development enterprises should promptly explain that those with quality defects should be repaired and rectified in time and fed back to buyers.

In terms of compacting the main responsibility of enterprises, the "Notice" clarifies that existing homes should be fully displayed to buyers for the actual delivery of houses. Require enterprises to strengthen sales management. It is stipulated that when signing the contract, the enterprise should show the model house to the purchaser, introducing the materials, technology, size and other contents; At the same time, inform the unfavorable factors of the project and confirm them in writing by the purchaser; It is required that the publicity materials of the project should be written and the video materials should be kept for future reference; It is clear that the enterprise takes overall responsibility for the overall quality and after-sales service of commercial housing, and should issue a "residential quality guarantee" and a "residential use manual" to the purchaser in line with the contract.

In addition, the Beijing Municipal Commission of Housing and Urban-Rural Development requires the competent department of district housing and urban-rural construction to conduct on-site verification of the setting of model houses before the development enterprises apply for pre-sale permits. In violation of the provisions of the Notice, the enterprise shall be ordered to make rectification within a time limit, and the violations shall be scored and incorporated into the credit system management.

For some time, development enterprises have over-decorated model houses and over-beautified the display of real estate, which has led to problems and opinions such as "the goods are not in the right version" and "the distribution of goods is seriously reduced". The Beijing Municipal Commission of Housing and Urban-Rural Development had previously studied and drafted the Notice on Further Regulating the Sales Behavior of Newly-built Commercial Housing, and publicly solicited opinions from July 9, 2026 1 to June 16. During the consultation period, a total of 79 feedback opinions were received from all walks of life, including suggestions 108, which mainly focused on expanding the scope of application of the Notice, establishing a platform for government intentions, canceling the unfinished building without model rooms, and increasing unfavorable factors.
