Article 1 These Regulations are formulated in accordance with the Military Service Law of People's Republic of China (PRC), the National Defense Law of People's Republic of China (PRC), the Regulations on Conscription and other relevant laws and regulations, in combination with the actual situation of this province, in order to standardize the management of conscription, ensure the quantity and quality of soldiers, and strengthen national defense construction.

Article 2 These Regulations shall apply to organs, organizations, enterprises (including foreign-invested enterprises and private enterprises, the same below), institutions, grassroots mass autonomous organizations and citizens within the administrative region of this province.

Article 3 It is the sacred duty of every citizen to defend the motherland and resist aggression, and it is the obligation of every citizen to perform military service according to law.

Article 4 People's governments at all levels and their military service organs shall do a good job in conscription according to law, and relevant administrative departments such as public security, supervision, justice, health, personnel, labor security, civil affairs, finance, agriculture, education, transportation, industry and commerce, press and publication, radio and television shall do a good job in conscription according to their respective duties.

The conscription office of the people's government at or above the county level shall, under the leadership of the conscription leading group, be specifically responsible for the conscription work within its administrative area. The conscription office is composed of personnel from military service organs and relevant departments.

According to the arrangements and requirements of the people's government at the county level, all organs, organizations, enterprises and institutions are responsible for the conscription work of their own units, and township people's governments and sub-district offices are responsible for the conscription work in their respective jurisdictions.

Fifth, strengthen the publicity and education of conscription. People's governments at all levels should incorporate it into patriotic education, national defense education and legal publicity planning. Recruitment publicity and education in accordance with the "Regulations on National Defense Education in Jiangxi Province".

Newspapers, radio, television, news websites and other news media should strengthen the publicity and education of military service according to law. Organs, organizations, enterprises and institutions, township people's governments and sub-district offices shall educate citizens in patriotism, revolutionary heroism and military service according to law, and encourage citizens to perform their military service obligations according to law.

Article 7 The funds needed for conscription work shall be included in the budget at the corresponding level by the people's governments at all levels, allocated in time, and gradually increased with the development of local economy.

Article 8 Units and individuals that have made remarkable achievements in conscription shall be commended and rewarded by the people's governments at or above the county level or military service organs. Article 9 The military service organs of the people's governments at the county level, under the leadership of the military service organs of the people's governments at the corresponding levels and the people's governments at higher levels, are responsible for the work of military service registration within their respective administrative areas.

The military service organs at the county level shall, according to the relevant provisions of the state and the actual situation, indicate the conditions for enlistment, deferment, exemption from service, refusal to accept service, conscription and compulsory service, exemption from service and refusal to serve in the reserve service on citizens' military service certificates respectively.

Citizens who have been determined by military service registration to enlist in the army shall obey the unified arrangements of the military service organs and participate in enlistment activities.

Twelfth male citizens of school age shall, within the prescribed time limit every year, carry their military service certificates to military service registration Station to perform the review procedures. Where the domicile of the household registration changes, it shall go through the formalities of change registration with the issuing authority in time; If the military service certificate is lost, it shall promptly report to the issuing authority and apply for a replacement.

Article 15 The administrative department of health of the people's government at or above the county level shall make a work plan for physical examination, deploy medical personnel to engage in physical examination after training, inspect and guide the physical examination at the next level, and organize conditional physical examination reexamination of soldiers and physical examination spot checks of ordinary soldiers.

The physical examination should be attended by the doctors of the receiving troops. The main duty of the doctors in the receiving army is to participate in the work of the main examination room and conduct necessary medical history investigation on the scheduled recruits.

Article 16 Citizens eligible for enlistment shall participate in physical examination according to the requirements of the conscription office of the people's government at the county level, and truthfully reflect their health status.

Seventeenth conscription political review work under the unified organization of the conscription office of the people's governments at or above the county level, by the public security organs responsible for the specific implementation.

Article 18 The public security organ of the people's government at or above the county level shall formulate the work plan for political examination, deploy the personnel engaged in political examination after training, and inspect and guide the political examination work at the next level.

Article 19 The post responsibility system shall be implemented in the physical examination and political examination of citizens eligible for enlistment, and the personnel participating in the physical examination and political examination must strictly implement the relevant regulations and standards of the state and the province to ensure the physical and political quality of recruits.

The civil affairs, finance and auditing departments of the people's governments at or above the county level and their dispatched offices shall, in accordance with their respective duties, strengthen the management, auditing and supervision of the overall work of preferential payments.

Twenty-sixth registered agricultural conscripts, by the local people's government at the county level in accordance with the standard of not less than 70% of the per capita net income of farmers in the county (city, district) last year, and then cash.

Non-agricultural registered conscripts who are self-employed after leaving the army shall be given a one-time economic subsidy by the people's government at or above the county level, and preferential policies shall be given in accordance with the relevant provisions of the state. Labor and social security departments and veterans resettlement institutions shall provide them with employment consultation, employment information and vocational skills training services.

Non-agricultural registered conscripts shall be given living allowance by the local people's government at the county level in accordance with the principle of not less than the local minimum living standard during the period of waiting for resettlement after discharge.

All units must complete the resettlement tasks assigned by the local people's government.

Thirtieth non-agricultural registered conscripts retired, one of the following circumstances, the people's government shall not be placed:

(1) Failing to report to the demobilization and resettlement institution of the people's government or go through the reserve registration formalities with the military service organ within 30 days after the expiration of the registration period without justifiable reasons;

(2) Failing to report for duty for more than 180 days without justifiable reasons after receiving the resettlement notice.

The public security organ shall handle the household registration relationship for the conscripts who are not placed in the preceding paragraph.

Thirty-first enterprises and institutions in rural areas to recruit workers, under the same conditions, should give priority to employment (employment) of demobilized conscripts.

The people's governments at the county level shall arrange work for registered agricultural conscripts who have won class II or above in peacetime and class III or above in wartime.

Thirty-second full-time college students and non-commissioned officers who have been approved to retire from active service shall be resettled in accordance with relevant state regulations.

Resettlement of conscripts who are directly recruited for active service in Tibet after discharge shall be implemented in accordance with the relevant provisions of the provincial people's government. Thirty-third male citizens of school age who refuse or evade military service registration or physical examination, or refuse or evade collection, shall be ordered by the people's government at the county level to make corrections within a time limit; Those who fail to perform within the time limit shall be forced to perform their military service obligations by the people's government at the county level, and may be fined more than 5000 yuan 1000 yuan.

Citizens who refuse or evade the solicitation and refuse to make corrections shall not be employed as national civil servants or employees of state-owned enterprises and institutions within two years, and shall not go abroad, leave the country or pursue further studies.

Thirty-fourth organs, organizations, enterprises and institutions in violation of the provisions of this Ordinance, one of the following acts, the people's government at the county level shall order it to make corrections, and may impose a fine of 1000 yuan to 50000 yuan; The person in charge directly responsible for the unit and other directly responsible personnel shall be given administrative sanctions according to law:

(1) Refusing to complete the conscription task;

(2) obstructing citizens of school age from participating in enlistment or enlistment;

(four) other acts that hinder the recruitment work.

Thirty-fifth in violation of the provisions of this Ordinance, one of the following circumstances, shall be given administrative sanctions by the unit or the superior organ or the supervisory organ; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) to provide convenience for citizens who evade military service;

(2) divulging the secrets of conscription work;

(three) issued false political examination materials, false academic qualifications, false age, false household registration, false medical diagnosis and other false certificates;

(4) Soliciting or accepting bribes;

(five) the conscription staff dereliction of duty, so that unqualified personnel enlisted.

Thirty-sixth in violation of the provisions of this Ordinance, arrears, interception, misappropriation of preferential payments, by the unit or the higher authorities or supervisory organs shall be ordered to make corrections, and the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; If a crime is constituted, criminal responsibility shall be investigated according to law.

Thirty-seventh in violation of the provisions of this Ordinance, one of the following circumstances, shall be punished in accordance with the relevant provisions of laws and regulations; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

(a) obstructing the conscription staff from performing their official duties according to law;

(two) by means of violence, coercion, illegal detention and other means to prevent citizens from participating in military service registration, physical examination or enlistment;

(3) Refusing or evading military service in wartime.
