Regulations of Zhengzhou Municipality on Letters and Visits (revised in 2004)

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the provisions of the Constitution of People's Republic of China (PRC) and relevant laws and regulations, and in light of the actual situation of this Municipality, in order to protect the lawful rights and interests of the petitioners and maintain the normal order of the petition activities. Article 2 The term "letters and visits" as mentioned in these Regulations refers to the activities of letters and visits by petitioners (citizens, legal persons and other organizations) to reflect the situation and put forward requirements to state organs and state functionaries, and the relevant state organs or units are responsible for handling them. Article 3 Letters and visits from the masses are an important way for state organs to listen to the opinions and suggestions of the masses and accept supervision. State organs and their staff at all levels in this Municipality shall conscientiously perform their duties, handle affairs impartially, and solve the difficulties and problems reflected by the masses in a timely manner. Letters and visits from the people should be seriously accepted, warmly received and handled in a timely manner. Article 4 Petitioners' petition activities in accordance with the law are a way for people to exercise their democratic rights and participate in the management of state affairs and social affairs. They are protected by law, and no organization or individual may suppress or take revenge.

Petitioners shall abide by the provisions of the Constitution, laws, regulations and rules in their petition activities, and shall not harm the interests of the state, society and collectives or the legitimate rights and interests of other citizens. Article 5 In handling letters and visits, we should adhere to the principles of handling affairs according to law, seeking truth from facts, taking responsibility at different levels and handling them under centralized management, combine solving problems on the spot with ideological education to solve practical problems, and implement the responsibility system of who is in charge and who is responsible. Article 6 State organs at all levels in this Municipality shall strengthen their leadership in the work of letters and visits, and establish and adhere to the letters and visits system such as the reception day of the person in charge and the reading and approval of letters from the masses. The main person in charge and the person in charge of the petition work shall inspect and guide the petition work of this organ and deal with important petition issues, and other responsible persons shall be responsible for handling the petition issues in charge of the work.

For major letters and visits, the person in charge of the organ shall conduct in-depth investigation and study to solve the problem in time. Chapter II Rights and Obligations of Petitioners Article 7 Petitioners shall enjoy the following rights:

(a) to reflect the situation and problems to the state organs and their staff, and put forward suggestions, criticisms and opinions;

(two) to lodge a complaint, accusation or report on the illegal and dereliction of duty of state organs and state functionaries;

(three) when the legitimate rights and interests of himself or others and the interests of the state or the collective are infringed, he shall lodge a complaint, accusation or report to the relevant state organs;

(four) in accordance with the prescribed procedures to the relevant state organs to inquire about the handling of letters and visits, and ask for a reply to the complainant. Article 8 A petitioner shall perform the following obligations in his petition activities:

(1) Abiding by the Constitution, laws, regulations, rules and policies;

(two) truthfully reflect the situation, and shall not fabricate, distort the facts or frame others;

(three) abide by the order of letters and visits and social morality;

(four) to accept the decision in accordance with the provisions of laws, regulations, rules and policies. Article 9 When a complainant reflects a problem, he shall first raise it with the unit where he is responsible.

To reflect the problem by letter, you should sign your real name, indicate the mailing address and postal code. The complaint, accusation and complaint shall specify the name, unit, address and basic facts of the person being reflected.

Visit to reflect the problem, should go to the reception place set up by the state organs, to reflect the petition staff. Chapter III Letters and Visits Working Institutions and Their Duties Article 10 State organs of cities and counties (cities, districts) and township (town) people's governments shall set up letters and visits working institutions in accordance with relevant regulations, or be equipped with full-time and part-time letters and visits staff. Article 11 The petition offices of state organs in this Municipality handle petitions on behalf of their own organs, and their main responsibilities are:

(1) Receiving and accepting letters and visits from petitioners;

(two) to publicize the laws, regulations, rules and related policies to the complainant;

(three) to investigate and handle major cases of letters and visits, and coordinate the relevant organs or units to handle cases of letters and visits;

(four) to undertake the petition cases transferred and assigned by the higher authorities, and report the results on time;

(five) to the relevant organs or units to do, assigned by the petition cases, and is responsible for checking the handling of the situation, and supervise the implementation of the results;

(six) to coordinate and solve the problem of letters and visits between regions and departments;

(seven) regularly study the situation of letters and visits, timely reflect the demands, opinions and suggestions of the masses to the organs and relevant departments, and put forward opinions on handling them;

(eight) to inspect and guide the letters and visits of lower-level organs or units. Twelfth petition staff can handle emergencies in the petition work. Thirteenth letters and visits staff should act in accordance with laws, regulations, rules and policies, be loyal to their duties, be honest and fair, and do a good job in letters and visits seriously and responsibly. Fourteenth letters and visits staff to perform official duties according to law are protected by law, and their personal freedom and safety are violated, the local public security organ shall promptly deal with it according to law. Fifteenth petition staff and the parties to the petition case have kinship or other interests, should be avoided. Chapter IV Scope of Acceptance Article 16 The municipal and county (city, district) people's congresses and their standing committees, the township (town) people's congresses and their presidium shall accept the following letters and visits:

(a) suggestions, criticisms and opinions on the people's congresses at the corresponding levels and their standing committees and staff;

(two) opinions, suggestions and complaints about the state administrative organs, judicial organs and procuratorial organs at the same level to abide by the implementation of the Constitution, laws and regulations;

(three) opinions and suggestions on the local regulations promulgated by the people's congress at the corresponding level and its Standing Committee and the resolutions and decisions made;

(four) reflect and report inappropriate decisions, orders and other normative documents of the people's government at the corresponding level, and reflect and report inappropriate normative documents of judicial organs and procuratorial organs at the corresponding level;

(five) suggestions, criticisms and opinions on the deputies to the people's congresses at the corresponding levels and the staff of state organs elected and appointed by the people's congresses at the corresponding levels and their standing committees, as well as the reports and accusations against the above-mentioned personnel for their illegal and dereliction of duty;

(six) opinions and suggestions on the resolutions and decisions made by the people's congress at the next lower level and its Standing Committee;

(seven) other matters within the scope of functions and powers of the people's Congress and its Standing Committee.
