Article 1 (Purpose and Basis)

Article 2 (Nature and Scope of Protected Areas)

The Yangtze Estuary ACIPENSER sinensis Nature Reserve (hereinafter referred to as the reserve) is located in the east beach of Chongming Island, which is a special area designated by the municipal government to protect ACIPENSER sinensis and its natural ecological environment.

The reserve starts from Bayao Port in the north and ends at Jiaqian Port in the south. It is surrounded by the reclaimed peripheral levee on the east beach of Chongming Island and the isobath with Wusong elevation of minus 5 meters. Article 3 (Management Organization)

The Shanghai Municipal Commission of Agriculture (hereinafter referred to as the Municipal Commission of Agriculture) shall be responsible for the planning, construction and related management activities of the reserve jointly with the Chongming County Government. The Shanghai Yangtze Estuary Acipenser sinensis Nature Reserve Management Office under the Municipal Agriculture Committee (hereinafter referred to as the Reserve Management Office) is responsible for the daily management of the reserve.

Shanghai Municipal Environmental Protection Bureau (hereinafter referred to as the Municipal Environmental Protection Bureau) is responsible for guiding and supervising the environmental protection work of protected areas.

The relevant departments of marine, water, transportation, public security and maritime affairs of this Municipality shall, in accordance with their respective responsibilities, coordinate in the management of protected areas. Article 4 (Adjustment of the Scope of Protected Areas and Its Procedures)

The scope of the nature reserve can be adjusted according to the changes of siltation, distribution and activities of ACIPENSER sinensis.

The adjustment of the scope of protected areas shall be proposed by the Municipal Agriculture Committee in conjunction with the Chongming County Government and relevant administrative departments. After review by the nature reserve review committee, the Municipal Environmental Protection Bureau will make a comprehensive balance, put forward audit suggestions, and report them to the municipal government for approval and promulgation. Article 5 (Setting of Landmarks)

The management office of protected areas shall, in accordance with the scope of protected areas approved and published by the municipal government, set up regional landmarks in a prominent position on the boundary of protected areas. Article 6 (Management Period of Forbidden Zone)

During the concentrated activities of juvenile ACIPENSER sinensis from May/KLOC-0 to September 30 every year, the protected area will be closed to fishing. During the closure period, it is forbidden to engage in fishery and other production and business activities. Article 7 (Management Period of Non-closed Area)

During the management of non-prohibited fishing areas, fishermen who enter the protected areas to engage in fishery production activities shall apply for fishing licenses according to law. Article 8 (Prohibited Acts)

No unit or individual may engage in the following activities in the protected areas:

(1) Destroying, damaging or moving boundary markers and protection facilities in protected areas without authorization;

(2) discharging, dumping or disposing of pollutants;

(3) Collecting aquatic animals and plants by poisoning, explosion or electric capture;

(4) Erection, blasting and drilling;

(five) dredging, burning and reclamation;

(6) Other activities that affect the living environment of Chinese sturgeon. Article 9 (Application and Approval of Scientific Research Activities)

For teaching experiments, specimen collection and other needs to enter the protected area to engage in related scientific research activities, it shall submit a written application to the protected area management office; Overseas organizations or individuals engaged in scientific research, teaching experiments and specimen collection activities in protected areas shall submit a written application to the Municipal Agriculture Committee.

The written application shall include the following contents:

Basic information of the applicant;

(two) the specific project and main purpose of entering the protected area;

(three) the time, content, scale, number of people, scope and related equipment used in the scheduled activities.

The Municipal Agriculture Commission or the protected area management office shall make a decision on examination and approval within 20 working days from the date of accepting the application. Approved by the examination and approval issued a "protected area pass"; Do not agree, it shall explain the reasons in writing.

If it is necessary to catch Chinese sturgeon or collect Chinese sturgeon fish specimens when entering the protected area for scientific research and other activities, they can engage in related activities only after being audited by the department that accepts the application and applying for a special fishing license from the fishery administrative department of the State Council. Article 10 (Control of Total Entry Personnel)

The management office of protected areas shall, jointly with the Chongming county government and the fishery administration and other relevant administrative departments, formulate a plan to control the total number of people who enter the protected areas to engage in scientific research and other activities during the management period of closed fishing areas and non-closed fishing areas. Article 11 (Entry in Emergency)

Entering the reserve due to emergencies such as flood control and disaster relief and bad weather. Shall abide by the provisions of the reserve, and notify the reserve management office; After the relevant situation is eliminated, it should immediately withdraw from the protected area. Article 12 (Emergency Treatment)

Where an accident or other unexpected event has caused or may cause pollution or other damage to the protected area, the relevant unit or individual shall take immediate measures, report to the protected area management office and the local environmental protection department in time, and accept the investigation and handling. Article 13 (Peripheral Operation Control)

Where major construction projects are carried out around the reserve, the operating unit shall consult with the reserve management office in advance, and if it may have an impact on the natural resources and ecological environment of the reserve after expert argumentation, the operating unit shall take effective control measures. Article 14 (Accidental Capture and Release)

Fishermen who accidentally catch rare and endangered aquatic wild animals such as Chinese sturgeon in fishing operations shall immediately and unconditionally release them. Article 15 (Emergency Disposal)

Any unit or individual who finds that the Chinese sturgeon and other precious and endangered aquatic wild animals are injured, stranded or trapped by straying into a port or a tributary of a river shall take emergency rescue measures and report to the reserve management office in time; If it is found that the Chinese sturgeon and other precious and endangered aquatic wild animals die, it shall be handed over to the reserve management office for proper handling.

If property losses are caused by the protection and rescue of Chinese sturgeon and other precious and endangered aquatic wild animals, they may apply to the reserve management office for compensation; After investigation, the protected area management office shall give appropriate compensation in accordance with relevant regulations and standards.
