Criteria for filing the crime of illegal fishing:

1. Illegal fishing of aquatic products of more than 500 kilograms and more than 5,000 yuan in inland waters, or illegal fishing of aquatic products of more than 2,000 kilograms and more than 20,000 yuan in naval battles;

2. Illegal fishing of aquatic animal larvae and brooding parents with important economic value, or fishing of aquatic products in conservation zone with a weight of more than 50 kg or a value of more than 500 yuan in inland waters;

3. Use prohibited tools or methods to fish in the closed fishing area;

4. Use prohibited tools or methods to fish during the fishing ban.

The sentencing standards for the crime of illegal fishing are as follows:

1. Anyone who catches aquatic products in a no-fishing area or during a no-fishing period or uses prohibited tools or methods, if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine;

2. If a unit commits the crime of illegal fishing of aquatic products, it shall be fined, and the directly responsible person in charge and other directly responsible personnel shall be punished in accordance with relevant laws and regulations.

Legal basis: Article 340th of the Criminal Law of People's Republic of China (PRC).

The crime of illegal fishing of aquatic products violates the laws and regulations on the protection of aquatic resources. If the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not more than three years, criminal detention, public surveillance or a fine.
