Measures for the Administration of Domestic Waste in Huaibei City (for Trial Implementation)

Chapter I General Provisions Article 1 In order to strengthen the management of domestic garbage, improve the living environment, save resources and promote the construction of ecological civilization and sustainable economic and social development, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Environmental Pollution by Solid Wastes, the Regulations on the Administration of City Appearance and Environmental Sanitation and other laws and regulations, and in combination with the actual situation of this Municipality. Article 2 These Measures shall apply to the management activities such as source reduction, delivery, collection, transportation, treatment and planning and construction of related facilities of domestic garbage within the administrative area of this Municipality.

The term "domestic waste" as mentioned in these Measures refers to the solid waste generated in daily life or activities providing services for daily life, and the solid waste regarded as domestic waste according to laws and administrative regulations. Article 3 The management of domestic waste in this Municipality follows the principles of government-led, national participation, urban and rural planning, territorial management, local conditions, market operation and social supervision, and gradually improves the level of domestic waste reduction, recycling and harmlessness through source reduction, classified delivery, classified collection, classified transportation and classified treatment. Article 4 The people's governments of cities and counties (districts) (including the administrative organs of development zones, the same below) shall establish a domestic waste management system of classified delivery, classified collection, classified transportation and classified treatment, so as to achieve effective coverage of the domestic waste classification system.

Rural domestic waste classification work, the county (District) people's government according to the local actual overall planning, and gradually promote. Fifth city and county (District) people's governments should strengthen leadership and determine the management objectives of domestic waste.

The Town People's Government and sub-district offices shall be responsible for the specific implementation of the classified delivery, collection and transshipment of domestic garbage and related supervision and treatment work in this area.

Village (neighborhood) committees shall assist in the management of domestic waste within their respective jurisdictions, and publicize and mobilize units and individuals to participate in the reduction and classified delivery of domestic waste. Sixth city management department is responsible for the management of municipal solid waste, and guide, supervise and assess the management of municipal solid waste in counties (districts).

County (District) urban management department is responsible for the daily supervision and management of domestic waste within its administrative area. Seventh city and county (District) people's government departments in accordance with the division of responsibilities responsible for the management of domestic waste related work:

(a) the development and reform department is responsible for the approval, approval and filing of domestic waste-related projects, and is responsible for the classification of domestic waste in public institutions such as party and government organs;

(two) the natural resources and planning department is responsible for the review and approval of land use and planning for the construction projects of domestic garbage collection, transportation and disposal facilities;

(three) the ecological environment department is responsible for examining and approving the environmental impact assessment documents of the construction projects of domestic waste disposal facilities, and guiding and supervising the prevention and control of domestic waste pollution;

(4) The housing and urban-rural construction department is responsible for the management of domestic waste in construction sites, supervising the renovation of new residential areas and old residential areas and supporting the construction of domestic waste treatment facilities, guiding and supervising the classification of domestic waste in property service enterprises, and incorporating the classification of domestic waste into the assessment content of property service enterprises;

(five) the commercial department is responsible for guiding the recovery of recyclable materials;

(six) the market supervision department is responsible for the supervision and management of product packaging reduction.

Education, public security, finance, agriculture and rural areas, water affairs, culture, tourism and other relevant departments shall, according to their respective responsibilities, do a good job in the management of domestic waste. Eighth units and individuals that produce domestic garbage shall pay the domestic garbage disposal fee in accordance with the charging standards and relevant regulations determined by the municipal and county people's governments. Article 9 People's governments at all levels and relevant departments shall popularize the knowledge of domestic waste classification to the public in various ways, enhance the public's awareness of reduction and classification, organize public opening activities of domestic waste classified collection, transportation and disposal facilities, and encourage the public to participate in the supervision of domestic waste treatment activities.

The competent education department shall urge all kinds of schools at all levels to incorporate the knowledge of source reduction, classified delivery, recycling and harmless disposal of domestic waste into the educational content, and organize activities such as classified education and practice of domestic waste.

Newspapers, radio, television, internet and other media should regularly carry out public welfare publicity on source reduction and classified delivery of domestic waste. Tenth advocate the whole society to practice a low-carbon lifestyle and reduce the generation of domestic garbage.

Units and individuals shall fulfill the obligation of domestic waste classification, take the initiative to carry out domestic waste classification activities in accordance with the relevant provisions and requirements of garbage classification, cultivate the habit of domestic waste classification, and have the right to dissuade, complain and report violations of these measures. Chapter II Planning and Construction Article 11 The urban management departments of cities and counties shall, jointly with the departments of development and reform, natural resources and planning, formulate plans for the treatment of domestic garbage, which shall be announced to the public after being approved by the people's government at the corresponding level.

County (District) people's government shall, according to the domestic waste control plan, formulate the construction plan for centralized collection, transshipment and treatment facilities of domestic waste, and organize the implementation. Twelfth city and county (District) people's governments shall make overall arrangements for the construction of urban and rural domestic waste collection, transportation and treatment facilities, determine the location of facilities, and improve the comprehensive utilization and harmless treatment level of domestic waste.

City, county (District) people's government departments in charge of commerce should make overall planning, rational distribution of recycling outlets, and promote the recycling of domestic waste.

The people's governments of cities and counties (districts) shall co-ordinate the effective connection between public transportation and treatment facilities of domestic garbage and supporting domestic garbage collection facilities, and strengthen the integration of the classified collection and transportation system of domestic garbage and the recycling system of renewable resources in planning, construction and operation.
