Can I go to court if the summons is not served?

Legal analysis: the people's court will not hold a session until a court summons is received. For civil disputes between the two parties, a civil lawsuit can be brought to the people's court. If the plaintiff brings a lawsuit to the people's court, the people's court needs to serve a summons on the defendant, and then it needs to hold a court session according to law and make a judgment. Article 136 When trying a civil case, the people's court shall notify the parties and other participants in the proceedings three days before the court session. If the hearing is held in public, the names of the parties, the cause of action, the time and place of the hearing shall be announced.

Article 159 When trying a simple civil case, the basic people's court and the court dispatched by it may summon the parties and witnesses, serve litigation documents and try the case in a summary way, but the rights of the parties to state their opinions shall be guaranteed.
