What principles should be followed in the protection and inheritance of red resources?

Article 1 In order to strengthen the protection and inheritance of red resources, carry forward red culture, educate patriotism and revolutionary traditions, and cultivate and practice socialist core values, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this Municipality.

Article 2 These Regulations shall apply to the investigation, identification, protection and management, inheritance and utilization of red resources and other related activities within the administrative area of this Municipality.

Where laws and regulations provide otherwise for the protection and inheritance of red resources, such provisions shall prevail.

Article 3 The term "red resources" as mentioned in these Regulations refers to the following material and spiritual resources with commemorative significance, educational significance and historical value, which were formed under the leadership of China's * * * Production Party in the new democratic revolution, socialist revolution and construction, reform and opening up, and socialist modernization, as well as in the new era of Socialism with Chinese characteristics:

(1) Sites, former sites, memorial facilities or places, etc. ;

(2) Archives, manuscripts, documents, audio-visual materials and objects;

(3) Other representative resources.

Article 4 The protection and inheritance of red resources shall follow the principles of respecting historical facts, inheriting and carrying forward, grading identification and territorial management, implement the policies of giving priority to protection, giving priority to rescue, rational utilization and strengthening management, earnestly safeguard the unique historical environment of red resources, and maintain its historical authenticity, resource integrity and cultural continuity to the maximum extent.

Article 5 The people's governments of cities and counties (districts) shall strengthen their leadership in the protection and inheritance of red resources, incorporate the protection and inheritance of red resources into national economic and social development plans, land and space plans and rural revitalization plans, and establish and improve a budget and guarantee mechanism that is compatible with economic and social development and meets the needs of red resources protection and inheritance.

City, county (District) people's governments shall establish and improve the coordination mechanism for the protection and inheritance of red resources such as information sharing and joint meetings, and coordinate and solve major problems in the protection and inheritance of red resources.

Township people's governments and sub-district offices shall do a good job in the protection and inheritance of red resources within their respective jurisdictions.

Article 6 The municipal administrative department of red resources shall be responsible for the guidance, coordination and supervision of the protection and inheritance of red resources in counties (districts), and do a good job in the protection and inheritance of other red resources within the scope of duties and powers.

County (District) administrative department of red resources is responsible for the protection and inheritance of red resources within their respective administrative areas, and shall perform the following duties:

(a) the implementation of laws, regulations and policies on the protection and inheritance of red resources;

(two) in conjunction with the relevant departments to prepare and implement the red resources protection and inheritance plan;

(three) to organize the investigation, identification, filing and declaration of red resources;

(four) to organize the rescue, repair, restoration and construction of red resources;

(five) the establishment, management and maintenance of red resource protection signs and facilities;

(six) to organize publicity and education, display and utilization, scientific research and cultural exchanges of red resources;

(seven) responsible for the safety management of red resources, investigate and deal with illegal acts according to law;

(eight) other work related to the protection and inheritance of red resources.

City, county (District) veterans affairs administrative department is responsible for the protection and utilization of red resources, historical materials and martyrs' praise in martyrs memorial facilities.

City, county (District) education administrative department is responsible for supervising and guiding the school to carry out the work related to the protection and inheritance of red resources.

Seventh city and county (District) departments of cultural relics, development and reform, finance, public security, agriculture and rural areas, housing and urban and rural construction, natural resources, ecological environment, emergency management, civil affairs, archives and other departments, according to their respective responsibilities, do a good job in the protection and inheritance of red resources.

Eighth trade unions, the Communist Youth League, women's federations and other mass organizations should give full play to their respective advantages and organize the work related to the protection and inheritance of red resources.

Villagers' committees and community residents' committees shall assist in the protection and inheritance of red resources.

Article 9 The city and county (district) shall set up an expert committee on the protection and inheritance of red resources composed of professionals in related fields to provide consultation, demonstration and evaluation services for the protection and inheritance of red resources.

Tenth units and individuals are encouraged to participate in the protection and inheritance of red resources. Units and individuals that have made outstanding contributions to the protection and inheritance of red resources shall be commended and rewarded in accordance with relevant regulations.

Chapter II Investigation and Identification

Twelfth city and county (District) administrative departments of red resources shall organize the general survey and special investigation of red resources, do a good job in the collection, sorting, identification and archiving of red resources and related documents, and establish a red resource database.

Article 13 The identification of red resources shall be organized by the administrative department in charge of red resources of the county (district) on the basis of fully soliciting opinions on propaganda, cultural relics, education, civil affairs, affairs of retired military personnel, local chronicles of party history and other aspects, and submitted to the county (district) people's government for approval and promulgation.

Involving two or more county-level administrative regions or county (District) people's governments as municipal, the county (District) people's government shall report to the municipal administrative department of red resources for examination and approval, and report to the municipal people's government for approval and promulgation.

Article 14 In case that the county (district) people's government fails to declare the red resources in accordance with the provisions of Article 3 of these regulations, if it is really necessary, the municipal administrative department of red resources can directly organize the municipal committee of experts on the protection and inheritance of red resources to conduct demonstration, and solicit opinions on propaganda, cultural relics, education, civil affairs, affairs of retired military personnel, local history of the Party history, etc. , and put forward the expert opinion, approved by the Municipal People's government.

Fifteenth city and county (District) administrative departments of red resources shall compile a list of red resources protection approved by the people's government at the same level, and make it public. The protection list shall be updated in time according to the adjustment of red resources.

The list of red resources protection shall specify the name, type, ownership of property rights, historical value, scope of protection, management and protection units, etc. Immovable red resources shall be accompanied by clear geographical coordinates and corresponding boundary topographic maps.

Chapter III Protection and Management

Sixteenth city and county (District) people's governments shall, in accordance with the provisions of laws and regulations on the protection of cultural relics, implement the scope of protection and construction control zones for red resources belonging to immovable cultural relics.

The protection scope and construction control zone of other immovable red resources shall be determined by the approved municipal and county (District) people's governments and announced to the public.

Seventeenth immovable red resources listed in the protection list shall set up protection signs on the spot. Signs indicate: name, historical description, appraisal institution, appraisal date, protection scope and construction control zone.

Eighteenth included in the protection list of red resources to implement the responsibility system for protection. The owner or user of red resources is the person responsible for protection and shall perform the following duties:

(a) the daily management, maintenance and repair of red resources and their protection signs and facilities;

(two) the implementation of fire prevention, flood control, lightning protection, earthquake prevention and other safety measures, to prevent man-made damage, do a good job in technical prevention, timely eliminate potential safety hazards;

(three) to organize or assist the red resources improvement, environmental improvement, collection, digital management, display and utilization projects;

(four) to organize or assist in the service and management of tourists and visitors.

If the owner or user of red resources is unclear, the administrative department of red resources of the county (district) shall be the responsible person for protection.

Nineteenth county (district) administrative department of red resources shall sign a protection management agreement with the person responsible for the protection of red resources, and stipulate the contents and measures of protection and the rights and obligations of the person responsible for the protection. Where the ownership and use right of red resources are changed, the owners and users shall inform the local county (district) administrative department of red resources.

County (District) administrative departments of red resources shall organize and carry out business knowledge and skills training, and improve the awareness and ability of those responsible for the protection of red resources to perform their duties.

The county (district) administrative department of red resources shall pay compensation for management and protection to the person responsible for protection.

Twentieth county (District) people's government shall timely rescue and repair the red resources with major security risks such as collapse, damage and loss.

Immovable red resources are destroyed, but the base site or representative environment still exists and has high value, site protection shall be implemented, and reconstruction shall not be carried out at the original site; If it is necessary to rebuild on the original site due to special circumstances, if it belongs to cultural relics, the construction procedures shall be handled in accordance with the laws and regulations on the protection of cultural relics; The reconstruction of other red resources, by the construction unit to the city and county (District) red resources administrative departments to apply for approval by the people's government at the same level.

Where there are potential safety hazards such as damage and loss of movable red resources, the collection unit shall carry out rescue protection through digital measures.

Twenty-first the restoration of immovable red resources should follow the principle of not changing the original state and minimum intervention, and should not damage or change the main structure of the relics and their ancillary facilities, or destroy the integrity and historical features of the relics.

Immovable red resources belong to cultural relics, and their restoration should be carried out in accordance with laws and regulations on cultural relics protection. Other immovable red resources shall be repaired by the person responsible for protection, and the opinions of the administrative department of red resources of the county (district) shall be solicited, and the repair plan shall be prepared and reported to the administrative department of red resources of the city for the record.

If the person responsible for protection does not have the ability to repair, the county (district) administrative department of red resources shall give technical guidance, financial support or compensation, or repair and protect after obtaining the ownership or use right through purchase, property right replacement or lease.

Twenty-second archives, museums, memorial halls, exhibition halls, libraries and other collection units should strengthen the collection of movable red resources.

Encourage units and individuals to donate or sell the collected movable red resources to archives, museums, memorial halls, exhibition halls, libraries and other collection units, and the relevant departments shall give spiritual encouragement or material rewards to the donors.

Twenty-third city and county (District) people's governments shall establish a safety mechanism for the protection and management of red resources, formulate emergency plans, conduct regular safety inspections, and timely discover and eliminate potential safety hazards.

Chapter IV Inheritance and Development

Article 24 The inheritance and promotion of red resources should be guided by the socialist core values, strengthen the inheritance of the original historical value and cultural connotation of red resources, and maintain adaptation and coordination with the historical atmosphere and place spirit.

Article 25 Institutions of higher learning, scientific research institutes, other units and individuals are encouraged to carry out academic research on red resources, create works of art such as literature, film and television, music and fine arts, develop red creative products, and promote the spread of red culture.

Archives, museums, memorial halls, exhibition halls, libraries and other institutions related to the protection and utilization of red resources should strengthen the exploration and research on the cultural connotation and historical value of red resources.

Twenty-sixth to encourage archives, museums, memorial halls, exhibition halls, libraries and other units and individuals to open to the public or publish all or preserved red resources.

Article 27 The municipal and county (district) administrative departments in charge of red resources shall establish a red resource flow sharing mechanism, encourage cross-regional cooperation and exchanges in the protection and inheritance of red resources, and enrich the display forms and contents of red resources display and utilization units such as archives, museums, memorial halls and exhibition halls through legal allocation, exchange and borrowing, so as to realize the sharing of red resources.

Twenty-eighth city and county (District) people's government should make use of the immovable red resources to establish patriotic education bases, encourage and support relevant units to establish education and training bases based on red resources, and organize patriotic and revolutionary traditional education.

Twenty-ninth state organs, enterprises and institutions and other organizations should use red resources to carry out thematic education activities.

Schools should use red resources to carry out moral education, intellectual education, physical education, aesthetic education, labor education and other educational and teaching activities, organize students to visit red old sites, sites, memorial facilities or places every academic year, and carry out patriotic education and social practice activities.

Thirtieth newspapers, radio, television, Internet and other news media should strengthen the theme propaganda of the protection and inheritance of red resources, introduce the knowledge of the protection and inheritance of red resources by setting up special topics and columns, publicize the advanced models of the protection and inheritance of red resources, and publicly expose the illegal acts of destroying red resources.

Article 31 The people's governments of cities and counties (districts) should focus on red education and training, red tourism and red cultural creativity, improve infrastructure, build red resource brands with local characteristics, and promote tourist routes, services and products with red resource characteristics.

Chapter V Legal Liability

Thirty-second in violation of the provisions of the provisions of article eleventh, the people's governments at or above the county level shall be ordered by the administrative department of red resources to make corrections; If losses are caused, it shall bear civil liability according to law; Red resources belonging to cultural relics shall be punished in accordance with the provisions of the Law of People's Republic of China (PRC) on the Protection of Cultural Relics; Those who belong to the object of protection of heroic martyrs shall be punished in accordance with the provisions of the Law of People's Republic of China (PRC) on the Protection of Heroic Martyrs. Those who violate the administration of public security shall be punished by the public security organs according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Article 33 If the administrative department in charge of red resources of the city or county (district) or other relevant departments and their staff violate the provisions of this Ordinance, abuse their powers, neglect their duties or engage in malpractices for selfish ends, resulting in the damage or loss of red resources, the responsible person in charge and other directly responsible personnel shall be punished according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Chapter VI Supplementary Provisions

Article 34 These Regulations shall come into force as of 202 1, 1 and1.
