Illegal fund-raising seriously damages people's property rights and interests, endangers market economic order and affects social stability. In order to severely crack down on illegal fund-raising activities, effectively protect the legitimate rights and interests of the broad masses of the people, and maintain a good financial order in our city, the relevant matters on preventing and cracking down on illegal fund-raising are hereby notified as follows:

1. Illegal fund-raising refers to the behavior that legal persons, other organizations or individuals illegally or in disguised form absorb funds from unspecified social objects through the media, promotion meetings, leaflets, mobile phone short messages, the Internet and other means in violation of national financial management laws and regulations.

2. Illegal fund-raising is prohibited by the state, and people's courts, procuratorial organs and public security organs will severely crack down and punish it. For illegal fund-raising as stipulated in Article 176 of the Criminal Law of People's Republic of China (PRC), criminal responsibility will be investigated for the crime of illegally absorbing public deposits; For illegal fund-raising stipulated in Article 192 of the Criminal Law of People's Republic of China (PRC), criminal responsibility will be investigated for the crime of fund-raising fraud. Providing assistance to the public knowing that it is illegal to absorb public funds, and collecting agency fees, benefits fees, kickbacks, commissions, royalties and other expenses from it constitutes illegal fund-raising, which is a crime, and criminal responsibility shall be investigated according to law.

Third, any investment has risks, and high returns are often accompanied by high risks. According to Chinese laws, illegal fund-raising is not protected by law, and participation in illegal fund-raising is at your own risk. At present, only various banking institutions approved by China Banking and Insurance Regulatory Commission can absorb public deposits. The general public should enhance their awareness of self-protection, invest rationally, improve their ability to identify illegal fund-raising, keep a clear head, refuse the temptation of high interest rates, stay away from illegal fund-raising and avoid personal property losses.

4. If the general public finds that it is suspected of illegal fund-raising by absorbing funds from the public without the approval of the financial supervision department or borrowing legal business forms, please collect and save the advertising materials, audio and video recordings of the promotion meeting, contract agreements, transfer vouchers and other evidence in time, and take the initiative to report to the local public security department.
