Measures of Yiyang Municipality for the Protection of Immovable Cultural Relics

Article 1 In order to strengthen the protection and management of immovable cultural relics, standardize the rational utilization of immovable cultural relics, inherit excellent historical and cultural heritage, and promote regional cultural characteristics, these Measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Cultural Relics and other laws and regulations, combined with the actual situation of our city. Article 2 These Measures shall apply to the protection, management and utilization of immovable cultural relics within the administrative area of this Municipality. Article 3 The term "immovable cultural relics" as mentioned in these Measures refers to cultural relics protection units approved and announced by the people's governments at or above the county level, and immovable cultural relics registered according to law that have not been approved and announced as cultural relics protection units, including ancient cultural sites, ancient tombs, ancient buildings, cave temples, stone carvings, murals, important historical sites in modern times and representative buildings. Article 4 The protection of immovable cultural relics shall follow the principles of government leading, departmental cooperation, social participation and rational utilization. Fifth city and county (city) people's governments (administrative committees) and township people's governments (street offices) are responsible for the protection of immovable cultural relics within their respective administrative areas.

City, county (city) cultural relics administrative departments shall supervise and manage the protection of immovable cultural relics within their respective administrative areas.

City, county (city) people's government (CMC) planning, housing and urban construction, land and resources, public security, finance, education, tourism, religion, fire protection and other departments are responsible for the protection of immovable cultural relics within their respective responsibilities. Article 6 The protection of immovable cultural relics within the administrative area of this Municipality shall be incorporated into the responsibility system of leaders at all levels and into the target management assessment of governments at all levels.

Improve the city, county (city), township (street) and village (community) four-level immovable cultural relics safety management network, and implement the responsibility of cultural relics safety step by step.

Establish a system of immovable cultural relics protection personnel, implement the government's purchase of cultural relics protection services, and implement the units or persons responsible for cultural relics safety one by one. Article 7 The municipal, district and county (city) people's governments (administrative committees) shall incorporate the protection of immovable cultural relics into the national economic and social development plan at the corresponding level, and the funds required for the protection of immovable cultural relics shall be included in the fiscal budget at the corresponding level, which will increase with the growth of fiscal revenue.

Special funds for the safety management of immovable cultural relics are included in the financial budget of the city, district and county (city), and are earmarked for the maintenance of immovable cultural relics safety facilities and the payment of wages to cultural relics protectors.

The business income and social donations of immovable cultural relics protection units shall be earmarked for the protection of immovable cultural relics, and no unit or individual may occupy or misappropriate them. Article 8 The administrative department of cultural relics shall, jointly with the departments and units of education, science and technology, internet information, press and publication, radio and television, do a good job in publicity and education on the protection of immovable cultural relics. Article 9 All units and individuals have the obligation to protect immovable cultural relics, and have the right to stop and report acts of destroying or damaging immovable cultural relics and their protection signs.

Encourage group organizations and individuals to participate in immovable cultural relics protection activities. City, county (city) people's government (CMC) shall commend and reward the units and individuals that have made outstanding contributions to the protection of immovable cultural relics. Tenth city, county (city) cultural relics administrative departments shall carry out the identification, registration and publication of all kinds of immovable cultural relics according to law, formulate specific protection measures for all kinds of immovable cultural relics and announce their implementation.

City, county (city) people's government (Administrative Committee) shall, in accordance with the law, delimit the necessary scope of protection and construction control zones for cultural relics protection units, make signs, establish records and files, set up specialized agencies or arrange special personnel to be responsible for management. Eleventh city and district, county (city) administrative departments of cultural relics shall publish the list of cultural relics protection units within their respective administrative areas, protection level, protection scope, construction control zone, management organization (manager), protection planning and protection measures on the government website at the corresponding level, and update them in time. Article 12 The administrative department of cultural relics shall, according to the needs of the protection of immovable cultural relics, work out the protection plan of cultural relics protection units in the whole region in conjunction with the urban and rural planning and construction departments at the same level, stipulate the protection measures of cultural relics protection units at all levels and underground cultural relics burial areas, and incorporate the protection scope, construction control zone and cultural relics burial areas of cultural relics protection units into the detailed urban regulatory planning. Thirteenth towns, streets and villages with particularly rich cultural relics and great historical value or revolutionary commemorative significance shall be investigated and preliminarily demonstrated by the competent department of urban and rural planning and construction in conjunction with the administrative department of cultural relics at the same level. Eligible historical and cultural cities or blocks, towns and villages shall be declared according to law. Fourteenth city and county (city) people's government (Administrative Committee) shall organize the preparation of historical and cultural cities, blocks, villages and towns protection planning within their respective administrative areas, and incorporate them into the overall urban planning.

The protection planning of historical and cultural cities, blocks and villages and towns should emphasize the protection of architectural layout, environment and historical features of cultural relics and historic sites. Fifteenth construction projects involving the protection of immovable cultural relics, the relevant planning meeting shall notify the administrative department of cultural relics to participate; The planning department shall, before issuing the site selection opinions, the construction land planning permit and the rural construction planning permit, examine whether the construction unit is approved by the administrative department of cultural relics and the people's government with the right of approval according to law.

Where the construction project involves the protection of immovable cultural relics, the housing and urban-rural construction department shall require the construction unit to provide the cultural heritage protection evaluation opinions issued by the cultural relics administrative department according to law before issuing the construction permit.

When a construction unit discovers cultural relics during construction, it shall immediately stop construction and report to the administrative department of cultural relics in time. After receiving the report, the administrative department of cultural relics shall arrive at the scene within twenty-four hours and put forward handling opinions within three days.
