Is the lawsuit notification SMS valid?

Under normal circumstances, the trial will not be notified by SMS. The court may notify the parties concerned by means of short message, telephone or fax in cases that are tried by summary procedure.

Legal documents issued by the people's court to the parties, including subpoenas, notices, rulings and judgments, shall be served in writing, unless I agree to serve them in other ways. If no one can be found, it should also be served by announcement (newspaper, court announcement), otherwise it will have no legal effect.

The so-called SMS or QQ information may be fraudulent information, and the caller should check the real court phone number first, and then call to verify.

The court won't call you, send you a text message, only send you a subpoena.

Court notices are handled by notice, and no text messages will be sent. A litigation document that informs the people's court to serve on the people's procuratorate and other litigants other than the parties within a certain time before the court session, and requests to appear in court on time. Don't be deceived when you receive a text message.

Whether it is the plaintiff or the defendant, after the case is accepted and filed, the court will serve you with a written summons with detailed information such as the cause of action, the time and place of the trial. If you are informed of the hearing by other means, you can inform your court to ask. If it is true, you need a subpoena. Whether the notice of litigation is true or false must be based on the court summons.

Legal basis: Article 144 of the Civil Procedure Law of People's Republic of China (PRC). If the defendant refuses to appear in court without justifiable reasons after being summoned by a summons, or withdraws from court halfway without the permission of the court, he may make a judgment by default.

Before the verdict is pronounced in Article 145 of the Civil Procedure Law of People's Republic of China (PRC), if the plaintiff applies for withdrawing the lawsuit, the people's court shall decide whether to grant it or not.
