Provisions of Zhuhai Municipality on Comprehensive Control of Anti-smuggling

Chapter I General Provisions Article 1 In order to effectively prevent and crack down on smuggling and maintain the order of the socialist market economy, these Provisions are formulated in accordance with the Customs Law of People's Republic of China (PRC) and other relevant laws and administrative regulations, combined with the actual situation of this Municipality. Article 2 Anti-smuggling work adheres to the principle of combining crackdown with prevention and putting prevention first; Follow the principles of joint anti-smuggling, unified handling and comprehensive management.

Anti-smuggling work into the city's comprehensive management system of social security. Article 3 The municipal and district people's governments (including the administrative committees of economic functional zones, the same below) shall, in accordance with these provisions and the relevant provisions of the state, carry out comprehensive anti-smuggling control work.

City and District Anti-smuggling Comprehensive Management Office (hereinafter referred to as the Anti-smuggling Comprehensive Management Office) is specifically responsible for the organization, coordination, inspection, supervision and guidance of joint anti-smuggling actions, special actions and comprehensive management.

Customs, public security, frontier defense, industry and commerce departments shall perform anti-smuggling duties according to law, and inspection and quarantine, environmental protection, quality and technical supervision, maritime affairs, fishery administration, water transport and other departments shall, within their respective functions and powers, support and cooperate with anti-smuggling departments to carry out anti-smuggling work. Article 4 The funds needed for the comprehensive control of anti-smuggling shall be included in the fiscal budget of the municipal and district people's governments at the corresponding levels to guarantee it.

The special anti-smuggling funds allocated by the state and the province shall be used for special purposes and shall not be used for other purposes. Chapter II Duties Article 5 The Office of Comprehensive Smuggling Control shall perform the following duties:

(a) to implement the laws, regulations and policies of the state on comprehensive anti-smuggling management, study and formulate the laws, regulations and policies on comprehensive anti-smuggling management in our city, and organize their implementation after approval.

(two) to organize, coordinate, inspect, supervise and guide the joint anti-smuggling operations, special operations and comprehensive management work of the whole city and relevant departments.

(six) to investigate, collect and analyze the anti-smuggling intelligence materials, and report the relevant information to the municipal and district people's governments and notify the relevant departments.

(seven) to establish and improve the town people's government (including street offices) and neighborhood committees' anti-smuggling responsibility system.

(eight) to perform other duties as prescribed by laws, regulations and rules. Article 6 The Customs is the national entry-exit customs supervision and administration organ, which independently performs the duties of smuggling investigation according to law and is not limited by the geographical scope of this Municipality.

The municipal and district people's governments and their departments shall support the customs in exercising its functions and powers according to law. Article 7 Public security organs shall perform the following duties:

(a) to assist and cooperate with relevant departments to carry out anti-smuggling work, and report anti-smuggling information and intelligence to the Office of Comprehensive Control of Smuggling and relevant departments in a timely manner.

(two) to investigate and deal with non-tax smuggling cases of guns and drugs outside the customs supervision area according to law.

(three) to assist the customs, frontier defense and industrial and commercial departments to perform their anti-smuggling duties when encountering resistance. Article 8 The frontier defense department shall perform the following duties:

(1) To investigate and deal with land smuggling activities in sea areas, land border areas and coastal areas under its jurisdiction.

(2) Seize suspected smuggling cases and suspected smuggling cases and hand them over to the customs in time.

(3) If the seized suspected smuggled goods are ownerless and the import source cannot be ascertained, they shall be handed over to the relevant departments for handling.

(4) Strengthen contact and cooperation with other anti-smuggling departments to realize information sharing. Article 9 The industrial and commercial departments shall perform the following duties:

(1) To supervise, rectify and standardize the trading market of imported commodities in conjunction with relevant departments, and investigate and deal with the distribution of imported commodities and articles without legal sources.

(two) to cooperate with the relevant departments to investigate and deal with the suspected smuggling behavior of import and export enterprises and special industries. Article 10 Inspection and quarantine institutions shall perform the following duties:

(a) to cooperate with the relevant departments in the inspection and quarantine of goods and articles suspected of smuggling.

(two) to give priority to the inspection or identification of goods and articles suspected of smuggling entrusted by the relevant anti-smuggling departments.

(3) To supervise the destruction of animals and plants, their products and other quarantine objects smuggled from epidemic areas. Eleventh maritime, water transport, fishery, fishery and other units shall perform the following duties:

(a) support and cooperate with the anti-smuggling departments to carry out anti-smuggling work within their respective statutory functions and powers.

(two) to establish a comprehensive anti-smuggling management responsibility system, and regularly report the anti-smuggling work to the anti-smuggling comprehensive office.

(three) to participate in the joint action and special action organized by the Municipal Office of Comprehensive Management of Combating Smuggling.

(four) to participate in the establishment of anti smuggling information linkage mechanism. Twelfth town people's government (including street offices) and neighborhood committees shall perform the following duties in the comprehensive management of anti-smuggling:

(a) to implement the laws, regulations and rules of comprehensive anti-smuggling management.

(two) to cooperate with relevant departments to carry out anti-smuggling work.

(three) to establish a comprehensive anti-smuggling management system, improve the information reporting network, and implement the anti-smuggling work responsibility system.

(four) to carry out anti-smuggling publicity and education in various ways.
