article 2 basic requirements that an applicant should meet. the applicant should be the party and government organs, institutions, social organizations, private non-enterprise units, partnership enterprises (accounting firms, law firms, etc.) registered within the administrative area of this municipality, and all kinds of enterprises (non-enterprises) that conform to the industrial development direction of this municipality, have a registered capital of RMB 1 million or more, have a good reputation, and operate normally in this municipality, pay taxes according to law, and participate in social insurance according to regulations.

Article 3 Basic requirements for returned overseas students (1) The academic degree obtained by returned overseas students shall meet one of the following conditions: 1. To obtain a doctoral degree in an overseas university, the cumulative study time abroad shall generally be no less than one year; If you are a graduate of Chinese-foreign cooperative education or joint training, the cumulative study time abroad is generally not less than half a year. 2. Obtain full-time undergraduate, bachelor's or above degrees in domestic "double-first-class" construction universities (directly under the central government and graduate training units of Chinese Academy of Sciences refer to "double-first-class" construction universities) and obtain master's degrees in overseas universities; Or get a full-time undergraduate degree, bachelor's degree or above in a non-"double-class" construction university in China, and get a master's degree in a high-level university abroad; Or study in a foreign university to get a bachelor's degree and a master's degree. 3. Get a bachelor's degree in a high-level university abroad. 4. After obtaining a master's degree or above in China, or obtaining the qualification of deputy senior and above professional and technical positions, he went to universities or scientific research institutions abroad to study and be a visiting scholar for one year. 5. Others who do not meet the requirements of items 2 and 3, but have obtained a bachelor's degree or a master's degree in a university outside the country (territory). The bachelor's degree abroad mentioned in items 2 and 3 of this paragraph does not include the starting undergraduate degree of domestic junior college, the relevant national higher education diploma (HND), the cooperative education and credit transfer of unplanned enrollment in China, and the accumulated study time abroad at the undergraduate stage is generally not less than 2 years; The accumulated study time at the master's stage is generally not less than half a year (excluding the forms of cooperative education and credit transfer for unplanned enrollment in China); If you are a graduate of Sino-foreign cooperative education or joint training, you should obtain both a domestic academic degree and a foreign degree. If the bachelor's degree abroad mentioned in Item 5 of this paragraph is the highest degree, it does not include the starting undergraduate degree of domestic junior college, the relevant national higher education diploma (HND), the cooperative education and credit transfer of unplanned enrollment in China, and the cumulative study time abroad at the undergraduate stage is generally not less than 2 years. If the highest degree is a master's degree, the bachelor's degree abroad is not subject to the above restrictions, and the accumulated study time abroad at the master's stage is generally not less than half a year (excluding the forms of cooperative education and credit transfer for unplanned enrollment in China). After being admitted to a foreign university, if you have studied in a domestic campus or branch school, the accumulated study time abroad and the credits obtained are generally not less than 5% of the total study time and total credits; After being admitted to a foreign university, if you use the summer vacation to get credits through non-academic education in China, the accumulated credits obtained abroad are generally not less than 8% of the total credits. The list of "double-first-class" universities in China is subject to the list published by the state. High-level universities abroad refer to Times HigherEducation, American News and World Report (News &: World Report), QS World University Rankings, and academic ranking of world universities's Academic Ranking of World Universities, the list of the top 5 universities in the world shall be subject to the confirmation of Shanghai Human Resources and Social Security Bureau. The name of the institution that issued the degree certificate stated in the certificate of foreign academic degree issued by the Ministry of Education shall prevail. 1. Overseas students should come to this city and continue to work in this city within 2 years after returning to China, sign labor or employment contracts with relevant employers in this city according to law, and pay social insurance premiums and personal income tax in this city according to regulations (except those meeting the conditions in the first paragraph of Article 4 below). 2. Persons who meet the first four conditions in the first paragraph of this article have paid social insurance contributions in the same unit for the last six consecutive months, which is not less than the average salary of employees in urban units in this city in the previous year, and the personal income tax payment is reasonably corresponding to the social insurance contribution base; Those who meet the conditions in Item 5, Paragraph 1 of this article have paid social insurance contributions in the same unit for the last 12 consecutive months, which is not less than the average salary of employees in urban units in this city in the previous year, and the personal income tax payment is reasonably corresponding to the social insurance contribution base. Returned overseas students should be talents who are in urgent need and play an important role in the unit and need to be used for a long time, and sign labor or employment contracts with the unit according to law. The contract is valid for 2 years or more, and it is valid for 3 months or more from the date of online acceptance (if there is a probation period stipulated in the contract, it is necessary to complete the probation period before reporting); In principle, the dispatched personnel do not belong to the bidding scope. 4. The age is more than 5 years from the statutory retirement age. 5 in line with the current national and municipal family planning policies. 6. There is no criminal record, and it is not appropriate to apply for a permanent residence in Shanghai.

(3) Persons in charge and core members of the team who have patents, scientific research achievements and proprietary technologies to set up overseas students' enterprises in this city (generally no more than 3 persons in total), the enterprise operates normally, employs at least one employee (excluding the person in charge of the enterprise), and can apply for settlement after paying social insurance premiums in accordance with regulations for 6 months. The registered capital of the enterprise is not less than 5, yuan (paid-in), and the person in charge of the enterprise for overseas students is the largest shareholder (excluding share transfer and later capital injection), and the individual shares are generally not less than 3%.

Article 5 Applicants who have returned from studying abroad to apply for permanent residence in Shanghai must apply by their units.

article 6 materials to be submitted (1) basic materials to be submitted by the unit 1. legal person business license or legal person registration certificate. If the applicant is an unincorporated branch, the business license or registration certificate of the branch and the power of attorney of the superior legal person shall be provided. 2. (2) In case of any of the following circumstances, the unit needs to submit the following supplementary materials to the returned overseas students and the core members of the team who set up overseas students' enterprises in this city, and the unit needs to submit another: 1. Enterprise capital verification report. 2. The enterprise has paid value-added tax (business tax) or enterprise income tax bill for 6 consecutive months recently. 3. The enterprise has paid the social insurance premium certificate for at least one employee for 6 consecutive months recently. 4. Articles of Association and relevant resolutions. Among them, the fourth material only needs to be provided when the core members of the team declare. (3) Basic materials to be submitted by individuals 1. Certificate of foreign academic degrees, degree certificates and transcripts issued by the Ministry of Education. The corresponding highest academic degree certificate obtained in China before studying abroad. If you are an on-the-job employee before going abroad, provide the materials that the original work unit agreed to transfer or have left. 3. Passport, visa and all entry and exit records. 4. Residence booklet and ID card. If the household registration has been cancelled during the study abroad, provide valid household registration cancellation materials within 9 days. 5. In line with the fourth incentive conditions, it is necessary to supplement and submit corresponding materials. (4) If an individual has any of the following circumstances, he/she needs to submit the following supplementary materials: 1. If he/she has settled in a non-community public household, he/she shall provide the address materials for his/her settlement in Shanghai. If I settle in my house in Shanghai, I will provide a valid certificate of house; For those who have settled in the houses of their immediate family members in Shanghai, they shall provide the valid certificate of the houses where they have entered the house and the written consent to enter the house signed by the property owner. If a collective household is settled in the unit, it shall provide the address page of the collective household register of the collective household management unit and the written opinion of agreeing to enter the household. 2. (4) If it is approved, the human resources and social security department of this Municipality will send the personnel information to the public security department through data sharing, and inform the applicant through the "One Netcom Office" system and SMS. If the audit fails and is returned during the audit process, the human resources and social security department of this Municipality shall inform the applicant of the results and reasons for failing or returning the audit through the above forms. Article 8 The spouses of returned overseas students whose family members meet the requirements of settling down (they must be married before the overseas students return to China, and their age is more than 5 years away from the legal retirement age) and their children aged 16 and below or above who are studying in ordinary high schools belong to the scope of follow-up. If the applicant's spouse needs to move with him, it should be submitted together with the applicant's application; If the spouse has not returned to China yet, he/she shall provide a valid identity document, and then apply for completing the settlement formalities after returning to China. If the applicant's children need to move with them, if the children are born in China, they must be submitted together after they have registered their birth in their original domicile. If the child is born abroad, it should be submitted together with the applicant's application; If you haven't returned to China yet, you should provide valid identity documents, and then apply for completing the settlement procedures after returning to China.

Article 9 Materials to be submitted by family members when they move with them (1) Household register of spouses and children, ID card, address materials for settlement in Shanghai, children's birth certificate, China passport or travel permit and visa, entry and exit records; Children over the age of 16 who are studying in ordinary high schools need to move with them, and provide school registration materials. (2) A copy of the spouse's personnel file verification form and related materials provided by the file storage unit in Shanghai. If the spouse used to have a work unit in other provinces and cities before coming to this city, provide the materials that the original work unit agreed to transfer or have left. After the audit, it is found that it is not suitable to apply for settlement in violation of relevant regulations or defraud the permanent residence of this city through false materials, etc., and the audit decision is revoked and its permanent residence in this city is cancelled; Those who constitute a crime shall be investigated for criminal responsibility according to law.

article 11 other detailed rules for implementation shall come into force as of December 1, 22 and shall be valid until November 3, 225.
